SPECIAL LIQUOR LICENSE SUSPENSION ~Ĺ’ETING HELD ON AUGUST 9, 1971
I. The special liquor license suspension hearing of licensee, Eric Dierkhising, 7:30
pm on Monday, August 9, 1971 with the following members present; 1-1:ayor George
Gustin; Cpuncihfien, Herman Schneider, Roman Reber, John Schroeder, Bud Reber,
Clerk Bob Johnson, Attorney John Knapp, Police Chief Bill Lorentz.
Also present were: Eric Dierkhising, licensee.
Mayor Gustin re-opened hearing at 7:30 p.m. Minutes of earlier portion of
meeting were read by clerk.
Mayor stated hearing open for discussion.
Dierkhising requested councilman Schneider to present his reaction or position
in the case. Mr. Schneider asked what difference 7 days or 30 days would mean.
Dierkhising stated the difference meant about $9,000. Dierkhising described
severe impact 30 day suspension would have. Take several years to make up
dif.ference finnancially. Other suspension were for 1 day.
Hayor felt council at fault for not acting on May violation. Question of
verification of IvIay 21, 1971 conviction date. Lorentz does not have information
present.
Mr. Dierkhising asked council if there were any questions regards his operation -
to dispel rumors. Council gave Dierkhising several suggestions to improve
I operation.
Question of search vlarrant matter is covered by ordinance.
Council advised Dierkhising conduct of business was licensee's responsibility.
Motion nade by Ronan Reber seconded by Herman Schneider to suspend liquor
licens~of Eric Dierkhising for 7 days - voting for: Bud Reber, Rormn Reber,
John Schroeder, Her!P.an Schneider.
Motion made by Roman Reber seconded by Herman Schneider to set closing dates as
follows: Sat. Aug. 14 - 8 am. to Sat. Aug 21 - 8 a.m.
Motion passed unanimously.
Hearing adjourned at 8.p.m.
