Pursuant to due call and notice thereof the City Council of the City of st. Joseph
met in special session on Thursday, December 20, 1979 at 7:30 p.m. ih City Hall.
Members Present: Mayor Hugo B. Weyrens; Councilmen Herman Schneider, Bud Reber,
steve Dehler, Mike Husen; Clerk Bob Johnson. (Herman Schneider arrived
at 8: 40 p. m. )
Others Present: Attorney Tom Jovanovich - 8:00 p.m., Dick Taufen - 10:00 p.m.
Day Care Center: Mike Husen, Council - Planning Commission representative explained:
a) A request for special use permit for day care and nursery school ln
R-2 residential zone. Public hearing scheduled for January 7 at
7:30 p.m. in City Hall.
1) Slze 2) parking and traffic flow questions to receive further
examination.
b) Appliance repair in home question raised. Majority of repair away
from home. primarily a business office.
Work to commence by Planning Commission to up-date Zoning Ordinance and
sub-division regulation ordinances.
c) New members for Planning Commission.
Data Privacy Act: Attorney presented information relating to the data privacy act.
City duties and requirements were reviewed for implementation.
Resolution - Data Privacy: A motion was made by Dehler seconded by Husen to approve
the following resolution:
The City Council of st. Joseph appoints Robert G. Johnson as the Respon-
sible Authority for the purposes of meeting all requirements of the Minn-
esota Government Data práctices Act, Minnesota statutes, Sec. 15.1611
through 15.1698, as amended.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.

El Paso Hearing: Claude Menzhuber, Denny Tamm, and Tom Botz were present represent-
ing the EI Paso Club. Police Chief Lorentz presented a police report
on possible liquor violation by the EI Paso Club, Inc. Selling, in any
manner, either directly or indirectly, intoxicating liquor to a person
under age of 19 years. State law permits sale by persons 18 years of age.
EI Paso owners indicated they have a person at door, for ID check, only
when a large crowd is present. Persons under 18 are permitted to enter
for bowling. Internal control question cited as most important. Sales
in bowling lanes perhaps in need of greater control. EI Paso indicated
the possible sale to minor was an error or oversight. Question of checking
ages on bowling teams at start of season suggested.
A motion was made by Reber seconded by Dehler to send EI Paso Club, Inc.
a letter of reprimand and a request strongly suggesting a tighter inspec-
tion of ID's in their establishment.

Nayes: None
Abstaining: Schneider. Motion carried.
A motion was made by Husen seconded by Reber to adjourn hearing at 9:00 p.m.

Request for Forms: A motion was made by Schneider seconded by Husen to approve
purchase of police department office forms in the amount of $97.70,
from G. A. Thompson Company.
Ayes: \\Teyrens, Schneider, Reber, Dehler, Husen.
Nayes: Kone Motion carried.
Police Department Ammo: 12 gage ammo increase required - about 8 additional boxes.
Question of establishing a permanent firing range in the city examined.
l\lidway Hearing: Hazel and Arthur Lamprecht were present for a liquor hearing that
opened at 9:15 p.m. Police Chief Lorentz presented the police report
on a possible liquor violation of selling intoxicating liquor to a minor.
Bartender neglected to check ID on the off sale. Adding a door check
person on busy nights was recommended by the police officer making the
report. Question of minors in liquor establishments examined. Liquor
ordinances to receive Council reVlew. Question raised relating to taking
violations back to County Attorney for consideration. willful violation
question raised concerning five year suspension of license. Attorney to
further examine.
A motion was made by Dehler to record incident violation and send licen-
see a letter of reprimand to be placed in their file, seconded by
Schneider.
Ayes: Schneider, Reber, Dehler, Husen.
Nayes: Kone
Abstaining: Weyrens Motion carried.
Question of a new policy relating to violations to be studied.
Motion by Husen seconded by Reber to adjourn hearing at 9:45 p.m.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Fight incident in front of l\1idÍ'o'ay Bar reviewed. IIlr. Lamprecht indicated
he was ívell satisfied with work of both patrolmen - doing a good job
checking doors.
New Policy: Automatic suspension question upon violation proposed as new policy.
Attorney to further explore policy matters approved on motion by Reber
seconded by Husen.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Persons after hours to be notified they have five minutes to leave bar
before being tagged for violation.
Alley Project: A motion was made by Reber seconded by Schneider to release payment
on alley project on basis of letter of agreement from Hardrives to
perform the following work in spring: Re-mortar manholes, improve gravel
edges abutting both alleys.
Ayes: Weyrens, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Insurance Coverage: A motion was made by Husen .seconded by Schneider to approve
recommended insurance coverage on the following properties:
1 ) City Clerk office, Council room, Police office,
and hall annex - 39,268.00
2 ) Fire Hall - 111,547.00

Maintenance Department Purchases: A motion was made by Dehler seconded by Schneider
to approve the following items requested by Dick Taufen, maintenance
superintendent - estimated cost - $600.00:
1) Alternating Flashing Warning Light --- $ 69.95 (plus shipping)
2) 55 gallons ZEP M-55 Degreaser -------- $385.00
3) 6 gallons ZEP Formula 777 ------------- $ 42.00
4) 6 gallons ZEP-O-Kreme ----------------- $ 36.00
5) 1 dispenser --------------------------- $ 12.00

Fire Extinguishers: Fire extinguishers for maintenance building approved for
purchase on motion by Reber seconded by Husen - $70.00 estimate.

License Approvals: A motion was made by Husen seconded by Reber to approve the
following non-intoxicating liquor, cigarette, amusement and entertainment
device licenses: El Paso Club & Lanes, Midway Bar, La Playette, Sal's
Bar & Cafe, Legion Club, Frisky Bait Shop, Grafitti, Inc. ,
Hollanders Country Store, st. Joe Liquor Shoppe,
st. Joseph Meat Market, Loso's Store, Versa-Vend vending
Inc. , Linnemann's store, Stueve's Garage, st. Joe Pharmacy,
Kay's Kitchen, Martini Mobil.
Ayes: Weyrens, Schneider, Reber, Husen.
Nayes: None
Abstaining: Steve Dehler Motion carried.
Street Light: A motion was made by Dehler seconded by Husen to approve installation
of a street light at the corner of Minnesota Street West and 4th Avenue
North West.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Adjournment: Adjournment on motion by Schneider seconded by Dehler at 12:00 midnight.
