Joseph met in session on Thursday, August 21, 1980 at 7:30 p.m. in City Hall. ~ Members Present: Mayor Hugo B. Weyrens; Councilmen: Herman Schneider, Steve Dehler, Mike Husen. (Absent: Councilman Bud Reber - working out of town.) Clerk Bob Johnson. others Present: Dave Tripp, MTC director; Attorney Mike Sullivan, representing MTC; Pam Averill, Rueben Muske, representing st. Benedicts bus service; Mel Voight, operator of MTC bus line; Fire Chief Mike Loso. MTC Representatives: Attorney Sullivan presented a brief history of MTC bus trans- portation, operational proceedures and memberships. It was indicated by Attorney Sullivan that City would be required to file a petition for member- ship. City would have one vote on the MTC Commission as a member and would have right of withdrawal at any time from the MTC by implied power. other pertinent information: 1) City would have choice of membership or service by contract on a one or more year basis. 2) Must have guarantee of riders (through survey). 3) City to pay full cost of service with option of how funding is provided. 4) Commission sets fares by agreement prior to contract. 5) Referendum - MTC would not provide service if the question were placed on ballot and voted down by City voters. 6) MTC cannot provide service for handicap at the door except on contract basis. 7) MTC reserves right to terminate contract on 60 day notice. 8) Cost basis: MTC membership under a 1.95 mill rate assessment with adjustment to 2.2 mills anticipated - estimated cost to City approxi- mately $9,000.00 in 1981. Under contract basis City cost is initially estimated at $17,000.00. Information relating to bus routes and time schedules was presented by Mel Voight. A total of six hours daily - 3 hours in morning and 3 hours in evening were proposed for start of service. st. Benedicts representatives, Pam Averill and Rueben Muskie, expressed an interest in MTC bus service. st. Ben's bus routes and schedules will be reveiwed with MTC service operator Mel Voight. The question of cost- apportionment will receive further study by the City Council. The City must notify MTC prior to September 1981 to establish bus service to st. Joseph. Fire Chief Loso: Fire Chief Mike Loso requested City close Ash Street from 1st Avenue NW to College Avenue N on September 13, 1980 - 6:00 to 8:00 p.m. and close 1st Avenue NW from Minnesota Street to Ash Street from 9:00 p.m. to 1:00 a.m. The request was approved on motion by Husen seconded by Dehler. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. Beer License: A motion was made by Husen seconded by Schneider to approve a 3.2 beer license for the Fire Department with the stipulation dram shop insurance is obtained and a certificate presented prior to issuance of a license. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. 994 Pager Batteries: A motion was made by Dehler seconded by Schneider to approve purchase of 12 pager batteries for a total of $60.00 (cost-apportioned wi th To\'mship). Ayes: Weyrens, schneider, Dehler, Husen. Nayes: None Motion carried. - Life Safety Code: A motion was made by Husen seconded by Dehler to approve purchase of 3 Life Safety Code books. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Ìllotion carried. City Attorney Jovanovich: ( 9 : 00 p. m . ) City Attorney Jovanovich presented a review of the El Paso sewer line question. A meeting with st. Benedicts on this matter will be scheduled in the near future. Engineer Joe Bettendorf: Presented a report on street seal coating project. Cracks on 1st Avenue Northwest and Birch Street between 1st Avenue Northwest and College Avenue North were reported and will be examined. Final Estimate: A motion was made by Dehler seconded by Husen to approve the final payment for the seal coating project No. 501.07 in the amount of $13,300.88. The amount of $665.00 retainage will be released upon receipt of a state tax document. Ayes: IVeyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. Sub-Division Regulation Changes: Engineer Joe Bettendorf presented proposed sub- division regulation changes - (copies to be made for Council). Minutes Approved: Minutes of July 24, 1980 were approved on motion by Schneider seconded by Husen. Ayes: IVeyrens, schneider, Dehler, Husen. Nayes: None Motion carried. J.C. 's Beer License: A motion was made by Husen seconded by Schneider to approve beer license of J.C. 's for September 12, 1980 - Octoberfest - same regulations as the last Spring Fling are in force. Ayes: Weyrens, schneider, Dehler, Husen. Nayes: None Motion carried. Gas Furnace Quote: A motion was made by Schneider seconded by Husen to accept low bid of Gene's Plumbing & Heating for gas furnace installation in City Hall Annex building in amount of $2,028.00 installed. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None ì\lotion carried. Air Conditioner Purchase: A motion was made by Dehler seconded by Schneider to approve purchase of used air conditioner in the amount of $100.00 for annex building offices. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. Liquor Ordinance No. 1980-A: On motion by Husen seconded by Dehler the Council approved passage of Liquor Ordinance No. 1980-A. Ayes: \lieyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. 9Q5 L~t The new liquor ordinance is a complete revise and incorporation of all previous liquor ordinance amendments. The ordinance becomes effective after its publication date on September 6, 1980. Licensees are invited to pick up their copies at City Hall. Records Retention Resolution: A motion was made by Schneider seconded by Husen to pass a resolution adopting the Records Retention Schedule prepared and approved by the Municipal Clerks and Finance Officers Association of Minnesota with provisions and exceptions requested by the Minnesota Historical Society. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. (Resolution on file in Resolutions Book #1) MCFOA Dues: A motion was made by Dehler seconded by Husen to approve the $10.00 dues for membership in the Municipal Clerk's & Finance Officers Assn. for 1981. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. Small cities League Dues: On motion by Schneider seconded by Husen the Council approved payment of dues for membership in the Minnesota League of Small cities for lQ81 in the amount of $65.72. Ayes: Weyrens, Schneider, Dehler, Husen. Nayes: None Motion carried. September 8 Planning & Hearing: A variance hearing has been scheduled for September 8, 1980 - 7:30 p.m. in City Hall to consider a request for variance from sign requirements in a residential district. The request has been submitted by Reinert Construction for sign placement at the Cloverdale Townhouse Apart- ment site on East Baker Street. Noise Ordinance Review: The Council reviewed the City Noise Ordinance. A hearing on the matter will be held on September 4, 1980.
