JOSEPH < MINUTES OF HEARING AND REGULAR COUNCIL MEETING HOLD ON THURSDAY APRIL 5, 1973 The Village Council met for a public hearing and regular meeting on Thursday, I April 5, 1973 with the following members present: Mayor George Gustin, Council- m~~ Herman Schneider, Roman Reber, Bud Reber, Hugo Weyrensj Clerk Bob Johnson and. Attorney John Knapp. Mayor Gustin opened public hearing at 8 p.m. on vacation of Ohio street abutting alley - hearing set aside temporarily until appearance of Lee Rebescke petitioner is made. Dave Karn and Mr. and Mrs. Al Pfannenstein were present regarding Mobile Home Ordinance requirements. Requesting extension of termination required by ordin- ance - Dec. 31, 1973. Dave Karn indicated sister and brother in law owner. Dave Karn requested a 3 year extension of time for trailer removal. Council to consider matter further and notify thriler owners. Motion made by Herman Schneider seconded by Hugo Weyrens to approve final payment on 1970 Water System and Fire Hall project in the amount of %6500.00. Motion carried. Estimate No. 7 presented by engineer on 1972 Water and Sewer project. (Eastern Park Addn.). Presented report on project to date. Bob Pirkle requested leveling of lots - informed by engineer contractor would comply - problem of use of 6th Ave. - reported drop of 2 - 3 ft to Able Street - manhole extension above ground level pr.oblem cited. Trespassing problem by contrac- tor on Pirkle property cited. Engineer to notify contractor - county - Village I street surfacing project informàtion prelimiary approval needed soon from County Commissioners. ~ Ed Kremer and Albert Kuebelbeck were present regarding sewer problem. Review of costs and Kremer problem presented. Mr. Kremer presented his view points on the question. Albert Kuebelbeck reported problem in stub. Property owner has been liable from main to property since installation in 1961. ! 1 / Mr. Kremer informed:village liable for mains only. council~an Reber moved village pay Flexible Tool statement for sewer cleaning in t e amount of $66.50 - balance must be Mr. Kremer's liability. Motion was seconded by Bud Reber. Motion carried. No further determination on Albert Kuebelbeck case matter - matter considered closed. Joe Bettendorf, engineer presented final estimate on 1970 Water System and Fire Hall project - reported project completed. Final payment based on engineer report on condition of north wall to clerk prior to issuance of check in final payment. Engineer and Herman Schneider to attend next County Commissioners meeting on April 17, 1973. Roman Reber to contact Lavern Plantenberg. Engineer requested information on water users - 5 years - above normal users. Plant requirements on schedule with PCA. I Dick Taufen present: Alley problem cited at Lozy Walz resident - Tree removal request by Lorraine Jost from alley abutting rear of her property. .~- 522 Leo Sadlo presented treasurer report for March. Oheck of $1258.48 received from St. Joseph Park Fund signed by Reuben Wiener, chairman. Balance of park land cost , to be paid out of revenue sharing on motion by Bud Reber seconded by Hugo Weyrens. Attorney to complete transaction with St. Bens House rental (David I Winter) to past check to Village. Lee Rebischke arrived at 10:10 - Public hearing for Ohio Street and alley vaca- tion continued. Discussion held on amount of property to be acquired by Manor Enterprise Inc., Lee Rebeski, president. Publish variance for 8 plex multiple - Motion made by Hugo Weyrens seconded by Roman Reber to continue hearing on street vacation on May 10. A hearing for variance to construct an 8 - plex on Lot 1 and 2 Bk 2 Loso's 7 addn. and necessary acquired property to be held on May 7, 1973. . Motion made by Bud Reber seconded by Herman Schneider village enter into earnest money contract for $1700.00 on condition of approval of variance for construction of 8 plex as per petition - description to include 6 ft to east of center line of ~- Ohio Street. Motion carried. Hub Klein presented preliminary plat of Hollow Park (approx. 6 acres) abutting Park Terrace to north - plat received planning commission approval. Public hearing to be held May 10, 1973 at 8 p.m. Notice to property owners within 200 ft. Motion made by Hugo Weyrens seconded by Herman Schneider to approve public hearing on May 10, 1973 at 8 p.m. Motion carried. Broken water main at Park to be repaired. I Estimate of well treatmentpresented from Donabauer - $924. No. 1 Well - $1100. for No 2 Well. Motion made by Herman Schneider seconded by Bud Reber to approve well project. Motion carried. Letter to organizations in appreciation: Lions, Rod and Gun, Sno cloes, VFW, Beuben Wiener, John Schraeder for park fund contribution. Motion made by Hugo Weyrens seconded by Herman Schneider to approve acceptance of low estimate for ball park block construction. Bud Reber to obtain estimates. Motion carried. ~lanning Oommission report by Roman Reber - new officers - Ben Kremer, chairman, Gregory Felt, vice chairman, John Redmond, secretary. Commission examined prelim- inary plans on Creamery renovation to 8 or 12 pleNe Motion made by Hugo Weyrens seconded by Roman Reber to send letter to Robert Hoff- mann and William Loso remove junk cars and debrie. Motion carried. ,~ Roman Reber reconnended approval of building permit for O.O~ Dierkhising to con- struct a Dairy Queen Drive is approved on motion by Hugo Weyrens seconded by Bud Reber. Village cleanup,c day to be held April 28, 1973. Motion made by Herman Schneider seconded by Hugo Weyrens to pay bills as presented. I Motion carried.
