Special City Council Meeting - July 25, 1977 at 7:00 o'clock
I 1) 7:00 Physical inspection of St. Ben's property by City Attorney and
members of Council.
2) Attendance at Meeting: Mayor Hugo Weyrens, Councilmen Schneider, Reber,
Dehler, Husen, Engineer Joe Bettendorf, Oity Attorney John Knapp.
(Absent: Clerk Bob Johnson - vacation), developer Don Landwehr and James
Landwehr, Mike Sullivan Attorney for st. Bens. Sr. Moira and Sr Marion.
3) Preliminary discussion concerning "building suitablity by St. Bens on
said property if not purchased by city. Additional discussion of problem
of Dutch Elm and Oak Wilt infection of trees on the htgh east bank of
property.
4) Price of property set by St. Benedicts at $26,000. The liability of
tree removal poses unique problem for actual cost of property.
5) Possible financing would be thru "Developers Donation" of money or land.
6) Restriction of Land Use and accessibility to land if park use is stip-
ulated or realized, center of short discussion
Order at 8:30 - Attendance listed above. Purchase of Property
1 ) Access to Property
A) East - West easement along northerly line on south side probably
2) width of 66 ft - definetely to be given to City.

3) Terms - reasonable but not stated concretely
- General review of history of discussion of land use and purchase since
April 77. Idea to sell not first priority of Convent. To sell is
considered to be sign of cooperation by St. Bens with the entire community.
Their appraisal is to be considered the asking price.
- St. Bens would not consider 20 yrs, 10 yr period would be more acceptable~
4) City of St. Joseph would largely depend upon the "developer donation" as
source of financing purchase and development of property in question.
Also storm sewer assessment in smaller degree.
5) Engineering information presented concerning feasibility of building
(home sites and number) on o~e or both sides of drainage area.
6) Mr. Sullivan reiterated that his remarks at the onset of this meeting
was that the convent has continued since April to act in good faith,
therefore the land value of the appraiser, set at $26,000, is the
asking prÜre.
- Due to existence of dutch elm and oak wilt infection there is possible
room for re-evaluation of asking price.
- Unlikely that total 40 acres would be offered for sale - St. Bens
Convent desires "buffer" zone between "Hog Farm" Rd and Park/Drainage
area.
I 7) Additional discussion of terms. Council womld propose a time period of
10 years at s% interest.

8) City will draw up written proposal of total price and terms to be sent
to Oonvent of St. Benedict. I
% interest/period of amortisation/total price/any and/or amount of
down payment/payment schedule (monthly/ semi-annually/ yearly).
9) Asking price of $26,000 then discount certain percentage of city cost of
tree removal - $2,000 discount.
10 ) $26,000 - $2,000 (tree removal partial) at s% interest for a period of
10 years.
Total price would be adjusted, per acre price, by the result of survey.
11 ) Motion by Reber second by Schneider, that the City Council directs City
Attorney Knapp to inform Convent of St. Bens that City is willing to
purchase the property at $26,000 - $2,000 (tree removal cost) at s%
interest rate for a period of 10 years, with a down payment of 10%
(ten percent) with payment schedule of one annual payment.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens
Nayes: None
Adjournment at 10:00 - Motion by Reber, second by Dehler.
