MINUTES OF SPECIAL CITY COUNCIL MEETING HELD ON THURSDAY, AUGUST 28, 1975
The City Council of the City of St. Joseph met in special session on Thursday, August
28, 1975 at 8 p.m. with the following members present: Mayor Harry J. Knevel;
Councilmen, Herman Schneider, Bud Reber, Hugo Weyrens, Steve Dehler; Clerk Bob I
Johnson, Attorney John Knapp.
Town Board members present were: Chairman Norb Eikmeier; Supervisors, Fred Reber
Del Terwey, Clerk David Thralow and Attorney John Pattison. Also present were:
Howard Kaibel, Secretary, Public Service Commission; Don Landwehr, LeRoy Rebischke;
five res~dents from the east end.
Purpose of meeting: to resolve procedures and mutual agreement relating to orderly
annexation of properties to the City of St. Joseph.
Mayor Knevel opened meeting at 8 p.m. and introduced Secretary Howard Kaibel -
Attorney John Knapp presented the revised City proposal for orderly annexation.
Problem areas, present and anticipated problems reviewed by Attorney John Knapp.
Attorney Pattison questioned area total of 6 sections. Discussion of jurisdiction
of land development - in orderly annex areas. Adoption of master plan for area
necessary.
1) Planning - Zo~g
designate no property - take larger city area - put into Joint powers
agreement for zoning and planning - delØegaie authority to 5 man
committee - 2 town - 2 city - 1 neutral (county). 10 year agreement
to refer to 5 man committee limit role of committee to zoning changes to
4/5 vote.
Stillwater agreement: board of Appeals - Designation of councilor board I
members or other - choice under Joint powers act.
Question of Zone 1 designation (60% rule). In orderly could not be annexed
until developed - if city cannot provide services. City will not extend
water and sewer until majority petition.
Areas becoming urban and sufburban and can provide services. Agreeable to place
all of Zone 1 an~ ¡ 001\ -2" into the orderly annexation area of 1 - 5 years. City
or town not to initiate annexation in the 5 year period. 5 - 10 years on Zone 2
city cannot annex for 10 years unless property owner petitions.
Kaibel suggested trade-off on lot size - sewer and water lines extended in orderly
annexation area on basis of one unit basis per lot.
After agreement in effect - future building to be assessed full amount. 10,000
min sq ft. at unit basis eo% - 20% sq. ft. area assessment basis.
Sept 11 hearing to be postponed to first week in October. Council - Township
to meet agein on Sept 25 at 8 p.m.
Motion by Bud Reber seconded by Steve Dehler to approve purchase of curtains
for hall as per estimates and sample displayed.
Motion to adjourn by Herman Schneider seconded by Hugo Weyrens at 12:15 a.m. I
