Pursuant to due notice and call thereof the state of Minnesota Municipal Board
conducted a public hearing on Wednesday, october 3, 1979 at 10:05 a.m. in City
Hall.
I The hearing was opened by Municipal Board Executive Director, Terry Merritt.
Others Present: County Commissioners: Robert Gambrino, Clarence Kremer
Township Officials: Chairman Fred Reber
City Officials: Attorney Tom Jovanovich, Clerk Bob Johnson,
Councilman Mike Husen, Planning Commission Chairman Ben
Kremer.
Also Present Were: James Graeve, Township resident
Bob Viehauser, City resident
Al Maleska, City resident
Dave pfannenstein, City resident
Mark Knoblach, Realtor, Capital Investors
Purpose of Hearing: To allow persons to be heard and comment after presentation
of a petition for annexation of the Susan Roske property.
Terry Merritt, Executive Director, presented all legal documents
necessary and made a part of the record. Attorney presented stipulation
and introduced the document as evidence. James Graeve requested exam-
ination of stipulation document. Director Merritt presented an explain-
ation of stipulation document. James Graeve asked if Roske residence
property was being annexed. Attorney indicated residence area of Susan
Roske was not included in annexation. City exhibit "A" presented by
Attorney; map indicating the area proposed for annexation. Approximately
eleven acres - south of County #75. Rezoning planned for commercial
use. Area presently zoned R-3 Township multiple dwelling. Zoned R-l
Agriculture when it becomes annexed to the City. Ben Kremer presented
testimony regarding zoning of property. Dave pfannenstein questioned
access to property. Mike Husen, Councilman, laison to City Planning
Commission and member of Orderly Annexation Board, presented information
relating to present access to property. Indicated developer has re-
quested a third access - center of property to County #75. County
Commissioners are examining request. Ash street definitely not to be
used as access, according to Husen. Fred Reber asked if Commissioners
had acted on access to County #75. Commissioner Gambrino indicated no
access has been granted at this time. Access on west end of property
and possible east end to #133. Access on #133 cited as problem by James
Graeve - 30' to 40' from County #75 - believed accident problem would
by great - R.R. crossing - four lane highway - greater safety in access
to County #75. Dave pfannenstein, home owner on Ash street, very much
opposed to access to Ash Street as are other residents. Mark Knoblach,
Capi tal Investors, indicated his firm had made a search of properties
in st. Joseph and concluded the Roske property represented the best
location. They would not go ahead with project if this area is not
approved. Felt need is present in st. Joseph. Further east would be
to near st. Cloud. Fred Reber questioned right of closing streets for
access and directing traffic to other areas. Al Maleska, Ash Street,
opposed to opening of Ash street as an access street serving the proposed
commercial area. Mike Husen indicated Council and Planning Commission
oppose opening of Ash street as an access to the proposed commercial area.
Attorney Jovanovich presented a summary. Purpose of hearing to annex
~ and allow City to provide services. Executive Director Merritt indicated
when matter is considered for final action persons may be present if
they sign notice of interest. Merritt summary - evidence will be

presented to Board and Commissioners. Members will meet to review
documents. Commissioners and director will examine property. Every-
one welcome to join.
