Joseph met in regular session on Thursday, May 10, 1979 at 7:30 p.m. in City Hall. Members Present: Acting Mayor Herman Schneider; Councilmen Bud Reber, steve I Dehler, Mike Husen; Clerk Bob Johnson; Treasurer Leo Sadlo. Treasurer Report: City Treasurer Leo Sadlo presented the monthly fund report. A motion was made by Dehler seconded by Husen to approve the treasurer report as presented. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Park Land Deed - Sale of Property: Letter from City Attorney Tom Jovanovich, relating to sale of park property, presented. Copies to Council. Minutes Approved: Minutes of March 22, 1979. Minutes of the April 5, 1979 meeting was corrected as follows: . . towing charges by the City, dUe to misunderstanding resultihg directly frOm the conversation between Mr. Roman Reber ahd street Commissioner Dehler, and refer parking etc. The correcting motion was made by Husen seconded by Dehler. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. A motion was made by Husen seconded by Dehler to approve minutes of March 22, 1979 as presented and minutes of April 5, 1979 as corrected. Ayes: Schneider, Reber, Dehler, Husen. 1 Nayes: None Motion carried. Sno:""Joes: Ray Harlander and Ron Zenzen were present, representing the Sno-Joes. They requested permission to erect a structure in Millstream Park - on lease basis - for storage and meetings. Advised to meet with Park Board for their consideration and advice. Millstream Park Fence: Damaged fence at Millstream Park reportedly repaired. pump Repair - Water Department: Acting Mayor Schneider reported bearing and seal malfunction of filtration plant motor. Replacement ordered. Pat Schneider - Recreation Director: Pat Schneider was present regards summer recreation program. Hiring an assistant program director was con- sidered by the Council. A motion was made by Dehler seconded by Husen to approve expenditure of $480.00 (160 hours @ 3.00) for a Summer Recreation Director assistant. Ayes: Schneider, Reber, Dehler, Husen. N aye s : None Motion carried. Sponsor: Recreation Association offered to sponsor youth baseball program. Council agreed to Recreation Association sponsorship. street Light Change: A motion was made by Reber seconded by Dehler to approve I street lighting change of nine fluorescents to high pressure sodium. Ayes: Schneider, Rober, Dehler, Husen. Nayes: None Motion carried. 887 Daniel Funeral Home Representatives: Tom Daniel and Dave Daniel of Daniel~s Funeral Home were present regards expansion of present funeral parlor. Requesting variance or re-zoning to permit addition. Re-siding and -- re-roofing planned this spring. A remodeling - expansion plan was presented. It includes rear surfaced parking lot. Daniel's indicated they contacted neighbors and presented a statement of support from some area residents (12 signatures). Daniel's were informed request for re-zoning must return to Planning Commission or the present zoning ordinance would have to be amended to permit a funeral home in an R-2 area. Councilman Husen suggested amendment of zoning ordinance. zoning Board of Appeals would conduct a public hearing after question has been submitted to Planning Commission. Interim Zoning and Sub- division Regulation Ordinance information presented to Daniel's. Question of parking lot size raised. Attorney Jovanovich suggested a variance rather than re-zöning. Jovanovich also stated that the Council is limited in its decision to amend zoning Ordinance No. 59. The Daniels were advised to petition Planning Commission requesting a variance on re-zoning. Advised to submit request to Planning Commission Chairman Ben Kremer. A public hearing will be required. Midway Bar Hearing - 9:30 P.M.: Mr. & Mrs. Art Lamprecht were present because of alleged liquor violation. Attorney informed licensees of their rights. Licensees were also notified if objecting to council recommendation they may request another hearing. Police evidence presented by Chief Lorentz, March 20, 1979 date of violation for selling liquor to minor. Statement made to Chief Lorentz indicating minor was drinking at Midway Bar. A motion was made by Husen seconded by Dehler that the City of st. Joseph resolve to suspend the liquor license of Lamprecht, Inc. dba Midway Bar for a period of one week due to seriousness of violation presented during hearing tonight (May 10, 1979) . The period of suspension shall commence on June 3 and continue through June 9, 1979. voting for motion: Husen, Dehler, Schneider. voting against motion: Reber. Motion carried. Attorney Jovanovich advised licensee of right to protest this hearing and request another hearing on license suspension. (a tape of this hearing has been placed on file until disposition of this matter has been completed). City Engineer: Joe Bettendorf city engineer reports: Kenko Inc. reportedly coming in Tuesday or Wednesday of next week for Kenko inspection in Cloverdale Estates 2nd Addn. Sewer~ine Measures: Engineer Bettendorf presented an estimate of sewer line measurement - 2 st. Bens sewer manholes - described recording device operation flow recording - monitoring 30 days. $965.00 - I manhole (2 - $1300 - $1400) July 15 - Oct 15, period of monitoring. Millstream Add: Engineer reported he will no longer work on Millstream Addn. project - completing feasibility report - after completion engineering firm will first consult council on possible conflict of interest projects. 888 EI Paso Sewer: Attorney Jovanovich presented information on sanitary sewer easement and proposed expansion at El Paso Club & Lanes question of building over or moving manhole. straigh~ing line, to by pass existing manhole in problem area, cost estimate of $4000 to $5000. Easement will be provided if line is moved - cost to be shared - further negotiation to be made. - Scout Bldg Lease: A motion was made by Husen seconded by Reber to approve lease agreement with Scout Troop #84 for placement of bldg in Waste- water plant area. Ayes: Reber, Dehler, Husen, Schneider Nayes: NOne Salary Increase - Part-time Police: A motion was made by Dehler seconded by Husen to approve salary increase to $5.00 per hour for part time patrolmen with a maximum of part time patrol hours set at 40 hours per week until a third full time officer is hired. Ayes: Reber, Dehler, Husen, Schneider Nayes: None A motion was made by Husen seconded by Dehler to pay the $5.00 per hour salary increase for part time officers retroactive to the first day they worked alone. (1 day) Ayes: Husen, Dehler. Nayes: Reber Abstaining: Schneider. Motion carried. A motion was made by Reber seconded by Dehler to close alley for auction at Henry Court - Bill Baggenstoss residence on May 15 - 2p.m. to 9 p.m. Ayes: Reber, Dehler, Husen, Schneider Nayes: NOne Liquor Applications: A motion was made by Dehler seconded by Husen to approve the following liquor applications for 1979-80 licensing period: El Paso club & Lanes, Inc. ; Lamprecht, Inc. dba Midway Bar; Dale Schneider dba Sal's Bar & Cafe; La Playette, Inc. Mark zimmer,Manager; American Legion Post 328, dba Legion Club; Graffi ti , Inc. HOí'lard Zimmer; st. Joseph Liquor Shoppe, Dave Hollander. Watts Electric Softball field project: A motion was made by Reber seconded by Husen to approve final payment to Watt's Eeectric, Long Prairie, in the Millstream Softball Field #2, lighting project, ívi th the following stipulations: 1 ) City receives list of suppliers and subs 2) All lein waivers are in order. 3 ) State certificate of tax withholding has been received by City Ayes: Reber, Dehler, Husen, Schneider Nayes: None Clerk Institute: On motion by Reber seconded by Husen the council approved the City Clerk attendance at the Clerk's Institute Year II at the U. of Minnesota June 18 thru 22. Ayes: Reber, Dehler, Husen, Schneider. Nayes: None 88° u Engineering Alley Surfacing: A motion was made by Husen seconded by Reber to instruct engineer to estimate total cost and establish grades in the quarter alley encompassing new bank area. Ayes: Schneider, Reber, Dehler, Husen I Nayes: None Motion carried A motion was made by Dehler seconded by Reber to schedule public hearing on alley surfacing project for June 21, 1979 at 8 p.m. ln Ci ty Hall. Ayes: Schneider, Reber, Dehler, Husen Nayes: None Motion carried Bills Presented: A motion was made by Husen seconded by Reber to pay bills as presented. Ayes: Schneider, Reber, Dehler, Husen Nayes: None Motion carried Fire Board Meeting: A motion was made by Dehler seconded by Reber to approve purchase of protective clothing for 2 fire dept members (total cost $550.00 city cost share.) Ayes: Schneider, Reber, Dehler, Husen ~axes. : ,None Motion carried . ._~ Fire Convention: A motion by Reber seconded by Dehler to approve attendance of 2 firemen to State Convention at Grand Rapids, MN - June 27 - 28 and 29.
