The Village Clerk, Robert Johnson, was also present. *** *** *** Member Ballansch introduced the following resolution and moved its adoption: RESOLUTION CALLING A PUBLIC HEARING ON PROPCBED SEWER IMPROVEMENT NO. 1960 BE IT RESOLVED by the Village Council of the Village of St. Joseph, Minnesota, as follows: 1- This Council has heretofore caused à. study to he made by Richard Teague, consulting Engineer for the Village for the improvement of the sewer system of the Village, as described in the notice of hearing hereinafter set forth. Said Engineer has submitted a report as to the feasibility and estimated cost of said improvement, which report is now on file in the office of the Village Clerk, and b;as been and is hereby approved; and said proposed improvement is hereby designated anc}··shall be referred to in subsequent proceedings as Sewer Improvement No. 1960 . 2. This Council shall meet at the time and place specified in the form of notice herein contained for the purpose of holding a public hearing on said proposed improvement, and the Village Clerk is hereby authorized and directed to cause notice of the time, place andpurpose of said meeting to be published once a week for two consecutive weeks in the official newspaper of the Village, the first of such publications to be not less than ten days and the second not less than three days before the date of said hearing. 3· Said notice shall be in substantially the following· form: -- -1- ... [- NOTICE OF HEARING ON SEWER IMPROVEMENT NO. 1960 VILLAGE OF ST. JŒEPH, STEARNS COUNTY, MINNESOTA NOTICE IS HEREBY GIVEN that the Village Council of the Village of st. Joseph, Minnesota, will meet at the st. Joseph Parochial school in said Village on June 30, 1960, at 8:00 o I clock p.M., for the purpose of holding a public hearing on-a proposed improvment heretofore designated as "Seì.¡er Improvement No. 196d', consisting of the construction of a con- ventional sewage disposal plant and sewage collection system and appurtenances. The estimated cOßt of. said improvement:i.s $,3ÞO.-OOO.OQ, . . - .- t The ar.ea proposed to be assessed for said improvement includes all lots, tracts and parcels of land within the limits ,of the Village of St. Joseph except those parts of Lots 9 and 10, Auditorls Subdivision No.4 lying north of Trunk Highway No. 52. The Council proposes to proceed with reference to said improvement under the authority granted by Minnesota Statutes, Sections 429.011 to 429.111, inclusive. A report on the feasibility and estimated cost of said improvement has been prepared by Richard Teague, Consulting Engineer, and is now on file and open to public inspection in the office of the Village Clerk. All persons interested in said improvement may examine said report and may appear and be heard at the time and place above stated. BY ORDER OF THE VILLAGE COUNCIL ROBERT JOHNSON Village Clerk st. Upon such hearing, or any adjournment thereof, the Council shall consider the views of all persons interested and shall determine whether to proceed with said improvement under the provisions of Minnesota Statutes, Sections 429.011 to 429.111, inclusive. The motion for the adoption of the foregoing resolution was duly seconded by Member Donald Rau , and upon vote being taken thereon, ~he following members voted in favor thereof: Herman Schneider, Christ Pallansch, Donald Rau, and Robert Johnson and the following voted agnnst the same: none whereupon said resolution was declared duly passed and adopted. -2- JI"". JOSEPH MINNESOTA 14(9' MIl\TUTES OF THE VILLAGE COUNCIL MEETING HELD ON JUNE 9, 1960 The regular meeting of the village council of the village of St., I Joseph washeldon Thursday, lune 9, 1960.~ All members were present with the exception of Mayor Zwack who was hospitalized at the time of the meeting. The meeting was conducted by acting mayor, council~an Herman Schneider. A motion was made by Chris Pallansch and seconded by Herman Schneider to" accept minutesof the regular May meeting as read.~ Attorney John Knapp read the attorney general's opinion regarding the clerk's right to vote. This opinion, stating the clerk had a vote-, was placed on file. Don Rau wasappointed to fill the vacancy.on the council created by the resignation of 'Dave Pfannenstein., The vote vIas 2 to 1., ~ motion wasmade by Christ Pallansch and seconded by Herman Schneider to pay bills as presented. A motion was made by ~ Bob Johnson and seconded by Christ Pallansch to grant the follibwing building permits: NickZachowski _ residence in lot 9 of Park Terrace addition; Menzhuber - Walz, . bowling lanes; Al Staller, garage addition; Leander Roering _ basement residence. con't on page 150 ----- - -- -- --~- 150 The following stioulations were included in the deed on the 15 acre plant site property purchased from Max Meyer: 1) easement for road purpose' -~ road also to be used by village., I 2} grant flowage rights from plant across remaining property. ~) no assesment on plant ) village clean and maintain the out-flow from plant. A motion was made by Don Rau andseconded by Christ Pallansch direct- ing Mayor and clerk to issue a check to Max Meyer for the àeàcribed property for the sum of $5,000.000 Acting Mayor Herman Schneider stated that the Bill Reber Trailer house wasplaced on bids. Chief Borresch reported the Philippi dry well storm sewer had been cleaned. R. W. Teague, village engineer, informed council that the alley survey adjoining the Walz - Kierzek properties had begun. ~~. Teague describ~ ed the legal proceedures necessary to determine true measurements, and further stated that additional surveying would be necessary. Attorney John Knapp presented Christ Walz the alley property deed for examination. The deed was listed as having been recorded on Dec 11, 1957. ,q ..':.~f' A communication was read from the office of Ahles & Ahles and signed by Mrs Christine Philippi, registering a complaint regarding children molisting her property. ~ Chief Borresch stated he had contacted the parents of the children in. II vol ved.~ ...\ Mr. Leo Sadlo, planning commission representative, presented ~ report on future parking facilities. Mr. Jãdlo stated the village planning é consultant sugested utilizing alleys for fuilre parkinÌ' by removing old buildings. It vTaS also suggested the village provide adequate lighting to encourage parking in alley facilities. Mr. Sadlo also cited the problem of parking in the post office area. Amotion was made by Don Rauand seconded by Christ Pallansch to engage Chuck P~annenstein as Summer recreation director. Arran~e- ment~for an assistant to conduct the program for girls fobe completed with'Miss Ruth Pfannenstein within the following week. : ~ Engineer R. W. Teague presented his report on the sewage program. The complete report was placed on file. A~motion wasmade by Christ Pallansch and sec0nded by Don Rau to conduct a public hearing regarding the proposed sewage program on ~- June 30, 1960 in the auditorium of St. Joseph's Grade School. Engineer R. W. Teague gave a brief report on packaged or prefab plants and lift stations. He further stated his firm would continue their I study in the pre fab field. Thé council dedided an election regarding the sewage dispoaal program would be held if· such a request were made at the public hearing., Resolution calling a public hearing on proposed sewer improvemènt Na 1960 included in attached extract of minutes.
