Pursuant to due call and notice thereof the City Council of the City of st. Joseph
met in session on Thursday, January 22, 1981 at 7:30 p.m. in City Hall.
I Members Present: Mayor Hugo B. Weyrens; Councilmen: Herman Schneider (left at
11:40 p.m.), Bud Reber, Steve Dehler, Mike Husen. Clerk Bob Johnson.
others Present: Joe Brown, Mark Trobec and Rick Reischl, high school students,
were in attendance to observe Council proceedings.
Senior Citizens: Approximately 20 senior citizens were present to discuss use of
former maintenance shop area at City Hall after renovation has been
completed. Al Mohs acted as spokesman for the group. The Council assured
the group that use of the meeting room after renovation during the day
would be no problem. Grant funds in the amount of $20,000.00, reportedly,
may be available for the renovation project with the City required to
provide 25-30% matching funds. plans are to be prepared as soon as possible.
Weed - Drug Day - Albany: A motion was made by Schneider seconded by Dehler to
approve the attendance of Councilman Bud Reber and City Forester Jim
Marthaler at the annual weed meeting at Albany on January 26, 1981. Part
of the session was devoted to drug abuse.
Parks Commission Appointments: On motion by Reber seconded by Husen the following
persons were appointed to the st. Joseph Parks Commission:
Donna Blanchette, Nita Fleming, Marcella Kapsner, Claudette Klein, Nell
Pfannenstein.
I The newly appointed group joined members Harvey Notch, Ray Brandenburger,
Dave Keller, William Lorentz and Dick Taufen to complete the 10-member roster.
Minnesota "D" Day: Minnesota "D" Day - 'No Smoking Day' - January 22, 1981 was
acknowledged by the Council with posters and other data on display at
City Hall and City Hall Annex.
Fire Department Pagers: A motion was made by Schneider seconded by Reber to approve
purchase of 4 pagers and chargers for the Fire Dept. at a cost of $1,200.00.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Liquor Hearing No. 1 : The liquor hearing for Dale Schneider dba Sal's Bar & Cafe
at 109 Minnesota Street West, opened at 9:17 p.m. on possible liquor
violations: Ordinance No. 1980-A Sec. 11, Subd. 1 : Permitting a person
to whom the sale of intoxicating liquor is forbidden to remain on the
premlses, for any purpose whatsoever, except in the company of a parent,
shall be a violation of the Ordinance. Acting City Attorney Fred Grunke
presented a report of the possible violations. Officer Bush was questioned
by the attorney regards the possible violations in question. Sal's Bar
exhibit #1 was submitted by Attorney Grunke for recording. Dale Schneider
now testified in his own behalf. The question of violation was placed
before the Council.
I A motion by Dehler that a violation did occur on both dates and incidents
presented was seconded by Husen.
Ayes: Weyrens, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
1020 A motion was made by Dehler seconded by Reber to suspend sale of
liquor for one day due to findings and discussion of the state of the
ordinance and possible changes and then to waive the one day suspension.
Voting for the motion: Dehler, Reber.
Voting against motion: Schneider, Husen, Weyrens. I
Motion failed.
A motion was made by Husen seconded by Schneider to suspend the license
for two days.
Voting for the motion: Schneider, Husen, \\'eyrens.
Voting against motion: Dehler,Reber.
Motion was carried.
A motion was made by Husen seconded by Schneider to suspend the liquor
license of Sal's Bar & Cafe for the 2 days of February 1 and February 2,
1981.
Voting for the motion: schneider, Husen, Weyrens.
Voting against motion: Dehler.
Abstaining: Reber
Motion carried.

Liquor Hearing #2: The liquor hearing for the st. Joseph Liquor Shoppe - Dave
Hollander, licensee, opened at 10:10 p.m.: M.S. 340.73, Selling, in any
manner, either directly or indirectly, intoxicating liquor to a person
under the age of 19 years.
The testimony of Gerald Lee Theisen was first heard. Officer Randall I
Bush testified and was questioned by Acting City Attorney Fred Grunke.
A motion was made by Reber seconded by Dehler that a finding of violation
does exist.
Voting for the motion: Dehler, Reber.
Voting against motion: schneider, Husen, Weyrens.
Motion was defeated.
Hearing closed at 10:42 p.m. on motion by Schneider seconded by Husen.

Budget Matters: A motion was made by Dehler seconded by Reber to approve final
budget for 1981 with changes presented by City Clerk.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
A motion was made by Dehler seconded by Husen to approve the request
for a budget change in Maintenance Department capital outlay request -
Capital Outlay No. 9 changed to a $1,148.00 total.
Voting for motion: Husen, Dehler, Weyrens,. Schneider.
Voting against motion: Reber
Motion carried. I
Park Shelter Rental: A motion was made by Reber seconded by Husen to approve the
following rental fee schedule for the Centennial Park shelter building:
$15.00 for City residents, $25.00 for Non-residents.

Finance Workshop: A motion was made by Dehler seconded by Husen to approve
the attendance of Hugo Weyrens, steve Dehler and Mike Husen on February 28
and Bob Johnson on February 27 and 28 at the Holiday Inn, st. Cloud
starting at 8:30 a.m. on both days.
Ayes: Weyrens, Reber, Dehler, Husen, Schneider.
Nayes: None Motion carried.
Police officer Hire: A motion was made by Reber seconded by Schneider to approve
the hiring of Peter E. Jansky as a police officer for the City of
st. Joseph starting on February 1, 1981.
Ayes: Weyrens, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Restaurant and Games Room Question: The Council held discussion with attorney
Fred Grunke relating to restaurant and game room questions relating to
liquor operations. Further ordinance research to be made by attorney
for Council consideration.
A motion was made by Reber seconded by Dehler to keep moratorium on
question of juveniles in Sal's Bar & Cafe until further information is
obtained regards ordinance compatability with State Statute.
Voting for motion: Reber, Dehler.
voting against motion: Schneider, Husen, Weyrens.
Motion failed.
Question raised regards licensing of a section of a building for liquor
and gæne room separation. Attorney to provide recommendations.
Renovation Plans: A motion was made by Reber seconded by Dehler to contact
architectural-engineering firm to consider preparation of renovation
plans for the former maintenance shop segment of City Hall.
Ayes: Weyrens, Reber, Dehler, Husen.
Nayes: None Motion carried.
State Aid: A motion was made by Husen seconded by Reber that Council reiterate
its position supporting the League of Cities proposal to the Minnesota
Legislature, that State 2% fire aid funds may be used for any fire
department purpose after funding obligations are fullfilled for fire
penslons.
Ayes: Weyrens, Reber, Dehler, Husen.
Nayes: None Motion carried.
Mayor Conference: A motion was made by Husen seconded by Reber to approve the
attendance of Mayor Weyrens at a League Conference on March 12, 1981
in Minneapolis.
Ayes: Weyrens, Reber, Dehler, Husen.
Nayes: None Motion carried.
Adjournment: The Council adjourned at 12:35 a.m.
