JOSEPH SPECIAL LIQUOR LICENSE SUSPENSION HEARING HELD ON AUG. 5, 1971 I The Village Council met for a special hearing at 7:30 p.m Thursday, August 5,1971. Members present WEre: Mayor George Gustin; Councilmen, Roman Reber, John Schroeder, Bud Reber; Clerk Bob Johnson and Attorney John Knapp. Absent: Council- man, Herman Schneider. Also present: Eric Dierkhising, licensee, La Playette Bar and Restaurant. Purpose of hearing: To hear evidence and testimony on suspension of liquor license due to violation of liquor ordinance No. 62; selling liquor to a minor. Nr. Dierkhising deseribed incident leading to violation and conviction. Nay 21, 1971 conviction involved two college girls who Mr. Dierkbising stated provided legal identification to him or his bartender, but submitted improper and illigal identification to arresting officer. The July 30, 1971 conviction, as described by Eric Dierkhising was a result of selD_ng to minor who was served while in the company of his father on numerous other occasions. Therefore, Mr. Dierkhising stated, selling to the manor in such a described case \Vas a common practice in St. Joseph. Mayor Gustin reminded Mr. Dierkhising of the liquor meeting held last fall in which all licensees were instructed and informed of village policy relating to violation and conviction. I Mr. Dirrkhising stated any suspension over 7 days would result in bankrupcy. A motion was made by Roman Reber to suspend license of Eric Dierkhising for a period of 7 days. Mayor Gustin vacated the chair to second the motion. Voting for the motion: Mayor Gustin, Roman Reber . Voting against motion: Bud Reber, John Schroeder. The motion was not passed. Council was split on length of suspension period - 7 days or 30 days. Mayor Gustin recownended question be tabled until next special meeting due to absence of one councilman. . A motion was made by Roman Reber seconded by John Schroeder to continue hearing at 7:30 p.m. on Monday, Aug. 9, 1971. Voting for motion: Roman Reber, John Schroeder. Voting against motion: Bud Reber. Hearing was adjourned at 8:25 p.m. on motion by Roman Reber seconded by John Schroeder. Motion passed. George G stin, Mayor ~~rk I ( ------._-- 459 VILLAGE OF ST. JOSEPH MINUTES OF REGULAR VILLAGE COUNCIL HEETING HELD ON AUGUST 5 , 1971 Regular council meeting was opened by Mayor Gustin on Aug. 5 at 8:30 pm follow - I ing the liquor license suspension hearing of Eric Dierkhising. .:--. ... Hike Ives - Westri~ge Mobile Home Court developer presented a request for a special use permit - Mayor Gustin cited planning consultant suggestions: as follows - requested developer revise preliminary plans for re-consideration for special use permit. Engineer - suggested contour plat extremely helpful but expensive. Entrance change cited by council as most important factor prior to issuance of Special Use permit. Questions of water under tracks - $4000 for casing estimate by engineer - possibly a larger casing for future. Village resident and planning commission member John Redmond questioned cost of utilities for mobile home court. Mr. Redmond also stated he believed 150 unit court too: large for size of villag~cited additional costs to village by large increase in population - mobile h e courts do not pay their way in a community - no industry forces additional costs to residents-were objections also cited by Redmond. / Ives - college town - dealing with students - facàl1.ty members need housing for mobile community - developer installs all utilities - no bonded indebtedness for utilities. Planning Commission recommended issuance of Special Use Permit for Westridge Hobile Home Court. I John Borresch present: reported sore ribs - not in condition to work at present - will return as caretaker when able. Frank Niebolt security head at College of St. Benedict requested agreement permitting Lorentz to aid outside village - on campus - police work. School street deðication - 66 ft wide to east village limits - reported by Knapp Amendment to zoning ordinance presented by attorney - $25 fee for reg. meeting pJ~s professional fees incurred added to ordinance. Towing car question - attorney to check Engineer Bob Ericson present: reported on construction project - Roof check - controls in - hooked up next week - tank repair in progress - gate valve in alley "~ to be checked out - doors due in next week - temporary closing of room housing controls - painting inside by firemen - outside to be sealed - floor sealer also needed - vents to be replaced - front block not changed - clean up on outside to be done - outside doors in next week - roof above chemical and bathroom to be poured concrete - finål check by next meeting. Blacktop alley and rear of ahll in conjunction with Salls and Lodermeier - grade shots for alley blacktop to be rmcle - (1.50 sq yd estimate) Estimate No 4 - $14,871.87 presented - 80% completion - I Leo Sadlo, tpeasurer submitted his report. Sunday Centennial requests: close ~linnesota St. from Sauer Store College Ave. to First Ave N.W. approved - 12 noon to midm_ght. 460 Council to examine Minnesota and 2nd St NW corner regards squaring corner. ·..rl ,I ,W\ VÙCivil Defense Aux. police program reported - 1 community (Paynesville) re- porting, 4 or 5 members present at meeting. Auxiliary police school to be held in St. Joseph for county - program being set up. Unit only 1 used when authorized by council outside of village for civil defense. List prepared - all members are being screened - 17 names on present list. . St. Bens Park land option maximum of 6 months reported. Roman Reber to draw up proposal for council members fees to attend out of town meetings. Traffic control signs requested by Chief Lorentz - black dirt at park shelter to be leveled by Rennie. ~.~ Cost of first aid/lr/4l4iiØ-/ii for Bill Lorentz and Bud Reber reported as $7.50 per person. Dick Taufen requested approval for purchase of 6 cases of dump pois~n at $22.00 per case approved. Taufen to try Netters in ~;Jaite Park for repair of plmv.
