Joseph met in session on Thursday, December 4, 1980 at 7:30 p.m. in City Hall. I Members Present: Mayor Hugo B. Weyrens; Councilmen: Herman Schneider, Bud Reber, Steve Dehler, Mike Husen. City Clerk, Bob Johnson. City Treasurer, Leo Sadlo. Treasurer Report Approval: City Treasurer, Leo Sadlo, presented the monthly fund and investment report. A motion was made by Husen seconded by Reber to accept the treasurer's report as presented. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Council Minutes: Council minutes of october 30, November 6 and November 20 were approved on motion by Reber seconded by Husen with a correction of October 30 minutes indicating Bud Reber absent from meeting and out of City. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Fire Department Grass Rig: A motion was made by Reber seconded by Husen to approve fire department request to construct a grass fire-fighting unit as per method suggested by Fire Advisory Board and Fire Department. The unit construction has been approved by the Fire Advisory Board. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Cloverdale Townhouses Variances: A motion was made by Dehler seconded by Schneider to approve both variance requests of Reinert Homes, Inc. , as recommended I by the Zoning Board of Appeals. Copy of Zoning Board hearing placed in file. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. N aye s : None Motion carried. Liquor Hearing The liquor violation hearing was opened at 8:00 p.m. by Mayor Weyrens. A resume and pertinent data relating to the possible liquor violations of ,licensee Lamprecht, Inc./dba Midway Bar/was presented by Attorney Fred Grunke, representing the City. Attorney Dan RQthmeier represented the licensee. All witnesses were heard and examined by both attorneys. Officer Pat Murphy, Art and Hazel Lamprecht were also called to testify. Minors who indicated liquor consumed on the street was purchased at the Midway Bar were also questioned. After hearing the summaries of both attorneys the Council proceeded to take the following action: On violation #1 dated September 18, 1980 - the Council vote was unanimous with five members voting (yes) a violation had occurred. On violation #2 dated October 30, 1980 - the Council voted: yes - Schneider, Husen, Weyrens. No - Reber, Dehler. The vote was 3-2 that a violation had occurred. I License Suspension: A motion was made by Dehler that a suspension of one day be imposed for the finding of violations. The motion was seconded by Husen. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. 1012 Suspension Day: The one day license suspension was set for Monday, December 8, 1980 on motion by Reber seconded by Schneider. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. This hearing has been recorded on tape and filed with exhibits. I The hearing was closed at 9:55 p.m. Stearns County League Meeting: :-layor Weyrens reported the Stearns County Municipal League would meet in st. Joseph City Hall on Tuesday, December 16, 1980. ~lain agenda item to be a discussion and evaluation of the present County Court system. Police Advisory Board Matters: Mayor \\'eyrens presented information pertaining to Police Advisory Board functions for Council discussion. Council reviewed purpose of organization, its good work, frustrations and difficulties often times due to the lack of data, and information that is available to the Council. It was a unanimous action that the Council should assume the responsibilities of the advisory board and relieve the board of its duties and functions on January 1, 1981 on motion by Schneider seconded by Reber. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Park Board Question: A reorganization of the Park Board will receive Council attention in the near future. Meeting Night Change: Mayor \'\'eyrens requested Council consider changing Council meeting nights to 1st and 3rd Thursdays of the month to coincide with the APO meetings on the 2nd and 4th Thursday of the month. I Organization ~,Ieetings in City Hall: Mayor Weyrens also recommended all organlza- tions related to functions or operations of the City meet in City Hall. No action on this matter was taken at this time. Park Board Compensation: A motion was made by Schneider seconded by Reber to compensate Park Board members for meetings - $5.00 for members and $10.00 for the chairman effective January 1, 1981. Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Park Ordinance: Council to review proposed Park Ordinance for a second hearing on December 18, 1980. Softball Park Fencing: The Recreational Assn. plans to replace the 4' chain link fencing around softball parks with a 10' fence for safety reasons was reviewed by the Council. Estimated cost - $12,000.00. Centennial Park Survey: The recent survey of Lunser Surveying for the city to determine the west lot line of Centennial Park was reportedly complete. Planning Commission Report: A report on Planning Commi ssion work \'las presented by Councilman Husen: 1) variance approvals, 2) Housing Code Board of Appeals functions to be performed by Planning Conruission a half hour in advance of regul ar meetings, 3) Hous ing Code publi c hearing " March. I Millstream Park House Rental: A motion was made by Husen to discontinue the rental of the City housing unit located in Millstream Park as of February 1, 1981. There was no second to the motion. 10~13 Annexation Board: The regular meeting of the Annexation Board will be held on December 10, 1980. Planning Conference: A motion was made by Reber seconded by Dehler to approve I attendance, at Planning Conference December 12-13 in Minneapolis, of Mike Husen and Ben Kremer. (Fee - $70.00 for two.) Ayes: Weyrens, Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. MTC: Report placed in MTC file. - Bills: A motion was made by Dehler seconded by Reb~r to approve payment of bills - as presented. Purchase File Cabinets: On motion by Dehler seconded by Schneider the Council approved the purchase of file cabinets for Police Department as presented in the 1981 Capital Outlay request.
