HomeMy WebLinkAbout1979 [10] Oct 18 936 Thursday, October 18, 1979 Pursuant to due call and notice thereof the City Council of the City of st. Joseph met in session on Thursday, October 18, 1979 at 7:30 p.m. in City Hall. Members Present: Mayor Hugo B. Weyrens; Councilmen Bud Reber, steve Dehler, I Mike Husen. Clerk Bob Johnson. (Absent Councilman Herman Schneider, vacation. ) Oil Infiltration Problem: Mayor Weyrens reported another incident of a large amount of fuel oil or drain oil entering the city sanitary sewage system. An investigation is being conducted. Digital Voice Radio System: A new digital voice privacy radio system was presented for council consideration. System cost placed at $11,470.00. A lease agreement would cost $269.83 monthly at 12% interest. The system would give police department complete privacy in radio transmission. New Maintenance Building: A motion was made by Husen seconded by Reber to approve a change order on the new maintenance building construction to permit a size change in the two main doors to 12' x 12'. Ayes: Weyrens, Reber, Dehler, Husen. Nayes: None Motion carried. Public Hearing - Budget (Proposal) 8:00 p.m.: The proposed budget hearing was opened at 8:00 p.m. by Mayor Weyrens. Purpose of the hearing: To provide citizens an opportunity to present written or oral comment on Revenue Sharing Fund use and budget appli- cation for fiscal 1980. Copies of the proposed summary budget were presented. The affidavit of publication was made a part of these minutes and attached thereto. 1 No persons, other than the City Council, attended the budget hearing. The Council will continue budget study and meetings. A motion was made by Dehler seconded by Husen to close hearing at 9:00 p.m. Ayes: Weyrens, Reber, Dehler, Husen. Nayes: None Motion carried. Liquor Hearing - 9:00 p.m.: Mark Zimmer, manager of the La Playette, Inc. , appeared before the Council for hearing on a possible liquor violation. Others present: Kurt Franke, bartender, La Playette, Inc.; Police Chief Bill Lorentz. City Attorney Jovanovich presented preliminary information relating to the case. Chief Lorentz presented a resume of the possible violation and statements from persons involved. Zimmer challenged the statement by minors involved that implicated the La Playette as the source of the liquor found in their possession since they were apprehended a block from his place of business. The problem of persons entering an open door in a back room of the establishment was cited. Fire regulations require the exits to remain unlocked during business hours. The licensee was reminded that checking ID's of persons entering a liquor establishment remained the responsiblity of the owner and employees. Motion Failed: A motion was made by Councilman Dehler that a letter of reprimand I be a part of the hearing and no suspension be assessed as it was the licensee's word opposed to persons apprehended on the street a block from the business place. The motion died for lack of a second. q~7 A motion was made by Husen seconded by Reber to dispatch a letter of ~·u & reprimand stipulating that if a fourth violation occurs relating to sales to minors during one year, the Council will suspend the liquor license for a definite period of time, depended upon the severity of the violation. I Voting for the motion: Reber, Husen, Weyrens. Voting against motion: Dehler Motion passed 3 - 1. The hearing was adjourned at 10:15 p.m. Dick Taufen Present: Regards oil introduction to treatment plant this afternoon, 10/18/79 - 4:15 p.m. Oil material to be tested through regular testing firm. Dog Case: City received insurance company notice on Phibbs dog case. Offered $75.00 claim payment. A motion was made by Reber seconded by Husen to settle the dog claim as presented contingent upon insurance company paying within one week. Ayes: Weyrens, Reber, Dehler, Husen. Nayes: None Motion carried. Lyman Hull: House construction question at lumber mill site area. Flood plain question cited. Owner required to make flood plain determination. Kennedy Fence Area Question: Fence erected on public property in Kennedy area question examined. Attorney to dispatch letter to property owner in question regards danger and liability. Council Meeting Change: The council meeting scheduled for November 22 was changed to November 29 on motion by Husen seconded by Reber. 1 Ayes: Weyrens, Reber, Dehler, Husen. Nayes: None Motion carried. Bill Pritchard - Reinhard Construction: Bill Pritchard, Reinhard Construction representative, was present regards a need for variance from Zoning Ord. No. 59 requirements relating to side yard distance as related to structure height. A variance hearing is to be scheduled for November 7, 1979 at 7:30 p.m. in City Hall. Publication date: October 23. City Engineer Representation: A motion was made by Husen seconded by Reber that City Engineer refrains from representi~g developers involved in city area developments. Ayes: Weyrens, Reber, Dehler, Husen. Nayes: None Motion carried. stearns League Meeting: Councilman Husen reported on his attendance at a stearns Municipal League meeting held in paynesville. Husen indicated the league will attempt to continue to function although attendance at meetings has been poor. Mayors Ringsmuth of Waite Park or Weyrens of st. Joseph will represent the league at Region 7W meetings. The revitalization of a Central stearns Civil Defense program was also reported by Husen.
