Joseph met in session on Thursday, July 7, 1983 at 7:30 p.m. in City Hall. Members Present: Mayor Mike Loso; Councilme.n: Bud Reber, steve Dehler, Mike Husen; City Clerk, Bob Johnson; city Treasurer, Leo Sadlo. (Councilman Herman Schneider absent - hospital.) Others Present: Dave Dropp and son; Mike strickler; Police Chief Bill Lorentz. Treasurer Report: City Treasurer Leo Sadlo presented the monthly fund and investment report. A motion was made by Dehler seconded by Reber to approve treasurer report as presented. Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. Council Minutes: A motion was made by Dehler seconded by Reber to approve Council minutes of June 16 and 27 as presented. Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. Payment of Bills: A motion was made by Reber seconded by Dehler to approve payment of bills as presented. Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. Dropp Re-zoning: David Dropp was present regards his request to re-zone the following I property: Lots 7 and 8, Blk 2 and 3, Loso's 7th Addn. from R-l to R-3. The City Planning Commission recommended Council approval with the following stipulations: 1) that the property will hold a certificate for rental housing as long as it is used for that purpose; 2) that at least 6 off-street, hard surface parking places be constructed since the house will be renovated as a duplex and will be used to house 8 college students. In conformance with the zoning Ordinance 13.04-B, no more than 2 spaces shall be allowed in the front yard setback. Dropp indicated he has sufficient property for off-street parking on east side of house (approx. 60' ) . A motion was made by Husen seconded by Reber to approve the Dropp re-zoning with the following change in Planning Commission stipulations: 1) (same as Planning Commission) 2) change No. 2 to read "8 persons", (not 8 college students). Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. Police Department Matters: Mayor Loso presented copies (to Council) of a written complaint about City Police Department proceedures from Attorney Kurt Deter of the legal firm of Rinke, Noonan, Grote and Smoley, Ltd. , Sauk Rapids, MN. The complaint referred to two letters received by a client clearly indicating the st. Joseph Police Department and/or the Stearns County sheriff's Department I may have been in serious legal and ethical violation with regard to the confi- dentiality of juvenile criminal complaints. According to Attorney Deter, the letters clearly show that juvenile matters are being openly discussed and information given to other members of the community at coffee meetings at the local cafes in st. Joseph. The letter demands the Mayor and Council put a stop to this type of activity. 1190 Mayor Loso stated he had a meeting with Chief Lorentz on May 6, 1983 regards this type of conversation in local cafes and instructed Chief Lorentz to put a stop to such violations as they were improper and illegal. A motion ,vas made by Mayor Loso that Council direct a letter to Chief Lorentz, I as the department supervisor, stating that future breaks shall be taken according to City personnel policy that allows a 15-minute rest period during each one-half work day to be scheduled at the middle of such one-half work day whenever feasible. Further, the letter shall state that the confidentiality of juvenile criminal matters will not be violated. Any further incidents of this nature will result in disciplinary action. The motion was seconded by Reber. Discussion: Husen disagreed with tone of reprimand at this time, and suggested that a reprimand after the next such violation would be more appropriate. Husen also stated he does not like to act on unsigned letters. Mayor Loso again stated he had discussed the same problem a month ago with Chief Lorentz. Dehler indicated the letter writers apparently knew information that should not have been made available to them (referring to juvenile confidentiality). Reber reminded the Council of a personal case involving his family where the violation of juvenile confidentiality has also occurred. Voting for motion: Loso, Reber, Dehler. Voting against motion: Husen. Motion carried 3-1. Patrolman Jansky Suspension: Mayor Loso presented Council members with a letter from Chief Lorentz stating the following reasons for patrolman Pete Jansky's 3-day I suspension on June 28-29-30, 1983: 1. Passenger in patrol car in violation of our policy. 2. Taking patrol car out of your jurisdiction. 3. Participating in an act not in your job description, such as knowingly allowing this department to be used in a story that is not true. 4. Driving patrol car at speeds over speed limit, not in a chase and without red lights and siren. 5. No I.C.R. was written to show your activity in above action. 6. Telling people about your involvement in these actions and boasting that if you get caught you will get fired. 7. Spending too much time on your public relation stops after I told you to keep these stops to 10 minutes. You are a professional policeman and I expect you to act as such. Therefore I am suspending you for three (3 ) days in hopes you will try harder to conform to our policies. You may use comp time so you will not lo,¡lse pay for the three days off. The days are June 28, 29 and 30, 1983. Feel free to answer this letter and if you do not accept the reprimand put it in written form and I will forward it to the Mayor for his action. Wastewater plant Gate: A motion was made by Reber seconded by Husen to accept quote of Trojan Manufacturing Company, st. Cloud, Mn., as submitted: material - $490.00 installation - 220.00 Total $710.00 The gate will be 8' in height and provide access to the south side of the I Wastewater Plant to permit repairs on the primary clarifier sometime in July or August. Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. 11°1 .. g . Randall Bush Case Matters: _ 't., _ 1) The Randall Bush district court appeal brief has been filed by his attorney - dated June 18, 1983. Attorney Rick Mattox will be responding to this brief and will file the brief for the City within the allotted 30 day period. I 2) The Bush unemployment compensation appeal hearing date scheduled for July 6, 1983, was cancelled due to hospitalization of claimant Bush's attorney. A new hearing date is expected to be scheduled in the near future. Council Reports: Reber: Reported on Ehlert alley matters- all problems reportedly have been eased. Husen: Annexation Board meeting report: Tom Rothfork property hearing and re-zoning information presented. The Board moved to allow rezoning providing one residence is constructed in the northwest corner of the property and there be no accessory uses for a farm operation. The zoning changed from (I) Industrial to (FR) Farm Residence. Civil Defense Director: Mayor Loso indicated city resident Mike strickler was interested in the civil defense directorship. The Mayor stated the present director, Dick Taufen, would like to retain position at the present time, therefore, no opening existed. strickler to be notified when position is open for consideration. stop Sign Installation: A motion was made by Dehler seconded by Reber to approve installation of a stop sign on Cedar street West at the junction of 1st Avenue Northwest. Ayes: Loso, Reber, Dehler, Husen. Nayes: None Motion carried. st. Ben's Meeting: Mayor Loso reported a meeting with st. Ben's will be scheduled in late August, according to information from Sr. Kathleen Kalinowski's office.
