Pursuant to due call and notice thereof the City Council of the City of st. Joseph
met on Monday, May 23, 1983 at 7:00 p.m. in City Hall to hold a public hearing on
a proposed improvement consisting of sanitary sewer, stòrm sewer, watermain, concrete
curb and gutter and bituminus streets. The estimated cost of the project is $531,200. I
The improvement shall be constructed on the following streets within the City and
along County Highway #2: Minnesota street West, 6th Avenue Northwest, 7th Avenue
Northwest, Ash street West and Birch street West.
Members Present: Mayor Mike Loso; Councilmen: Herman schneider, Bud Reber, Steve
Dehler, Mike Husen; City Clerk, Bob Johnson; City Attorney, Tom Jovanovich;
City Engineer, Joseph Bettendorf.
others Present: Attorney Mike Sullivan and Sr. Kathleen Kalinowski, representing
st. Benedict's Convent, Mildred Reisinger, Bob Reisinger, Linda Reisinger, Bill
Elfering, R. J. Manderfeld, Vince Manderfeld, James Landwehr, Rosie Terwey,
Louis Terwey, Ed Kacures Sr., Hub Klein.
Mayor Loso opened hearing at 7:00 p.m.
Engineer Bettendorf presented feasibility report highlights - improvements and
services to all lots - Terwey residence can be serviced by sanitary sewer,
according to Bettendorf.
Project to require a 90 day construction period - streets may be completed in
spring depending on weather. Some of the questions and answers raised were
as follows:
1) Would storm sewer and street assessments be attached to some of the properties
on County Road #2? Answer: No I
2) Determination of st. Ben's assessment and amount? Answer: $15,000.00 for
1/3 cost of storm sewer outfall line. st. Ben's property south of County Road
#2 assessed on a 10-lot basis for the 10" watermain to be installed along the
north side of County Road #2.
3) The present dollar numbers are estimates? Answer: Good chance bids would
be below estimate. Current bids have been coming in low in the market place.
4) Location of 10" watermain? Answer: Shoulder of County Road #2 - north side -
bituminus to be removed (bike path) and replaced. All other utilities to be
located prior to excavation start.
5) Location of Louis Terwey lot - Township or City? Answer: Split location -
part of property in City - projecting section line to determine exact location
will be completed. Question of returning all property to Township jurisdiction
raised. If Terwey not interested in services, project would stop before reaching
property. Sewer question: Engineer indicated PCA would allow less grade to
pick up Terwey with an 8" sewer main. Service line would enter about 2' below
Terwey residence foundation. Terwey does have option.
6) If length of watermain on Minnesota Street is reduced, will it reduce st. Ben's
assessment proportionately? Answer: Yes.
7) If Terwey decides against utility services, does Reisinger have same option I
on second lot? Answer: Yes.
8) It was stated that Gapko and Notch do not need the watermain on County Road
#2. Both would accept sewer installation.
9) st. Ben's assessment on waterline - (10" down County #2): 1181
Answer:
Assessment based on line location - average lot size used as basis - front foot
assessment would not change assessment amount.
~ 10) storm Sewer Outfall - st. Ben's:
a) st. Ben's can tie into storm sewer to serve property north of Clinton
Village Addition.
b) Sanitary sewer and water could utilize storm sewer easement area - water
looping would be required - same as for Clinton Village Addition.
c) Prior to approval of Clinton Village plans and specs and Council order to
proceed, all easement questions must be finalized. A letter from st. Ben's
indicating a willingness to negotiate easement with developer was submitted.

d) st. Ben's has indicated there is a legal problem relating to property deed
that must be resolved. Attorney Sullivan (st. Ben's) to examine all
pertinent documents. st. Ben's also requested a more accurate location of
easements. st. Ben~s board meeting scheduled for June 18. Engineer indicated
that kind of delay would seriously delay project completion for this year.
Sr. Kathleen Kalinowski agreed to try to resolve matter with st. Benedict's
executive board by June 2, 1983 to allow City Council approval at its
regular June 2, 1983 meeting. st. Ben's intends to negotiate easements
with developer and convey to city subject to: (1) final legal descriptions
which will be prepared by the city after the plan survey has been completed;
(2 ) our record ownership of the lând described in the easements; (3 ) a
determination that our property proposed to be assessed for storm sewer
improvements has aecess to a public road; and (4) necessary corporate
approval authorizing the conveyance on behalf of the corporation. It is
also understood that construction contracts for the proposed improvements
will not be executed until the conveyance has been deliverd to the city.
e) Manderfeld - Elfering (Hollow Park) easements: Answer.: Letters of intent
to negotiate have been presented to developer.
f) Past statement of charges to developer: developer verbally agreed to pay.
g) Notch - Gapko: indicated they want sewer but do not like water assessment.
Terwey: would accept sewer to eliminate easement hassle later on. Had
some objection about water assessment but stated he would accept.
Summary:
1) Easements - a) Manderfeld - Elfering have submitted letters of intent to negotiate
with developer.
b) A letter was received from st. Ben's indicating a willingness to
negotiate necessary easements with developer.
2) Watermain on County Road #2 can stop at 6th Avenue Northwest - removing Reisinger
and Terwey from access and assessment charges. Reduce assessments to st. Ben's
property south of County Road #2.
3) Sanitary sewer extensions can stop short of the following properties: Reisinger -
Terwey and Gapko - Notch - if property owners desire. This would allow City to
return to minimum grade resulting in reduced service for City maintenance crew.
(Future service to those properties would then probably be by lift station or
trunk line from west.)
4) The September 1, 1983 construction start will commence on Cypress Drive in Hollow
Park Addition. The sewer line is estimated to be 5' to 10' from lot line.
Easement to be on development property.
Motion to continue Hearing: A motion to continue hearing to June 2, 1983 at 7:00 p.m.
was made by Reber seconded by Schneider.
