City Council Meeting 7:30 August 4, 1977 - Regular Session
1 ) Call to Order 7:30. Present Mayor Hugo B. Weyrens, Councilmen Herman
- Schneider, Bud Reber, Steve Dehler, Mike Husen, City Treasurer Leo Sadlo,
City Attorney John Knapp, (City Clerk Robert Johnson on vacationv and
- Engineer Joseph Bettendorf.
2) Report of Treasurer, Leo Sadlo, for the month of June 77.
A) Transfer of funds from Gen Revenue to Joint Operating Fire - $1,927.42
B) Report reflects taxes paid during July or '77
C) Revenue Sharing Investment fund increased by $6,500.
Motion by Schneider, second by Reber to accept the treasurer~s report.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None
3) Request by Leo Sadlo and Marty Pfannenstein for the city to review
street improvements for 2nd Street SEe Request for improvements of curb
and gutter. The Street Commissioner will explore cost factors for city
and property owners.
4) Approval of Minutes
Motion by Dehler, second by Husen, to approve the minutes of May 19,
May 24, June 9, June 13, June 22, and June 29.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None
5) Report by Husen of Planning Commission action on Simon Bros. Business
request for Special Use Permit. Permit was denied by Planning Commission.
City Attorney advices council to send a letter to Simon Bros. appraising
the business of denial and request to cease such business activity with-
in a certain time period. If Simon Bros fail to act the City sould seek
a court injunction.
Motion by Schneider, second by Reber to inform Simon Bros. of the denial
of Special Use Permit and instructing said business to cease their
activity at their present location within 30 days.

6) Report of City Attorney on St. Benedicts Property.
A) Convent Attorney indicates preliminary approval of City offer to
purchase the property (Park and drainage).
B) Easement thru land to property requested for purchase. Question
concerning north-south roadway easement. Easement to
be granted to City on St. Benedict's property. Legal question of
easement thru north-east corner of Palmersheim property. City must
investigate with Palmersheim property owner the possibility of
obtaining easement thru property to connect with easement to be
granted to City.
Township of St. Joseph perhaps can provide information on legal
status of existing easements and road right-of-ways. Weyrens and
Schneider will discuss situation with Mr. Palmersheim.
7) City Engineer and Cloverdale Estates.
, A) No bids should be sought until title of property to be purchased
from Convent of st. Benedict's is offically obtained and filed.
The reason for waiting is the "designated drainage area" to be
B) financed by "Community Development Block Grant".
Question of annexation of property. No date no action by Muncipal
Board of Annexation.

C) Final Phase of planning, estimated, and schedules should be available
for City Council consideration at the end of August.
D) Surveyor markers and placement - County Surveyor to be contacted for -
placement of Section Marker.
E) Discussion of culvert under Minnesota Street at Hoffman Apt. houses.
No longer in use. Additional discussion of storm water drainage
thru Eastern Park south to Baker Street.
F) City should approach County Commissioner directly to repair at county
cost the engineering problem on Minnesota Street. Street is buckled.
County road, should be county responsibility
G) City should consider an agency similar to an H.R.A. to monitor and
admini~housing in development area.
8) City Attorney and Park Property Donation (Bloomington Ord)
A) Council discussion of amount of land or land value to be required
by City to be given to park acquistion and development fund of City.
B) All monies collected must be used for park purposes only. These monies
may be used for all parks in City.
C) Discussion of various ways to establish true land value of developments
that are included in the Orderly Annexation Areas # 1 and # 2.
D) Inclusion of land to be made at time of final plat or annexation.
E) City Attorney to write an ordinance concerning parks and development
tailored to the needs and means of the City of St. Joseph.
City Attorney
1) No word from Burlington Northern on easement for North Street.
2) Continuing to review old Ordinances.
9) City Maintanance Dept: Dick Taufen and Mr. Marthaler.
A) Dutch Elm Report. All samples must be taken and sent to County by
Aug 31st. Some removal has been done, as well as replacement by maples.
Stevens of Upsala will remove stumps for $25.00 each.
B) SMD chemical treatment for trees that are exposed to infected trees.
This is one possibility to try to save non-infected trees.
C) City must write policy of tree removal on City property and policy
of removal on private property, by city crews, form letter to inform
property owners of extent of city responsibility in repairing yards
and boulevards.
D) Need for City to purchase chain saw. Suggested by city crew for city
to buy IFarm Boss' 2011 at $ 269.00 less 10% with purchase order.
Motion by Schneider, second by Reber to purchase the 111I'arm BosslI
chain saw. Motion carried.
E) Cut trees to be either burned or buried, depending on permits.
F) Oil needs - cases of 10W/ 2OW/ 30W, 1 case each. Total cost of
three cases is $70.00.
Motion by Reber second by Dehler, to approve purchase of oil and
battery for city equipment. AYes: SChneider,Reber,Dehler,Husen,Weyrens.

G) Area Vocational - Technical School offering courses for municipal
employees in a variety of areas covering general physical operations
of the municipalities: sewer and water projects, hydrant inspection,
etc. Fee $10.00 per student.
Motion by Schneider, second by Reber, to send 2 city employees (Taufen
and Marthaler) to attend A.V.T. School for Sept courses.
10) Mayor reports
A) Art Reber to attend Aug 24, 25, 26, Civil Defense Seminar in Brainerd.
Motion by Schneider, second by Husen, for Reber to attend.
Ayes: ÐChneider, Reber, Dehler, Husen, Weyrens.
Nayes: None
B) City shouiid begin to interview attorneys to replace John Knapp, newly
appointed Minn. State Tax Judge.
C) Flexiglas screen for interior of patrol car at cost of $31.00. City
police would install screen.
Motion by Dehler, second by Schneider, to purchase prisoner-control
screen.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
Nayes: None
D) Bikes left at City Hall, found by police abondoned or stolen. Effort
must be made to inform public of description of bikes for possible
claim by owners. No claim made, city will accept offers for sale.
E) Liquor Ordinance Amendments
# 1967 and #62 discussion tabled until Asst. City Attorney Tom Jovanovich
is present to legally explain contents of these two ordinance amendments.
F) Discussion of Ordinance to control obstruction of streets, sidewalks,
and buildings. Need for further revisions of existing policy.
Motion by Husen second by Dehler, to instruct Asst. City Attorney
to write an ordinance concerning loitering as set out by policy statement.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.

G) 4 Way Stop at Minnesota and College Ave.
Motion by Dehler, second by Schneider to approve 4 way stop at College
and Minnesota
11 ) Planning Report: Husen
~Motion by Reber, second by Dehler to offically approve the re-zoning
of Lots 7-8-9-10-11, Blk 2, Loso's 3rd Addn from R-2 Residental to "B"
Business, as approved by Planning Commission.
Ayes: Schneider, Reber, Dehler, Husen, Weyrens.
N ayes: None
12) Recreation Program: Reber
A meeting will soon be conducted by Rec. Assoc., Park Board, Jaycees,
and Lions Club, to consider present and future projects and needs of
the park and recreation programs.

Pursuant to due call and notice thereof the City Council of the City of St.
Joseph met in special session Thursday, August 11, 1977 at 7:30 p.m. in City Hall.
Members Present: Mayor Hugo B. Weyrensj Councilmen: Herman Schneider, Steve
Dehler, Mike Husen. (Absent: Bud Reber, illness.) Clerk, Bob Johnson.
Others Present: James and Donald Landwehr.
Bills Presented: A motion was made by Schneider seconded by Husen to pay bills
as presented.
Ayes: Schneider, Dehler, Husen, Weyrens.
Nayes: None
Street Repair: Minnesota street "heave" problem: job to be completed by City_
. . County to pay all costs. Work to begin on Aug 23 if possible.
Attorney Tom Jovanovich: Present to discuss City Attorney position with the
City of St. Joseph. Salary and fee schedule were negotiated and agreeable
to both parties. Council to make decision in near future after Attorney
Knapp official resignation.
New Ordinance Review: Ordinance No. 1967 relating to non-intoxicating liquor
examined along with amendment to Ordinance No. 62 intoxicating liquor
ordinance. Further study to be made on the above ordinances. Obstruction
of right of ways ordinance has first reading - further review to be made.
James Landwehr: Park land dedication on sub-division development discussion
held. Percentage question explored. Question of changing 12 unit apt.
bldgs to 24 unit building raised. Further study to be made of dedication
and percentage matters relating to park land dedication.
Waiver Question A motion was made by Husen seconded by Dehler to have attorney
draw up waiVer of liability for tree removal on private property by city
employees.
Ayes: Schneider, Dehler, Husen, Weyrens.
Nayes: None
Statement of Assurances: A motion was made by Schneider seconded by Husen to
approve Mayor signature on Revenue Sharing Statement of Assurances for the
ninth entitlement period
Ayes: Schneider, Dehler, Husen, Weyrens.
Nayes: None
Chain Hazard: Street Commissioner Steve Dheler to examine hazard of chain
and cable use as street and park area closures.
Adjournment: A motion to adjourn made by Schneider seconded by Husen at 10"45 p.m.
