Pursuant to due call and notice thereof the City Council of the City of st. Joseph
met in special session on Thursday, July 19, 1979 at 7:30 p.m. in city Hall.
I Members Present: Mayor Hugo B. Weyrens; Council: Herman Schneider, Bud Reber,
steve Dehler, Mike Husen. Clerk Bob Johnson, Attorney Tom Jovanovich.
others Present: Joseph Bettendorf, Engineer; Al Donabauer, Donabauer Well
Drilling; Mary Lahr, st. Cloud Times reporter.
Well No. 1 Quotes: The tabulation of bids on rehabilitation of Well No. 1 was
presented by Engineer Joe Bettendorf. Two bids were received:
Donabauer Well & Pump Co. - $8,841. 50
Fischer Well & Pump Co. - $9,711.00
Engineer presented some information on drilling a new well. Question
of gravel packing examined. of sand structure of well presented
by Engineer Bettendorf. Question of old cesspool in rear of hall
nearer than 50 feet to proposed near well site. Loose floor in old
building disadvantage of rehabilitation. Donabauer indicated he did
not feel floor in pump house would be a problem. Gpm now 180-200.
Estimate of 400+ after rehabilitation. Engineer recommendation:
rehabilitation if floor in pump house is okay.
Motion on Well No. 1 : A motion was made by Schneider seconded by Dehler to
approve the low bid of Donabauer Well & Pump Company in the amount
of $8841.50 for rehabilitation of Well No. 1.

LaPlayette Liquor Hearing: The hearing on possible liquor violation at the
-- LaPlayette Bar & Lounge opened at 8:05 p.m. A police report of the
incident was presented by Chief Lorentz. The possible violation
occurred on June 7, 1979. The investigating officer while on door
check entered the LaPlayette Bar at 0128 hours. Two persons were
reportedly still drinking beer at the bar. Two six~packs of beer
were also on the bar. The two persons at the bar were informed by
the officer that the six-packs could not leave the bar. Both persons
stated they had won the six-packs of beer by shake-a-day earlier.
Mark Zimmer, LaPlayette manager, stated he was absent during the
reported possible violation. zimmer also reported a new bartender
was on duty at the time of the incident. The bartender served the
six-packs with the belief it was legal due to the persons winning
the beer and therefore it was not a sale. Shake-a-day was described
as a dice shaking game. City Attorney Tom Jovanovich presented in-
formation relating to a legal description of liquor sale. The areas
of possible violation considered were: 1) Permitting consumption
of intoxicating liquor later than twenty minutes after sales must
terminate. 2) Selling off-sale liquor after 10:00 p.m.
Council Motion of Dismissal: A motion was made by Schneider to dismiss possible
violations, seconded by Husen.
Voting for motion: Schneider, Husen, Dehler.
Voting against motion: Reber, Weyrens. Motion carried.

Attorney advised City Council should address shake-a-day method of
beer going out after hours. Six-packs are not to go out after 10:00 p.m.
A motion was made by Husen seconded br Reber to close hearing at 8:40 p.m.

J _L 'j' Alley Surfacing Project: Al pfannenstein Jr. presented an update on information
relating to the downtown alley upgrading project. One signature reported
missing from the desired 100% signing. Mr. pfannenstein reported on
recent meeting of abutting property owners. The following method of
cost apportionment had been agreed upon: I
a) One quarter of the cost of the improvement shall be assessed
equally between the total number of commercial units abutting
said alleys.
b) One quarter of the cost of the improvement shall be assessed
equally between the total number of residential parcels abutting
said alley. A parcel shall be 66 feet or any portion thereof.
c) One half of the cost of the improvement shall be assessed on a
front foot basis between the commercial units abutting said alleys.
Each commercial unit shall pay its share of one half the cost of
the improvement on a front foot basis.
A parcel (66' or less) shall be a $204.86 cost apportionment.
Resolution on Alley Project: A motion was made by Husen seconded by Reber to
approve order of improvement once City Clerk has verified all property
o~~er signatures have been affixed to the petition.

Nayes: None Motion carried.
A motion was made by Reber seconded by Schneider approving the order
for the engineer to proceed í~ith plans and specs on alley surfacing
Project No. 79-9134.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
The following project schedule has been listed:
1 ) Approve plans and specs - August 9
2) Publish ad for bids - August 10 (once)
3) Open bids- August 23 (7:30 p.m.)
4) Publication of Assessment Hearing - August 22 and August 29
5) lIIailed notices to abutting property owners - August 20
6) Assessment hearing - September 6 ( 8 : 00 p. m. )
Council commended businesses for their cooperation and efforts in
preliminary proparations, meetings, petition signing on alley surfacing
project.
Engineer Report - Sewer Ìlleasure TV Project: Engineer Bettendorf reported Weir
devices working well. The devices are measuring the volume of sewerage
flow from the Convent-College of st. Benedict. A second measurement
will be taken in October.
County Road #75 Ditch: Council examined reports of ditch filling along south
side of Highway #75 on east side of 2nd Avenue North West. Further
information will be obtained from County as the fill may effect County
right of way. The ditch was also reportedly designated as a special
flood hazard area in 1976 by the U.S. Department of Housing and Urban
Development.
Numbering System Update: Council approved house numbering update for the 500 1
through 1000 blocks on Minnesota Street East on motion by Dehler
seconded by Reber.

Rental Housing Ordinance: Model ordinances to receive further examination.
Promotion of health and safety cited as most important factors.
Muntifering Services: A motion was made by Schneider seconded by Reber to ter-
....... minate Gary Muntifering's services at this time until a housing ordin-
ance has been passed and is in use.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.

TV Sewer Job: A motion was made by Reber seconded by Dehler to approve final
payment for the TV sewer project to Plaunt and Anderson Company as per
agreement.

Nayes: None Motion carried.
Sale of Park Property: City Attorney indicated the sale of park property must
be approved and found compatible with comprehensive plan of City.
Letter of Reprimand: On motion of Schneider seconded by Husen the Council approved
sending LaPlayette licensee a letter of reprimand relating to the in-
cident dated June 7, 1979.

Patrolman Loesch Resignation: The resignation of police officer Bill Loesch was
presented by Mayor Weyrens. Loesch has accepted a position with the
Spring Lake Park police department. Termination date is set for July 31,
1979.
A motion was made by Schneider seconded by Husen to approve the hiring
-- of police officer applicant Mike Kampa, after an investigation has been
completed by Chief Lorentz.

Beer License Approval: The application for beer license, submitted by the st.
Joseph Fire Department for September 8, 1979, was approved on motion
by Husen seconded by Reber.

Street Sign Purchase: A motion was made by Schneider seconded by Dehler to approve
purchase of street and regulatory signs. Estimated cost $900 - $1100.

Nayes: None Motion carried.
winter Snow Towing: winter snow and car towing problems to receive Council study.
Transfer of Funds: A motion was made by Dehler seconded by Schneider to approve
the transfer of funds: $3500.00 from General Revenue fund to Grant
Anticipation Fund for payment to Carley Engineering statements Nos.4-5-6
on Project No. 78-6282, plant Upgrading, in the amount of $5,520.20.
Ayes: Weyrens, Schneider, Reber, Deh}er, Husen.

Planning Commission: Council representative on City Planning Commission Mike Husen
reported planners met recently to discuss and examine future street plans.
The Orderly Annexation Board also met recently to examine and discuss
drainage questions relating to the Arnie Lauer building site on Rassier
Road. A possible county ordinance violation cited.

Bob Borresch Property: The Bob Borresch open basement construction property
located on County Road #2 (West Minnesota street) was cited and exam-
ined as a health and safety hazard. Further action will be taken
by Council beyond weed control.

Minutes Approved: The following Council meeting minutes were approved on motion
by Reber seconded by Schneider. Minutes of June 14-21-28, 1979 were
included in the approval, also minutes of May 24 and June 7, 1979.

Adjournment: The meeting was adjourned at 12 : 1 5 a_.JTI. on motion by Dehler seconded
