Pursuant to due call and notice thereof the City Council of the City of st. Joseph
met in special session on Thursday, September 20, 1979 at 7:30 p.m. in City Hall.
- Members Present: Mayor Hugo B. Weyrens; Councilmen Herman Schneider, Bud Reber,
Steve Dehler, Mike HUsen. Cle~k Bob Johnson, Attorney Tom Jovanovich,
Engineers Joe Bettendorf and Gale Eastwood.
Others Present: Don Carley, president of Carley Engineering. Mr. Carley was
present regards plant Upgrading project.
PCA cOMnents to be answered specifically No. 1 relating to population
projections. step II of the project will be completed by Carley Engin-
eerlng. Carley suggested drawing line around city and establish annex-
ation boundaries. Metro council policy cited by Carley - indicated he
knew no other way to control growth. A determined number of sewer
connections would by permitted per year as under the Twin City Metro
sewer district policy. Population numbers and projection to be up-
graded. Council must determine growth policy - city to answer comments
through Carley Engineering - comment No. 1 - population question -
population numbers and proposed areas of annexation - energy costs
relating to force oain operation discussed. Interceptor main and future
connection to st. Cloud question raised. Carley to contact PCA Engineer
Larry Zdone on Friday, September 21, 1979.
Maintenance Building Bid Award: Great Plains Supply bid of $41,354.65 was presented.
Cost factors examined and reviewed.
Bid Acceptance: A motion was made by Reber seconded by Dehler to accept the bid
of Great plains Supply and award bid.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Dog Questions: Insurance questions raised and examined. Matters relating to dog
ordinance reviewed by Council.
Dog Policy: A motion was made by Schneider seconded by Reber to adopt the City
of st. Joseph Dog Handling Policy
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Fence obstructions: A motion was made by Schneider seconded by Reber to notify
property owners that obstructions or fencing on public property is in
violation of city ordinance.
Ayes: Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Scout Building: Engineer Bettendorf to check sewer connection to Scout building.
Recycling Program: A motion was made by Reber seconded by Husen to permit four
barrells for recycling glass and cans placed on the west side of pump
house No. 1 - program conducted by VA Hospital.
Garbage Pickup Rates: Council to discuss garbage rate increase with refuse service
prior to final contract agreement.
Dog Equipment Purchase: A motion was made by Reber seconded by Husen to approve
dog catching equipment as listed.

phibbs Dog Case: Attorney Dale Mossey and Rober Phibbs were present regards
the accidental disposal of r.lr. phibb's dog. The following actions
were requested by Mr. Phibbs:
1) Attorney Jovanovich reported insurance company would adjust the
monetary loss. -
2) Apology from City for accidental death of dog.
3) City adopt policy relating to dog handling.
4) Description of incident relating to the death of the dog.
Dog handling policy changes were requested and incorporated.
Liquor Violation Hearing: Mark Zimmer, manager of the LaPlayette, appeared before
the Council for a preliminary hearing on a possible liquor violation.
Attorney opened hearing presenting facts of the case. Actions possible
by Zimmer were explained by City Attorney Tom Jovanovich. Police Chief
Lorentz read police report of incident of minor consuming alcoholic
beverage. statements of both minors were presented. The minors were
not asked for identification. Not clear to bar manager Mark Zimmer who
purchased beer. Zimmer indicated his establishment is not in business
to sell to minors. An honest mistake was made, according to zimmer.
Bar policy does not allow minors unless accompanied by an adult. The
The bartender was aware of policy on minors - did not see the subjects
enter bar. LaPlayette does not want minors in bar. Council considered
past record of sales to minors and considered the incident an error
and questionable purchase.
A motion was made by Reber seconded by Husen to dismiss possible vio-
lation with stipulation that effort be made to check ID's.
Ayes: Schneider, Reber, Dehler, Husen.

Police Car Repairs: A motion was made by Reber seconded by Husen to repair the
patrol car as needed.
Ayes: schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
old 1958 Sludge Truck: A motion was made by Husen seconded by Dehler to sell
old sludge truck as per offer of $250.00.
Ayes: Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Truck Repairs: A motion í1as made by Dehler seconded by Husen to approve repairs
on equipment (trucks) as required and reported.
Ayes: Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Pumphouse Roof Bids: Maintenance Foreman to obtain additional quotes on roof
repair - pumphouse No. 1.
6th Ave. Project Close: A motion was made by Husen seconded by Reber to approve
release of retainage in the amount of $lJOO.OO to Hardrives for 6th
Avenue South East Project.
Ayes: Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Minutes Approved: The minutes of August 23, 1979 and August 30, 1979 were presented
and approved on motion by Husen seconded by Dehler.
Ayes: Schneider, Reber, Dehler, Husen.

Budget Meeting: Council to meet September 27 for special budget meeting. iJi _..
Planning Matters: Planning Co~mission - City Council meeting October 9, 1979.
Planning favors commercial designation for Roske, Wasner, Hoffman properties.
~ October 2, 1979 - Husen, Kremer, Weyrens to meet with County Commissioners
to discuss land use - Reske property - access to County #75. Examining
areas for commercial development - arterial streets study underway.
File Cabinets: Council approved purchase of two file cabinets for clerk office.
(1979 budget item).
Adjournment: A motion was made to adjourn at 12:00 midnight by Reber seconded
by Schneider.
