Pursuant to due call and notice thereof the City Council of the City of
I st. Joseph met in session on Thursday, May 17, 1984 at 7:30 p.m. in City Hall.
Members Present: Mayor Mike Loso; Councilmen: Herman Schneider, Bud Reber, Steve
Dehler, Mike Husen; City Clerk, Bob Johnson.
Others Present: Art Reber; William Elfering; Deb Dorshorst, Courier Editor.
Minutes: Council minutes of the May 3, 1984 meeting were approved as presented on
motion by Dehler seconded by Husen.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Liquor Applications: A motion was made by Reber seconded by Schneider to approve
applications as presented:
La Playette, Inc. - Liquor license - On-Sale, Off-Sale, Sunday
Louie's Midway Bar, Inc. - Liquor license - On-Sale, Off-Sale, Sunday
EI Paso Club, Inc. - Liquor license - On-Sale, Off-Sale, Sunday
Salts Bar & Grill - Liquor license - On-Sale, Off-Sale, Sunday
Legion Post 328 - Liquor license - Club On-Sale, Sunday

Robert Wagner Variance: On motion by Reber seconded by Schneider the City Council
approved the granting of a 3 foot variance to Robert Wagner, 19 Ash Street
East, from side yard requirements to allow construction of a garage (20' x
40') with a stipulation that abutting property owners (Wagner-Hiemenz)
exchange easements relating to common driveway entry.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Rothfork - Baklaich - Used Car Lot: A motion was made by Husen seconded by Reber
to allow Pete Rothfork and John Baklaich to proceed, if and after Planning
Commission approval, at the May 23, 1984 hearing, of the opening of a used
car lot operation and authorized the issuance of a building permit provided
all building requirements are met. The operation will be located on Cedar
Street, east of Hollander's Store and gas station.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Sal's Bar & Grill Liquor Question: After Council review of a possible liquor
violation and discussion with Attorney John Scherer.
A motion was made by Husen seconded by Schneider that a liquor violation did
occur on April 24, 1984.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
- A motion was made by Dehler seconded by Reber to suspend Salts Bar & Grill
intoxicating and non-intoxicating liquor licenses for a period of 8 days,
starting May 29 through June 5, 1984.

Licensee indicated he admitted to the violation as per report he received
from Police Department, The report was offered as exhibit "A" by City
Attorney John Scherer. Suspension to be executed according to Council
decision,
A motion was made by Schneider seconded by Dehler to close hearing at 8:20 p.m,

Recess at 8:21 p.m, - Council reconvened at 8:32 p,m.
Rental Housing Complaints: Rental housing violations and policy were discussed.
Police Chief Lorentz was present. The following rental unit owners are to
receive notice of hearing scheduled for June 7, 1984 - 8:00 p.m. - City
Council meeting,

The Council approved the follo\ving policy on motion by Reber seconded by
Schneider:
1st complaint: Police Department record complaint and mail certified
notice to property owner,
2nd complaint: Police record complaint and provide City Clerk's office
with copies of both complaints. City Clerk to provide City
Council \vith copies to schedule hearing and consider possible
suspension or revocation of rental housing license. City Clerk
to notify owner of property of hearing date by certified mail,
Copies to: Police Dept., Housing Inspection Dept, and renters,
when possible.

Engineer Bettendorf: Presented a report on City Seal Coat Project #84-1. Back-
ground check on low bidder included in report. Engineer recommended award
of bid to Buffalo Bituminous, Inc. of Buffalo, Minnesota, the second lowest
bidder,
A motion was made by Reber seconded by Husen to award street seal coat project
#84-1 to Buffalo Bituminous, Inc.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Well #2: Engineer presented a report of proposed repairs for Well #2, Review of
contractor proposal was held. Discussion conference to be held with well
driller, Engineer recommended trying to rehabilitate Well #2.
A motion was made by Schneider seconded by Reber to approve rehabilitation of
well #2 as recommended by Engineer Bettendorf.

clinton Village Project: Developer requested soil borings be taken to comply with
FHA requirements. Question raised is it developer or project cost? The use
of contingency funds was also questioned.
I A motion was made by Husen seconded by schneider to approve cost of soil
borings as a contingency fund expenditure. Estimated cost: $1,500 - $2,000.
Voting for motion: Schneider, Husen, Dehler, Loso.
voting against motion: Reber. Motion carried.
clinton Village Project Assessment Deferrment: Don and James Landwehr requested
City Council consider deferrment of some of the first installment assessments
due on May 15, 1984. City Attorney indicated bond counsel agreed that the
Landwehrs could pay all that portion of the May 15, 1984 assessment except
for any interest which would be attributable to the streets and curb and
gutters. The amount would be $14,365.00 and that the money would have to be
paid by October 15, 1984 in addition to any other assessment installments due
at that time. This would assist the Landwehrs in their cash flow problem and
the City would merely not make any effort to collect that portion of the
assessment not being paid. Bond counsel also stated that if the $14,365.00 was
not paid in full by October 15, 1984, the City should take the appropriate
legal action to collect on the assessment due.
A motion was made by Reber seconded by Husen to approve deferrment of $14,365.00
of first installment interest as recommended by the City Attorney.

Summer Youth: The City received word it will have four positions under the Governor's
Summer Youth work program. Interviews to start soon.
Police Baton Training: A refresher course in police baton training was approved
for Patrolman Pete Jansky on motion by Dehler seconded by Reber.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Training class at Alexandria's Vo Tech August 24-25, 1984. Total cost is
$150.00. Recertification required every two years.
Fire station Doors: A motion was made by Husen seconded by Dehler to approve
purchase of two fire station doors as per low quote of Overhead Door Company
of st. Cloud at a cost of $2,985.00. If existing tracks are used deduct
$100.00 per door.
voting for motion: Husen, Dehler, Schneider, Loso.
Voting against motion: Reber. Motion carried.
Bills Approved: A motion was made by Reber seconded by Husen to approve the
following bills for payment: 1) Lee's Ace Hardware - $121. 61
2) Avon Lumber Company - $437.24

Nayes: None Motion carried.
Dave pfannenstein - Water Line Installation: Mr. pfannenstein will be advised to
return to Planning Commission to obtain approval of lot divisions in LOSO'S
5th Addition. Water line project proposed approved if proper permits are
obtained.
Fire Hydrant Installation: A motion was made by Reber seconded by Schneider to

approve installation of a fire hydrant on corner of Ash street East and
Second Avenue Northeast (estimated cost: $2,000.00) , Excavation necessary
for hydrant installation and connection of the lYz" private line to be
shared on a 50-50 basis between City and private line owner. I

Nayes: None Motion carried. Gas Meter Problem: A motion was made by Reber seconded by Dehler to approve
installation of iron posts to protect gas meter located in alley between
City Hall and Annex building,

Council Reports: Husen: Orderly Annexation Board met on May 9 to hear Lutheran
Church representatives present proposed plans for annexation of a portion
of the Susan Roske property to construct a church. June 30 closing scheduled
with construction to be delayed for three years. Question of re-zoning and
consideration of the issuance of a special use permit to be reviewed at a
public hearing to be scheduled for June 14, 1984 at 7:30 p.m, in Ci ty Hall,
All street and County highway access questions and needs to be studied along
with sewer and water line easements, etc. The area covers approximately
4,8 acres,
Dehler: Reviewed street repairs, seal coating and re-construction needs,
