Pursuant to due call and notice thereof the City Council of the City of
st. Joseph met in session on Thursday, December 15, 1983 at 7:30 p.m. 1n I
City Hall.
Membe~s Present: Mayor Mike Loso; Councilmen: Herman Schneider, Bud Reber, Steve
Dehler, Mike Husen; city Clerk, Bob Johnson.
others Present: Deb Dorshorst, editor, st. Joseph Courier; Tom Thelen, field
representative, Minnesota League of Cities.
Torn Thelen was present for a visit with the City Council. Presented information
relating to: a) Legislative session, b) Annexation, c) Local government aid -
a review of the aid process was conducted, d) Trust funds - for City benefit -
discussion of contributions and use of funds. Income tax credit for contribu-
tions also cited by Thelen. Thelen to provide update of League health insurance
program by mail.
Minutes: Council minutes of December 1, 1983 were approved on motion by Dehler,
seconded by Husen.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Bills: A motion was made by Schneider seconded by Reber to approve payment of bills
- as presented.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Gambling License Applications: The gambling license application of Sno Joes and I
st. Joseph Jaycees were approved on motion by Husen seconded by Reber.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Clinton Village Project Payment: On motion by Dehler seconded by Schneider, payment
No. 3 was approved to Barbarossa & Sons, Inc. on the Clinton Village project
in the amount of $6,533.72.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Park Refuse Garbage Pickup: Reber moved, Dehler seconded to approve the $5.00 per
account per month garbage pickup fee for 1984 as requested by Park Refuse Service.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Year End Transfers: The following year-end transfers and payments were approved on
motion by Schneider, seconded by Husen:
1) 1970 Water Imp. Fund: to 1961 Sewer &1965 Street(as per payment schedule).
2) 1973 Water Main Imp. Fund: balance to 1970 Water Fund.
3) 1976 R.R. & College Ave. Imp: to 1961 Sewer Fund - transfer return.
4) 1979 Alley Imp. to General Revenue - transfer return.
5) State Aid transfer: to Fire Department.
6) Fire Hall deþt redemption: Joint Fire Op. Fund to Gen.Rev.Fund (3671.88) . I
7) Town share of Hall debt: 63%(2313.28) to 1970 Water Sys. & Fire Hall Imp.
8) Police Fund 2% to General Revenue - return of funds.

Township Communication: A letter from st. Joseph Township relating to summer
swim program operation was presented and filed for consideration next spring.
Pawnbroker Ordinance: The Council received information relating to a pawnbroker
I operation. possible adoption of an ordinance will receive Council considera-
tion and review.
Sidewalk Snow Removal: Reber moved, Dehler seconded that City Clerk's office send
letters to property owners, on complaints, that Ordinance No. 29 requires the
owner of each lot, parcel or piece of land within the City to remove or cause
to be removed all snow, lce, dirt and rubbish within 24 hours from all side-
walks adjacent to or abutting his or her property. If the owner fails or
neglects to remove snow, 1ce, etc. within the designated time, the Ci ty shall
cause the same to be removed and shall assess the cost of such removal against
the properties involved. The property owner shall have 30 days to pay the
cost qfter billing. All statements not paid after 30 days shall be certified
to the County Auditor for attachment to general property taxes.

Cable Information: Cable update information received from the Westel Cable Co. was
presented for Council study.
Fire Center Workshop: On motion by Dehler seconded by Husen the Council approved
the attendance of: Dick Taufen, Fire Chief; Roman Reber, Bldg. Inspector;
and Bob Johnson, City Clerk at a workshop "Managing Fire/Building Department
Liabili ty" . The workshop is being offered by the University of Minnesota
Fire Center, at the Earle Brown Center, st. Paul Campus, on January 17, 1984.
(Estimated cost - fees and travel: $172.00 total.

Voting Equipment Conference: Husen moved, Schneider seconded to approve the
attendance of City Clerk, Bob Johnson, at a voting Equipment Conference,
offered by the Office of Secretary of State on Wednesday, January 25, 1984 in
st. Paul. No fee and advance registration is not required.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Police Dept. Fire Arms Course: A motion was made by Dehler seconded by Reber to
approve a rental fee of $15.00 for police department to participate in a fire
arms course at the State barn in st. cloud on January 17 - 20, 1984.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Final Water System Analysis Report: Engineer Bettendorf indicated by phone that the
complete and final engineering report on the City Municipal Water System supply,
distribution and storage facilities wîll be available for Council review early
next week.
Millstream Park Grant Project: A time extension to July 1, 1984 has been requested
of the DNR grants section as requested by the Parks Commission to allow project
completion and documentation preparation in spring.

Road Grader: Dennis Munson, Ziegler Co. representative, presented information on
a No. 12, 1957 Caterpillar road grader, examined by City maintenance chief
and Mayor for purchase consideration. The grader has a V plow and wing
attachment - a new set of cutting edges will be included in the purchase at I
no cost. Former owner: Irv Mayer, Melrose, Minnesota.
A motion was made by Schneider seconded by Reber to approve purchase of the
motor grader at a price of $12,500.00 as recommended by Mayor Loso and Maint-
enance Superintendent Dick Taufen.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
($10,000 - 1984 Revenue Sharing Funds allocation. Balance of $2,500 to be
paid from a previously allocated maintenance department Capital Outlay balance.)
Highway Flasher Problem: Dick Taufen, Maintenance Supervisor, reported County Hwy.
#75 flasher motor problem. unit to be returned to Electric r.lotor Service.
Bush Extra Compensation: A motion was made by Reber seconded by Husen to approve
letter dated 12/15/83 and payment to Randall L. Bush for the following items:
1. Comp time: 84.5 hours at 7.85 ------------------- $663.33
2. 4 holidays prior to suspension (32 x 7.85) ------- 251. 20
(New Years, Presidents Day, Good Friday, Memorial Day)
3. 10 vacation days (1981 earned) 80 x 7.85 -------- 628.00
4. 5 vacation days earned prior to suspension ------- 314.00
Total --------- $1,856.53
The above includes 10 vacation days earned in 1981 not requested by Bush and
also includes all overtime/comp time requested and earned. The City stated
it would not pay Bush for holidays and vacation days he claimed were earned I
after suspension.

District Court Order on Appeal & Memorandum: The City Council reviewed District
Court Judge Paul Hoffman's Order on Appeal and memorandum on the Randall L.
Bush case. The case is remanded (sent back) for the limited purpose of per-
mitting the Hearing Board to exercise its authority to fashion a remedy other
than that imposed by the City Council for the City of st. Joseph, if in its
opinion, such exercise is warranted, in accordance to the attached memorandum,
by Judge Hoffman. The Order on Appeal was dated December 6, 1983.
A motion \vas made by Reber seconded by Schneider to pass the following resolu-
tion: "After revie\ý of Judge Hoffman's Order on the Randall Bush termination,
the st. Joseph City Council hereby re-affirms its decision to terminate
Randall Bush as a police officer for the City of st. Joseph."
voting for the resolution: Mayor Loso, Reber, Schneider, Dehler.
Voting against resolution: Husen. Resolution is passed 4 - 1.
(A copy of the Order on Appeal and Memorandum has been placed on file in the
"Police Investigation File - District Court Briefs".)
Letter of Commendation: Mayor Loso presented a letter of commendation from the
Stearns County Sheriff's office for the fire department's outstanding ,vork. in
combatting the fir~ at the Wilshire Apartments on December 9, 1983.
First Aid Kits: A motion was made by Reber seconded by Husen to approve purchase I
of first aid kits for skating and hockey rink where needed.
Ayes: Loso, Schneider, Reber, Dehler, Husen.

Council Reports:
Husen: 1 ) Planning Commission members Chairman Kremer and Secretary
Durkee terms expire January 1, 1984.
2) Dropp variance hearing scheduled for January 9, 1984 at 7:30 p.m.
3) Bowser boat cover question - violation of ordinance.
4) Housing Code - rentals to receive second notice to register.
Dehler: Park Terrace street repair or re-construction question raised.
Part of City's street Capital Improvements program.
Mayor Report:
1 ) Mayor's Conference report: "How To Handle Emotionaly Charged
Councils."
2) Prepare to consider wages, Capital Outlay proposals and fire
pension at January 19, 1984 meeting.
