Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in special session
on Wednesday, September 12, 2001 at 4:00 PM in the St. Joseph City Hall. I
Members Present: Mayor Larry Hosch. Councilors Cory Ehlert, Bob Loso, AI Rassier, Kyle Schneider.
Administrator/Clerk Judy Weyrens.
Others Present: Frank 1m holte, Robert Veline, Jeff Veline, Dan Marrin.
Hosch opened the meetin~ and stated the purpose of the meeting is to discuss the purchase of the
property located at 21 - 15 Avenue NW by Robert Veline. Hosch turned the meeting over to Auctioneer
Frank Imholte who assisted the City with the sale of the property. I

Imholte stated that the City and Veline had scheduled a closing on the property for August 27, 2001. I
Since the time the property was auctioned several issues have surfaced. The first major hurdle was the
lack of an abstract. Imholte ordered a new abstract and the abstract company prepared an abstract for
the wrong parcel. Once the right abstract was received, Veline requested that the property be surveyed.
Imholte stated that he agreed to order a survey and absorb the cost. When the survey came back it was
determined that the building encroaches the alley by 1.1 feet. I

Veline stated that the delay in closing has had a financial impact on him and he is requesting I
compensation. Veline stated that in his opinion the property was not ready for sale and he should not be
penalized. The delay has cost him two months rent and attorney's fees. In addition, he has had to I
provide temporary housing for the tenants he had signed leases with. Weyrens reminded Veline that
before a rental license is issued he must make application for a special use permit as the Ordinance I
requires a mix of business and rental in a general business zone. Veline responded that he was unaware
he needed to go through the process for a special use permit. I

The Council stated that when the property was listed on the Auction Bill it was stated that a Special Use
Permit would be required if a portion of the building was to be rented. Therefore, the Council did not feel
responsible for more than one month of rent. Veline stated that one month's rent would equate to $
600.00 and the additional attorney's fees he incurred was approximately $ 500.00
The Council agreed to conduct a public hearing for the possible vacation of the southerly 1.1 feet of the
east / west alley and Veline agreed to process the paperwork to obtain a special use permit for the
issuance of a rental license.
Loso made a motion to reduce the selling price of the property located at 21 _1st Avenue NW by $
1200.00, equivalent to one months rent and additional attorney's fees. The motion was seconded
by Rassier and passed unanimously.
Adiourn: The meeting was adjourned by consensus at 4:40 PM.
