Joseph met in City Hall on Thursday, October 4, 1984 at 7:30 p.m. Members Present: Mayor Mike Loso; Councilmen: Herman Schneider, Bud Reber, Mike Husen; City Clerk, Bob Johnson; Treasurer, Leo Sadlo. (Absent: Councilman Steve Dehler - out of state.) Others Present: Roman Reber, building inspector. Treasurer Report: The monthly treasurer report was presented by Leo Sadlo and approved on motion by schneider seconded by Reber. Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. Bills: A motion was made by Husen seconded by Reber to pay bills as presented. - Ayes: Loso, schneider, Rèber, Husen. Voter Registration Report: City Clerk reported first two days (4 hours each) resulted in 137 voter registrations. Registration days scheduled were: September 26-27; October 3; October 10-11: 10:00 a.m. to noon and 1:00 to 3:00 p.m. each day in Mary Commons. Rental Housing: Attorney John Scherer presented an Amendment to Housing Ordinance #1980 and a resolution creating a policy for enforcement of the ordinance. Jim Smith Hearing: Jim Smith, Collegeville, a partnership owner of the rental I housing property located at 215 Minnesota street West, appeared before the Council. smith requested Council consider re-instatement of rental housing license. smith reported contactiNg persons in neighborhood: Mr. and Mrs. Henry Notch, Don Hartig and Leanore Roeder. None in favor of signing document approving re-instatement. smith presented copies of letters sent to neighbors and renters of last year. A motion was made by Husen seconded by Reber to approve a probationary re-instatement of rental housing license for the Smith property at 215 Minnesota Street West with the following conditions and terms: 1) Provide neighbors with landlord's name and phone number. 2) Inspect premises at least once every two weeks. 3) Repair damage to neighbors premises. 4) Make reasonable restitution for damage to neighbors. 5) Allow no parties on premises. 6) Subject to revocation upon first substantiated complaint relating to tenants or premises during probationary term. 7) Provide City with the names of the tenants. Conditions 3 and 4 must be completed by October 18, 1984. Probationary period to continue to December 31, 1984. Building Inspector to discuss damages with Henry Notch to determine reimbursement. Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. I Amendment and Resolution Review: The Council reviewed the proposed amendment to housing ordinance and resolution of policy with Attorney John Scherer. Amendment Adoption: -A motion was made by Husen seconded by Reber to adopt amendment with the following changes: 1282 1 ) Change request for evidentiary hearing from five to seven days. 2 ) Revoke for a period of not less than 2 months nor more than 12 months, Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. 1 Resolution Adoption: A motion was made by Husen seconded by Schneider to adopt the resolution creating a policy for the enforcement of Ordinance #1980, the Housing Maintenance and Occupancy Ordinance as presented by Attorney Scherer, Ayes: Loso, Schneider, Reber, Husen, Nayes: None Motion carried, Rothfork Addition: Ed Merkling presented a preliminary plat of Rothfork Addition located on County Road #2 north of City limits. Merkling requested letter of intent that City would provide water and sewer service when a time of need arose, Council advised Merkling to have his attorney contact Assistant City Attorney John Scherer for preparation of document, A recess was called at 9:25 p,m, Meeting opened at 9:35 p,m. Tax Exempt Housing: The Council was advised by Attorney Scherer that it was legal for the College of st. Benedict to remove three single family dwellings from the tax rolls as the homes were used for student housing. The homes are located at: 222 Minnesota Street West, 24 Minnesota Street East and 306 Minnesota Street West, The City had sent a letter protesting the action by the College, The City Assessor will be notified that the removal of the parcels in question should be completed. Tax Levy: A motion was made by schneider seconded by Reber to approve the following I tax levy for 1985: Fund Levy on Taxable Value - Revenue 115,000.00 Street Maintenance 10,000.00 Lights 16,000,00 Recreation 19,000,00 160,000,00 1961 Sanitary Sewer 4,789.00 1965 Street Improvement 410,00 1971 Water System 8,300.00 1972 Water-Sewer 2,285,00 1974-A Street Improvement --- 1976 R,R. & College Ave, 1,420.00 17,204,00 Total 177,204,00 Ayes: Loso, Schneider, Reber, Husen, Nayes: None Motion carried. Election Judges Appointment: A motion was made by Reber seconded by Husen to I approve appointment of additional judges for election if necessary and available for the general election on November 6, 1984. Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. '1°80 _ Li 10 Waiver of Publication: A motion was made by Schneider seconded by Reber to waive publication of sample ballot for the November 6, 1984 election. Cities of the 4th class may post only. Area newspapers carry story of candidates and I other pertinent election information as news copy. Ayes: Loso, schneider, Reber, Husen. Nayes: None Motion carried. Police Vehicle Tires: A motion was made by Reber seconded by Husen to approve the purchase of four tires for the police vehicle at a cost of $211.88 balanced and mounted. (See request by Police Department dated September 27, 1984. ) Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. Petition Presented: A petition containing approximately 72 signatures was presented requesting the City of st. Joseph provide: 1) An adequate community shelter for use during severe weather. 2) A publicized civil Defense plan covering severe weather as well as defense. Most of the petitioners appear to be residents of the st. Joseph Mobile Home Court. A copy of a Minnesota Department of Health Notice will be sent to manager of the Mobile Home Court. The notice relates to a 1982 legislative amendment to statutes governing manufactured home parks that requires the provision of a storm shelter or the establishment of an excavation plan for use in times of severe weather conditions, such as tornadoes, high winds and floods. Facilities plan: Reportedly Engineer Bettendorf will deliver facilities plan addendum copies, updating original facilities plan of sanitary sewer project, the first part of next week. Council Reports: Husen: October 15, 1985 Orderly Annexation Joint Powers Agreement with st. Joseph Township will expire. Council should review boundaries, lot Slzes, etc. and meet with Township on this matter. Copies of agreement to be prepared for Council review in early 1985. Fire Chief Conference: A motion was made by Husen seconded by Reber to approve the fire chief's attendance at a fire conference in Hibbing, Minnesota on October 18-19-20~ 1984. Ayes: Loso, schneider, Reber, Husen. Nayes: None Motion carried. Council Minutes: A motion was made by Husen seconded by Reber to approve Council minutes of September 20, 1984 as presented. Ayes: Loso, Schneider, Reber, Husen. Nayes: None Motion carried. Adjournment: Moved by Reber seconded by Husen to adjourn at 10:30 p.m. Ayes: Loso, Schneider, Reber, Husen.
