Pursuant to due call and notice thereof the City Council of the City of st.
Joseph met in special session on June 21, 1979 at 7:30 p.m. in City Hall.
Members Present: Mayor Hugo Weyrens; Councilmen steve Dehler, Mike Husen, I
Herman Schneider, Bud Reber; Secretary Laurie Terwey (Clerk Bob
Johnson at Clerk's Institute); city Engineer Joe Bettendorf; City
Attorney Tom Jovanovich.
others Present: Police Chief Bill Lorentz, Police Advisory Commission President
Gerald Derr.
Police Chief and Gerald Derr: Reviewed police applicants test scores. Randall
Bush was the recommended applicant by the PAC.
A motion was made by Reber seconded by Schneider to hire Randall Bush
as new patrolman.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None Motion carried.
The Police Advisory Commission recommended that the City adopt the
stearns County pay schedule for the police force. The schedule was
reviewed by the Council. Chief Lorentz asked for a new salary nego-
tiation date of January 1st. The Council decided to pay the new
patrolman $800.00 per month. A new pay rate will be established when
the 1980 budget is put together.
Alley Surfacing Hearing: City Engineer Joe Bettendorf reviewed alley surfacing
proposal.
Andy Bechtel asked if the alley would be lowered in places for drainage. 1
Engineer said tha proposal is to have it drain to a center V. Art
Reber wanted to know who all would be affected. Dehler informed him
anyone abutting the alley. Art Loso asked about heavy truck damage to
the surface. Engineer said the only problem time would be in April and
May when the frost is coming out of the ground. Engineer Bettendorf
told the property owners present that the cost of surfacing the two
block area would be about $11,000.00. Street Commissioner steve Dehler
presented five different suggestions as to how the property owners could
pay:
1) $7.00 per front foot for all owners.
2) A 3/4 - 1/4 split for businesses and residential owners per front ft.
3) A 3/4 business - 1/4 residential split per parcel.
4) Businesses pay total cost equally.
5) Each property owner pay equally per parcel.
Al pfannenstein Jr. asked if the City pays for any of the cost. Engin€er
told him the City pays for alley intersectiops. Don pfannenstein thought
the City should help to pay for the surfacing. Art Reber didn't think
they should. City Attorney Tom Jovanovich said the City should get a
signed agreement from the property owners as to which form of assess-
ment would be used. He offered to draw up a petition to be signed.
Art Reber asked if one property owner against the petition would make
a difference. Attorney said no, except they would have to go through
a more lengthy process of public hearings. Al pfannenstein Jr. would
not mind paying more to get it surfaced because he is a~xious to get I
it done. The Mayor asked if any property owners who were not present
at the meeting are against the proposal. Dehler said Ed Dold would
rather not do it right now. Harry Knevel questioned whether the proper-
ties involved are all zoned commercial. Engineer said most on the north
side of the alley are zoned R-2 (residential) and most on the south side
are commercial. Mr. Knevel mentioned that businesses could write the

amount off as business expenses on their taxes but residents couldn't.
Joe Bettendorf said the estimates are probably high. He also suggested
that any of them who wanted their back driveways surfaced could contact
surfacer (after one is hired) to get it done at the same time. Mayor
-- Weyrens asked property owners if they could decide together which form
of assessment would be used and let Attorney Jovanovich know before
the meeting on June 28. Art Lamprect wanted to know if the alley be-
- tween the old bank building and Loso's store would be closed. There
are no plans for that right now. Chief Lorentz said there will be no
parking allowed in the alley.
A motion was made by Schneider seconded by Reber to close the hearing.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None Motion carried.
Sno-Joes Hearing: Don Wieber of the Sno-Joes Snowmobile Club presented proposal
of a building to be erected by the Sno-Joes at the old dump grounds:
- 28' by 28' building on a floating concrete slab
- 12' for City use - 16' for Sno-Joes
- oil furnace - chimney
- 2 overhead doors and 2 side doors
- complete wood structure - red cedar
- shingled roof
site proposed is not in Millstream Park area but the Parks Commission
would like it to be. Husen was concerned about appearance of the
building because of high visibility. Dehler suggested putting it where
the present old structure is. Discussion whether it would be fair to
approve this proposal because the Boy Scout building was not approved.
Council members will meet with Don Wieber to look at the proposed
building site.
Rec. Assn. - Parish 4th Coinm. - J.C. 's - Hearing: Mayor Weyrens cited uncontrolled
Spring Fling. Chief Lorentz talked about beer stand problem of checking
LD. 's. He suggested checking them and then stamping them to prevent
re-checking. This pertaining to the ball parks, July 4th, Spring Fling,
and Octoberfest. He suggested some kind of a fence put up and I.D. 's
checked as they enter.
July 4th Committee has not hired anyone for patroling the grounds.
Chief Lorentz will hire two deputies for the day. They will be paid
by the Parish.
Harry Knevel suggested putting the minor serving problem in the church
bulletin.
Chief Lorentz wanted to know what the Council thought about drinking
in cars at the ball parks. Terry Schwab said that all players at the
park received a notice that no beer or drinks were to be brought in.
Joe Faber questioned whether the Recreation Association could lease
out the park facilities to other organizations to use and sell beer.
Attorney Jovanovich said it was not legal to allow other organizations
to profit from the Rec. Assn.'s license but he will check further and
inform Terry Schwab.
Joe Miller requested a beer license for the 4th of July Parish celebration.
Clyde Axtelle Hearing - Dog Complaint: Clyde Axtelle said he owns three dogs and
would like to keep them. He uses them for hunting and also protection.
He would be willing to buy licenses for all three. Bill Lowell asked
whether a family could have more than two dogs if they were in different

L) ,) ~J names on the license. The Council informed the men that the ordinance
says no more than two dogs per household and that's the way they wanted
to keep it.
Harry Knevel protested having to pay a license fee when other dogs are -
running around free in the City. The Mayor informed him that Chief
Lorentz is presently contacting all dog Oí'ffierS who haven I t purchased
a license and issuing warnings. ;\Ir. Knevel proposed that the Oí'ffierS
who get a warning ticket from the Police Department should have ten days
to buy a license without a penalty.
The City Council resolves that we strongly enforce Ordinance No. 1974-A
with Police Department issuance of violation warnings and redemption
and a 10 day grace period from issuance of warning and the City actively
recruit a dog catcher. The motion was made by Husen seconded by
Schneider.
Ayes: Schneider, Reber, Husen, Weyrens.
Abstaining: Dehler Motion carried.
City Engineer and Al Donabauer: Al Donabauer from Donabauer Well & Pump presented
well problem. He recommended drilling a larger hole. Engineer Betten-
dorf also said that a 16" well í'lould be better. Attorney Jovanovich
informed Council that they will have to have two bids for the job.
Engineer will contact Health Department to get a permit allowing them
to drill. He will also get another quote for drilling.
Bar Violation Policy: Question of treating the bar owners equally when a viola-
tion occurs.
A motion í'laS made by Husen seconded by Reber to have La Playette appear
before the city Council at 8:00 p.m. on July 5th.

July 4th Beer License: A motion was made by Reber seconded by Dehler to grant
the church a beer license for the July 4th celebration.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None Motion carried.
City Engineer: Discussion on engineering firm change by Joe Bettendorf. He
assured the Council that the job of Plant upgrading will be completed
as agreed even though he and Gayle Eastwood are changing firms. He
will have more information at the next meeting.
Engineer Bettendorf suggested contacting the pollution Control Agency
to see if the plant upgrading program could be expanded. This would
slow down the process but would probably result in a better plant.
The normal PCA program takes on the average 7 to 8 years. Discussion
on other programs such as FHA and HùTI, and also about hooking into
st. Cloud lines. Joe Bettendorf will check into the different possi-
bilities to see what would be the best solution for the City.
Engineer informed the Council that time is running out to put seal
coating on the streets. The best times are in July and August. The
cost is about $400 to $500 per block. Mr. Bettendorf will talk to
City Clerk to decide which streets need it most.
Bud Reber: Discussed new maintenance building. He would like to see Great plains
Supply Company do the job because it would be the same as the existing
building they put up.
Tom Jovanovich: city Attorney reported on Sunday liquor. Bars should serve meals
in order to have a Sunday liquor license but the definitions leave it

open to the Council to decide. Mike Husen questioned the liability
problem to the City.
Attorney Jovanovich requested his hourly wage be raised to $35.00 per hour.
II A motion was made by Reber seconded by Husen to raise City Attorney's
fee to $35.00 per hour effective July 31st.

Mayor Weyrens: Presented a request from Howie zimmer to have two yard refuse
container at Millstream Park instead of cans. The cost would be $10.00
per month. Tom Jovanovich will check the Recreation Association lease
to see who would pay the fee.
Question of whether housing inspector could inspect rental housing in
the City. Council will check further.
