Joseph met in special session on Wednesday, August 18, 1982 at 7:30 p.m. in city Hall. Members Present: Mayor Hugo B. Weyrens; Councilmen: Herman Schneider, Bud Reber, I Steve Dehler, Mike Husen; City Clerk, Bob Johnson; City Attorney, .Jfom Jovanovich. others Present: Attorney Phillip Resnick, representing Randall Bush; Attorney Roger Nierengarten, representing interested st. Joseph area residents. (See attendance roster.) Purpose of Meeting: City Council to determine action to be taken in the Police Department investigation case after review of prosecuting attorney Rick Maddox's options and recommendations. The Council also reviewed the investigatory statements and interviews conducted by investigator Jim Turck including the interview of patrolman Randall L. Bush by Turck. Meeting Opened: Mayor Weyrens opened the special meeting at 7:30 p.m. The Mayor indicated the Council had received a request from Phillip S. Resnick, attorney for police officer Randall L. Bush, to address the Council regarding the Bush case. Attorney Resnick: Attorney Resnick spoke on behalf of his client and presented affidavits from the following persons: Mark Arnold, James Harlander and Ken Dickinson. The City council had received a letter from City Attorney Tom Jovanovich on August 10 stating the Minnesota Open Meeting Law prohibits Council I members from discussing pertinent case matters prior to this meeting tonight. Attorney Resnick stated his source of information had been the news media. Attorney Jovanovich: Attorney Jovanovich reviewed the process and proceedures of the investigation and the options the City Council has at this time. The investigatory files contain 225 pages of interviews and interragations conducted by investigator Jim Turck. Attorney Jovanovich also indicated Turck had reviewed police reports. Motion to Terminate: A motion was made by Councilman Reber seconded by Councilman Schneider to terminate the employment of Patrolman Randall L. Bush and to initiate proceedings to oreate a 3 member board of arbri tration. Voting for motion: Schneider, Reber, Weyrens. Voting against motion: Dehler, Husen. Motion carried. Attorney Nierengarten: Attorney Roger Nierengarten recommended City submit entire investigatory files to the arbritration panel. Attorney Jovanovich: City Attorney Jovanovich presented a review and explanation of the work of investigator Jim Turck. Police Chief Lorentz: Chief Lorentz indicated he had requested a copy of the Attorney Maddox letter and investigatory file from Mayor Weyrens. Lorentz I also requested City pay Bush's attorney fees. Motion of Authorization: A motion was made by Reber seconded by schneider author- izingCity Attorney Tom Jovanovich to notify Attorney Rick Maddox that the 1119 city direction in the case would be termination through the appointment of a 3 panel arbritration board. Voting for motion: Reber, Schneider, Weyrens. Voting against motion: Dehler, Husen.
