JOSEPH IDNUTES OF REGULAR VILLAGE COUNCIL MEETING HELD ON 1rJEDNESDAY, APRIL 14, 1971 The Village Council of the Village of St. Joseph met in session on Wednesday, I April 1/;., 1971 at 7:30 p.m. v.ith the follmÙng members present: Mayor George Gustin; Councilmen, Herman Schneider, Roman Reber, John Schroeder and Bud Reber, treasurer Leo Sadlo; clerk Bob Johnson; attorney John Knapp. A public hearing scheduled for 7 :30 p.m., on assessments for Water System Improvement 1970, was opened by Mayor Gustin. Mayor Gustin read assessment hearing notice as published on Narch 18 & 25, 1971 in the Enterprise - Dispatch - . The Mayor then announced corrections or complaints qould be accepted from the floor: Question of water installation in saw mill area examined upon request by l1ax 11eyer - assessment considered too high (281.46) only assessed for area in village limits - approx 2 acres of usable land (approx. 2/Y' of assessment is deferred). Attorney John Knapp explained the area assessment method used. He Also explained was the approx 50% aplit of cost between special assessment and ad valorem tax. A number of objections to the area assessment method 1¡rere voiced. Several persons suggested the adoption of an assessment on a vnit basis. The council contended the great majority of tax payers favored the area method as being most equitable. Policy of proportionate assessment to nevrly annexed areas questioned. hook -up charges or special assessments will be made on annexed areas with the method and amounts to be determined after further council study. Pete Grieger presented question of equitable assessment on property not I acciescible at the present time. Council agreed to reexamine the Grieger situation. There being no further discussion pertaining to assessment hearing a motion was made by Herman Schneider seconded by John John Schoreder to adjourn at 8:30 p.m. A public hearing was opened by Mayor Gustin at 8:1.~5 p.m for vacation of the follovring street and alley: All of Lake Street lying between the east line of the north - south alley in Block 2 of Loso's 6th addition and also the vacation of the east - west alley in said block 2 of Losols 6th addition lying between the east line of San Francisco Street and the west line of the north - south alley in said Block 2. Plats were submitted by mvner Sal Schneider and examined by council and interested persons. There were no objections presented. A motion was made by John Schroeder seconded by Bud Reber to approve petition for vacation. Motion carried unanimously. Hearing was closed at 9:15 p.m. Regular \ouncil meeting was called to order at this time by lvIayor Gustin. A motion vms made by John Schoreder seGonded by Herman Schneider to table reading of minutes of previous meetings. Notion carried. Sal Scbneider presented question of garbage collection on private street. A motion was made by John Schroeder seconded by Roman Reber to approve I garbage collection on private street. Notion carried unanimously. 445 Question of storm sewer addition in Trailer c:ourt to be referred to en-Gineer for examination. Previous storm sewer assessment policy to the area also I to be examined. Sal Schneider also requested consideration of liquor licBnse application. O. C. Dierkhising presented plans for remodeling the former J. C. Crever residence and converting it into a 12 - bed unit lodging house. The question to be referred to planning commission for variance application procedure. Marvin Taufen - representing the St. Joseph baseball Joes presented requests for park repairs and maintenance needs. Requested erection of snow fence inoutfield. A motion was made by Bud Reber seconded by Herman Schneider to approve placement fof snow fencing for baseball season. A motion was made by John Schroeder seconded by Roman Reber to grant baseball team an on- sale mon - intoxicating liquor license for baseball season. Motion carried. Mr and Hrs. Delphin Horsch "lere present regarding request for beer license. Attorney John Knapp explained that granting of license would be a violation of Zoning Ordinance advised to return question to Planning Commission - a public hearing would be required for remIDval of a provision attached to a variance granted in 1966 prohibiting the sale of beer at the present location. Attorney Dan Eller representing Wally Honer, requested consideration of I annexation of approx 13.82 acres known as the former Wagner - Notch property east of the village End. ts.A preliminary plot "ms submitted for examination. Hr. Eller was instructed to submit a petition for annexation. Mayor Gustin announced a meeting scheduled for 14ay 15 with local business firms and a Small Business Administration representative. Engineers Don Carley and Bob Erickson of Milner Carley and Assn. were present and presented a report of vonstruction progFess on vlater S;vstem Imp. 1970 project. Necessary changes to meet State approval have been made reported by Don Carley. Completion between Sept 1 and 15 reported possi ble . Engineer Bob Erickson to be closely associated vilth project during balance of construction. Engineers reported treatment plant has a mercury seal in trickling filter operation and in most caseS mercury has disappeared in the amount of time elapsed EiÌ.nce start of operation. Engineers to examine condition and make required adjustments. Engineering fee schedule to be reexa~ined by Don Carlelf. :iYIr. Carley to obtain St. Cloud fee schedule relating to plant tests required by Pilillution Control. A motion v-ms made by Roman Reber seconded by Bud Reber to approve the follov-¡- ing fire department applications: Andy Bechtold age 33, ThonBs Nordang - I age 27 - Motion carried. A motion vias made by Roman Reber seconded by John Schroeder to approve the attendance at fire school of Leo Sadlo and Bill Lm·¡ell. Hotion carried. 446 Attendance at sevler operators school by John Kierzed vms approved on motion by Herman SChneider seconded by Bud Reber. Notion carried. I A motion was made by Herman Schneider seconded by Bud Reber to approve use of 3 or 1.> welfare workers out of the county office - insurance question to be examined. Notion carried. Lyle Greiger special assessment on Water System Imp No. 1970 was changed to a 2/3 deferred status due account reduced to $87.00 from $140.80 on motion by John Schroeder seconded by Herman Schneider. Hotion carried. Rec program salary schedule to be reexamined. Water rate increase to commercial properties to receive further study. A motion was made by John Schroeder seconded by Herman Schneider to appoint Leo Sadlo treasurer. Motion carried unanimously. Oath of office admin- istered to Leo Sadlo as treasurer. Village dump to start summer schedule. Lorentz to obtain lawn mower cost factors. A motion was made by Roman Reber seconded by Herrmn Schneider to adopt assessment role for Water System Improvement No. 1970. IvIotion carried. Engineer James Harlander N. lJ. Bell engineer, to be notified of complaints relating to the underground cable installation completed last fall. A motion was made by Roman Reber seconded by John Schroeder to approve I request of N. W. Bell to provide servic~e to Schneider Trailer Court area. ~otion carried. A motion vms made by Herman Schneider seconded by Roman Reber to pay bills as presented. Notion carried. On a motion by Roman Reber seconded by Herman Schneider on call police duty salary was increased from $12.50 to $20.00 per day. Voting for the motion: Roman Reber, Herrmn Schneider, John Schroeder; abstaining, Bud Reber.
