I Pursuant to due call and notice thereof the City Council of the city of
st. Joseph met in session on Thursday, June 21, 1984 at 7:30 p.m. in City Hall.
Members Present: Mayor Mike Loso; Councilmen Herman Schneider, Bud Reber, steve
Dehler, Mike Husen.
Others Present: Jim Smith, associate- owner of the rental property located at
215 Minnesota street West. Mr. smith indicated there appeared to be a lack
of communication between he and partnership. He was not aware of the incidents
or complaints. smith also apologized for the conduct of the female student
renters. He also indicated his partner, Bob Ahles, did not receive the hearing
notice due to being out of town at the time. A daughter signed for the regis-
tered mail. smith inquired about possibility of license renewal. Mayør Loso
indicated there was no guarantee. The use of convenants or stipulations in
a lease was also examined.
Others Present: Iver Linnemann; Hazel Lamprecht; Lee Kapsner; Vince Manderfeld;
Nancy Manderfeld; Steve Eiynck; Bill Lorentz, Police Chief; Mark Zimmer,
Deb Dorshorst, Courier Editor.
Council Minutes: A motion was made by Dehler seconded by Schneider to approve the
Council mi~utes of June 7, 1984 as presented.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: Nòne Motion carried.
st. Ben's Meeting: A "Water Systems Conference" has been affirmed with st. Bens
for June 26, 1984 at City Hall at 7:30 p.m.
Cable Update: City Clerk reported Westel, Inc. indicated construction start was
set for July 5, 1984. The cable firm is presently negotiating for a headend
site and office space.
Mark zimmer - 8:00 p.m.: Mark zimmer, liquor licensee La Playette, indicated most
licensees would like to see an amendment to City Liquor Ordinance relating to
pages 9-10-11: Restrictions on consumption: Sub. 2, No. 1, Page 10. To allow
licensees to hold functions on their property outside of building. zimmer
suggested some type of special use permit with stipulations or guidelines -
issued for each function and operating no later than 8:00 or 10:00 p.m.
Council to give matter further study - attorney review.
Firework Request: A motion was made by Reber seconded by Dehler to table st. Cloud
Legion's request for donation for their st. Cloud 4th of July display.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Memorial Park Fencing: A proposal from Trojan Playground Equipment Company to re-
install fence around baseball field in Memorial Park was presented for review.
Cost estimates were: $2,455.00 and $2,251.00. A motion was made by Loso
seconded by Husen to table matter for further study.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
307 Birch Street West Rental Property: The owner of the rental housing property at
307 West Birch Street did not appear fop the hearing. A motion was made by
Reber seconded by Husen to revoke the rental housing license issued to Pat

McCauley for the residence located at 307 West Birch street due to 3 complaints
of loud parties, nOlse, etc.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried, III

Legion Liquor Hearing: Present for the hearing were: Gib stock, Commander; Mark
Loso, Bar Manager, Police report indicated possible violation occurred on
6-04-84. Commander stock cited legal fees as reason for not having an attorney
present, The report stated a possible violation occurred for: "permitting
persons on the premises later than 20 minutes after sales must terminate."

A motion ,ýas made by Reber seconded by Schneider to suspend license for 3 days
plus one day for violation during probation period for a total of 4 days.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried,
On motion by schneider seconded by Reber the suspension time was set for June
25,26,27,28, 1984,
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Council advised licensee to know and adhere to the laws and ordinances ln
their operation.
Shop Door Openers: A motion was made by Reber seconded by Dehler to approve maint-
enance shop door openers quote from st, Cloud Overhead Door Company at $850,00
for both doors.
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried,
Weed Killer: 14 gallons - estimated cost $108.00 approved purchase on motion by
Schneider seconded by Reber.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Midway Bar possible Violation: Police report indicated possible violation on 6-08-84,
strong beer sold off-sale in place of 3.2 beer.
A motion was made by Reber seconded by schneider to send Midway Bar a letter
of reprimand.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Joe Bettendorf - Engineer: The engineer presented new copies of an APO population
projection, Letter to PCA May 15, 1984 - proposed schedule.
A motion ,ýas made by Dehler seconded by Schneider to approve engineering facil-
ities plan schedule (plans and specs) as presented,
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried,

Facilities plan addendum costs estimated at $6,800.00 approved on motion by
schneider seconded by Husen. (Facilities plan to be complete in 3 months.)

st. cloud Agreement (Wastewater Hookup): Time for review - action should be taken
by August, 1984.

Well #2 statement: Engineer recommended payment of the statement from Donabauer
Well Drilling in the amount of $2,895.00 for rehabilitation of Well #2.
Well reported back in good shape. Has tube inserted for liquid chlorine
injection once a month.
A motion was made by Husen seconded by Reber to pay amount of statement -
$2,895.00.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Lutheran Church in America: Attorney Frank Kundrat appeared as representative of
the Lutheran Church. A letter of recommendation from the City Attorney's
office guided the Council in the following actions:
A motion was made by Husen seconded by schneider that City Council agree to
provide the Lutheran Church in America a special use permit with automatic
renewal each year for a period of 3 to 5 years as determined by the Joint
Powers Board.
Ayes: Loso, schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
A motion was made by Dehler seconded by Reber that the City Engineer be
directed and hereby is, to investigate the feasibility of the proposed
development and the City's ability to provide essential services to the
development:
Ayes: Loso, Schneider, Reber, Dehler, Husen.
Nayes: None Motion carried.
Access to County Road #75 has had preliminary discussion, according to
Attorney Kundrat. Size of area proposed for building reported as 5-7,000
square feet. The church estimated a membership of 325-350 persons.
Council Reports:
Reber: Reported recreation director charging modest fee for participants in
summer program who are not residents.
Husen: Planning Commission would appreciate Attorney in attendance at their
July 2, 1984 meeting. Approved by Council.
Dehler: Joe Town Auto matter. Status inquiry. A lease dispute has been
reported. Council to act on matter at next meeting.
