JOSEPH, MINNESOTA MINUTES OF REGULAR CITY COUNCIL MEETING HELD ON THRUSDAY, MARCH 6, 1975 The City Council of the City of St. Joseph met in regular session on Thursday, I March 6, 1975 with the following members present: Acting Mayor Herman Schneider, Councilmen, Bud Reber, Hugo Weyrens; Clerk Bob Johnson, Attorney John Knapp. Herman Schneider opened meeting at 7:15 p.m. Leo Sadlo presented the treasurer monthly fund report. Report was approved on a motion by Herman Schneider seconded by Hugo Weyrens. Motion carried. One bid, submitted by Howard Hornibrook, was received on the heavy duty street dept. tractor with loader. A motion was made by Hugo Weyrens seconded by Bud Reber to accept bid of Howard Hornibrook total price $8000 for tractor on specs presented - Motion carried. Buninessmen on agenda March 20 at 8 p.m. - employee wage negotiations at 9 p.m. March 20. Fire Chief Mike Loso present: Fire district proposal question - council directed attorney to contact Attorney Mike Sullivan, College-Convent, regards monetary contribution toward purchase of fire trucks on motion by Herman Schneider seconded by Bud Reber. Motion carried unanimously. Fire Chief request to block off street for street dance - 1st Ave N.W - alley north to Birch st. - council to study matter prior to dance scheduled in June - answer by regular April meeting. " Bill Lorentz explained police dept. equipment order from Uniforms Unlimited, Inc. I reported as general supplies. Bills were approved for payment on motion by Herman Schneider seconded by Hugo Weyrens. Motion carried unanimously 9596, 9597,9612,'9615 thru 9644,9653, 9661, 9663,9672 thru 9677,9680,9681,9683 thru 9686. Dale Mossey statement for city attorney assessment search (125.00) examined and discussed. Attorney Knapp indicated a total of 5 hours was spent on search. Council determined that any assessment search involving additional professional service would require notice of additional costs to person seeking information. The above policy relating to assessment search on related requests as an addition to the present change of $5.00 by the clerk's office for a ordinary search. Motion made by Bud Reber seconded by Hugo Weyrens for above motion to include payment of statement of Dale Mossey in question to be paid by city. Motion carried Áttorney Knapp presented letter from Township Attorney John Pattison regarding east end annexation petition protest. Copy on file. Petition of withdrawals also presented - removing names from the above petition. Informal meeting with Municipal Commission secretary Howard Kaibe1, Township officials, city council and residents of area in question set for March 26, 1975 at 8 p.m. Engineer Bettendorf presented an engineering report - crack in wastewater facility - I between digester and holding tank - requested materials suitable from several firms. Epoxy material recommended by engineer -above 550 temperature necessary. Step I Grant approved - prepare infiltration report and hearing - end of May schedule - R.R. crossing - county held meeting with property owners for acquistion of land - estimates are in 617 Hollow Park question - easement for sewer connection needed. Final specs complete " developer has clearance to proceed after deposit of indeminty bond. Planning Commission has had water and sewer specs. Restoration in writing on places, stated by Engineer Bettendorf. Easement expiration in Park Terrace Covenants to be further examined. A motion was made by Hugo Weyrens seconded by Bud Reber to approve engineering agreement proposal as presented by Milner W. Carley & Asso. for 1975. Motion carried unanimously. Engineer and attorney to examine sample excavation ordinance. Bad check processing policy question discussed. Knapp to obtain attorney general ruling on matter. Change of proposed liquor ordinance and Mrs. Donna Wiener removal of name from council ~enda were also discussed. Police logs on Midway Bar operation were submitted by Police Chief Lorentz - only bar open on Sunday after 12 midnite. Lorentz request change of non-intoxication law to clese at 12 mi:dnite on Sunday to conform with Sunday liquor closing. Council to further study matter. Police department internal matters were examined. A motion was made by Herman Schneider seconded by Steve Dehler to refer question of non-intoxicating liquor ordinance change to Police Advisory Commission. Motion carried. Public hearings scheduled for April 3 and April 24, 1975 at 8 p.m relating to Housing and Development Act of 1974 Community Block grant program. Don Kierzek, Police Advisory Commission chairman, presented a report on board meeting and interviews of police d~pt applicants - copy of board minutes placed on file. Letter on Gerald Werner ineligibility for patrolman position presented from Dale L. Hiemermann, regional head of Ceta program Dept. fo Manpower Services. Jeff Young, second choice, recommended for the position by Police Advisory Board. A motion was made by Steve Dehler seconded by Herman Schneider to approve the appointment of Jeff Young to the position of patrolman on thé "·C"eta VI program. Voting for the motion: Steve Dehler, Hugo Weyrens, Herman Schneider, Harry J. Kneve1; Bud Reber obstained for voting on the motion. Motion carried 4 - o. Patrolman Paul Ewald, Police Reservists John Kneve1 and Dan Meinz were administered the oath of office. Request for permission to conduct a St. Patricks Day Parade by college students on March 16, 1975 - use of city green giant truck, driven by city employee approved on a motion by Steve Dehler seconded by Hugo Weyrens. Motion carried unanimously. Phone communications with Sheriff Dept. report by Chief Lorentz - $95.00 hookup charge - $56.00 per month for answering service presented as cost factors. A motion was made by Bud Reber seconded by Hugo Weyrens to approve adoption of communication connection with the Stearns County Sheriff office. Motion carried. Request prêsented by Lorentz for attenance at Willmar Junior College Police s~hool on new criminal procedures, approved on a motion by Herman Schneider seconded by Hugo Weyrens - March 14 and 22 - tuition $19.00. Motion carried. 618 Metro Water Works School - March 31 Holiday Inn - Mpls attendance of Dick Taufen at Waterworks school approved on a motion by Bud Reber, seconded by Steve Dehler. Motion carried. School for Emergency Services Director fee $8.50 - Art Reber attendance approved on a motion by Hugo Weyrens seconded by Bud Reber. A motion was made by Bud Reber seconded by Hugo Weyrens to instruct clerk to notify Ceta office city \ñ1l accept 4 - 5 and supervisor on Ceta Title I program - Motion carried. Hall renovation final plans presented along w~ith estimated cost - hall renovation plans to receive further examination. Motion made by Bud Reber seconded by Hugo Weyrens to approve purchase of small fire resistant file unit for treasurer. Motion carried. Motion to adjourn was made at 1:05 a.m. Motion Harry J.
