Joseph met in regular sessión on Thursday, January 10, 1980 at 7:30 p.m. Members Present: Mayor Hugo Weyrens; Councilmen Herman schneider, Bud Reber, I Steve Dehler, Mike Husen; Clerk Bob Johnson; Treasurer Leo Sadlo. Tom Jovanovich, Attorney - 8:00 p.m. Engineer Joe Bettendorf - 9:00 p.m. Others Present: Three students from Apollo High School: Loren Loso, Tony Studer, Mark Klein - were present to observe council proceedings. Russ Swanson, Dorothy Swanson, John Swanson, Wayne Fischer, Al Maleska were all present. Treasurer Report: Leo Sadlo, City Treasurer, presented the monthly financial fund report. A motion was made by Schneider seconded by Husen to accept the treasurer's report as presented. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Weed Conference: A motion was made by Husen seconded by Schneider to approve the attendance of forester Jim Marthaler at the annual county weed conference to be held at Sands Cafe in Albany on January 21 from 10:00 a.m. to 3:00 p.m. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Shade Tree Regulations Hearing: On motion by Reber seconded by Dehler,the Council approved the attendance of Bob Johnson and Jim Marthaler at a Shade Tree Program conference at the Court House in st. Cloud on I January 11, 1980 at 3:00 p.m. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Street Lighting Update: An update of the change and additions to the city street light system were presented by City Clerk Bob Johnson. On motion by Dehler seconded by Reber the Council approved one additional hi-pressure sodium installation for the south side of Minnesota Street at the Lab School entrance. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. A total of 15 - 250 W hi-pressure sodium units and two additional 250 W mercury vapor will replace the present nine fluoresent units located on Minnesota Street and College Avenue North. Day Care & Nursery School: Councilman Husen presented a report of the Planning Commission Public Hearing held on January 7, 1980 to consider a request for special use permit to operate a Group Day Care Center and Nursery School at 115 - 2nd Avenue North East, Lots 17-18, Blk 2, Loso's 5th Addition, on property known as the Milton and Kathy Jones residence. The Planning Commission recommended the permit be granted with the following stipulations and the provision the Council judge whether there is a traffic flow problem in the area, if so, that the problem I be resolved before granting a special use permit: 1) that a single-lane turn around be constructed in front of the Center for dropping off and picking up children; 2) that employee parking be constructed on the property of the Center; 953 3) that the maximum number of children served by the Center be 30; 4) that an annual review of continued state certification of the Center be made by the Planning Commission; 5) that, among the rules and policies issued by the Center to customers, l_ the desired access to the Center be specified and the use of alleys be prohibited. Area traffic patterns were reviewed by the Council. Al Maleska, area resident, expressed concern regards alley traffic and further commercial- ization of the neighborhood. Russ and Dorothy Swanson presented a resume of their experience and local plans in the day care nursery school operation. A motion was made by Dehler seconded by Husen to approve the special use permit as reguested by Russ Swanson to conduct a day care and nursery school at 115 - 2nd Avenue North East with the following stipulations: 1) property fencing required; 2) certification by state each year; 3) adequate off-street parking be provided; 4) maximum number of children served limited to 30; 5) additional special use permit to be required to enlarge or add to the present structure to increase the number of children permitted over the number 30. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None· Motion carried. Council recessed for 5 minutes at 9:05 p.m. Liquor Violation Policy: City attorney working on liquor violation and suspension policy. To be approved at next council meeting. section 8 Housing: Mayor Weyrens presented information received from Reinert Homes, Inc. pertaining to section 8 rental housing eligibility guide- lines: Income requirement - maximum annual income: 10,300 for 1 person 11,800 for a family of 2 13,250 for a family of 3 14,700 for a family of 4 15,650 for a family of 5 Eligibility requirements: (at least one of the following) a) handicapped b) disabled c) displaced d) elderly - at least 62 years of age or older e) a family - 2 or more persons sharing the same residence and utilizing the income and monies available to meet family needs, and who are related by blood, marriage or law and maintain a stable relationship. f) single individuals - under special circumstances. No family will pay more than 25% of its monthly income for housing. Seal Coating Report: Engineer Joe Bettendorf presented a 5-year seal coating and street repair program report. The engineer also presented infor- mation relating to the Weir measurement project. Additional water pumping data to be obtained for review. Engineer Bettendorf also indicated Stearns County requested information on force main direction by March 1, 1980. 954 Highway #75 Flashers: Size of flasher, standard height and extension of both flashers at the junction of H\vy. #75 and cty. Rd. #2 will be examined by County Engineer's office. Bill Presented: Bill \vere presented and approved on motion by Reber seconded by Husen. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Water Sewage Subscription: On motion by Husen seconded by Dehler the Council approved the subscription to Water & Sewage Magazine as requested by Commissioner Schneider. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Water & Sewer Rate Increase: A motion was made by Reber seconded by Schneider to increase water rates .10 per 100 cu. ft. to .50 per 100 cu. ft. and sewer charges from 65% to 75% of water consumption based on a winter quarter reading. Rate increases are effective January 1, 1980. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Refuse pickup Cost Increase: A motion was made by Husen seconded by Reber to increase refuse charges .50 to 3.50 per month effective January 1, 1980. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Legislative Bulletin and League Directory: A motion was made by Schneider seconded by Dehler to approve subscriptions to the State Legislative Bulletin - $9.00, and Directory of Minnesota Municipal Officials - $6.00. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. 1980 Council Appointments: A motion was made by Husen seconded by Dehler to approve the following appointments for 1980: 1. Voting for the motion: schneider, Reber, Dehler, Weyrens. Voting against motion: Husen Motion carried 4 - 1.
