Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in special sessiÞn
on May 22, 2002 at 7:00 PM in the St. Joseph City Hall. i , I

SE Utilitv Improvement Public Hearina: Mayor Hosch opened the public hearing at 7:00 PM and stated
the purpose of the hearing is to consider an utility improvement to an area between 88'h Avenue and 17'h
Avenue SE, south of Minnesota Street.

City Engineer Joe Bettendorf stated the proposed project includes the extension of water and sewer
services with construction in 2002. The proposed improvement includes:

Extension of a 12 inch water main east on Minnesota Street from 17'h Avenue' SE
to the south edge of the St. Joseph Business Park. An 8 inch water main will be
installed on Lynx Road, looping the main from 17'h Avenue to Minnesota StreEit.
A six inch water service will be provided to all lots. I I
Sewer Main A 10 inch sanitary sewer will be installed on Minnesota Street from the existing
manhole located at CSAH 75, with a eight inch sanitary Sewer being installed I
from Lynx Road to the east-west intersection of Minnesota Street. Further, an 8
inch sewer line will be installed to the south intersection of 17'h Avenue SE and
Lynx Road. Each lot will be provided a 6 inch sewer service.

The existing drainage problem at the Intersection of 16'h Avenue SE and Lynx I
Road will be repaired with the installation of a 15 inch storm sewer, 6 catch
basins and an outlet into the ditch on the north side of Lynx Road,

The roadbed would be reclaimed, excavated, stockpiled, and used as base fo(
the new asphalt that will be placed after the utilities are installed. !

Cost Estimate $ 602,014, Proposed Assessments $ 560,018., I
Gary Utsch of 216 - 17'h Avenue SE stated that he does not mind paying his fair share, but feels that as
the property owner of a corner lot he is over assessed for improvements, Utsch questioned if there arE!
grant funds available for assistance, ,
Bettendorf responded the City does provide some credit to property owners, but unfortunately
they are assessed for each project that is adjacent to their property. As far as grant funds,
Bettendorf stated he is unaware of any assistance,

Dan Pueringer of 16'h Avenue SE questioned the drainage problems on Lynx Road and if the catch I
basins are needed, He stated it is his opinion the water can run to the ditch if the road is raised. 'I'
Hosch responded it is the policy of the City to install curb and gutter when improvements are
completed and ditch drainage is as costly to construct as curb and gutter. Hosch stated he would
not be opposed to reviewing this situation as long as additional drainage problems are not caused
by the exclusion of the catch basins.
Tom Krebsbach representing K & L Properties questioned if the proposed improvements are designed
with enough capacity for the development of the 34 acres to the south of Lynx Road.

Bettendorf responded that the majority of the 34 acres can be serviced, but he would review the
matter and design a map illustrating what portion of the 34 acres can be serviced by the proposed
extension.
Joel Vogel of 16th Avenue SE questioned if the proposed project area is in the City limits.
Weyrens responded the City has received two petitions for annexation and if the project is to
move forward, additional petitions must be received and it will then be forwarded to the Township
for approval.
There being no one further to comment, Rassier made a motion to close the public hearing at 7:40
PM; seconded by Loso and passed unanimously.
Weyrens presented the Council with a letter from K & L properties stating their concerns with the
extension of the project. If the project moves forward, K & L is requesting a deferral of assessments of a
period of three to five years and agreement for future zoning of the 34 acres of land they own south of
Lynx Road.
Bettendorf stated that if the project does move forward, the City cost to the project is approximately $
80,000. He further stated that the project is being driven by the annexation r~quest of the Armory
Reserve. The Armory is proposing to construct a maintenance facility on property near the Del Win
Ballroom. While the facility will not require water and sewer they have requested such and have agreed
to pay the assessment at the completion of the project.
Weyrens stated that if the project moves forward, it will be added to the financing for the already
approved City projects. The property owners will be assessed with payments being equally divided over
15 years at an interest rate of six percent.
The Council requested the Engineer and Administrator I Clerk to contact the property owners with regard
to development agreements and report back to the City Council.
City Engineer Reports - 2002 Interior Street Improvement
Addition of 3" Avenue NW: Joe Bettendorf presented the Council with the proposed cost to reconstruct
3" Avenue NW. The estimated cost of the project is $ 26,000 with $13,000 being recouped through
assessments. The property owner, Tim Borresch, has also requested the Council consider the paving of
the east/west alley between 2" Avenue NW and 3" Avenue NW. The property owner has indicated that
the alley is used for ball games and it would be in the public's best interest to pave the same. Bettendorf
stated that if the alley were to be paved it would involve other property owners and could be difficult to
construct. Since the project has already been designed, Bettendorf recommended only adding 3'"
Avenue NW.
Tim Borresch spoke on his own behalf. Borresch stated that he owns all the property on both sides of 3'"
Avenue NW. He further stated that 3'" Avenue NW serves as an entrance to the ball diamond and
skating rink thereby seeing increased traffic. Therefore, he is recommending the Council pay 50% of the
improvement instead of the standard 40%. Hosch stated that the City cannolt change the assessment
policy for one property as all residents can argue that the road in front of their property has other uses.
Borresch questioned if the City will not reduce his assessment could he complete some of the work
himself thereby reducing the assessment. Bettendorf stated that he would not recommend doing such
as all the work needs to be scheduled in an orderly fashion. If the City allows residents to complete
portions of a project, the contractor cannot control the project. The Council was in general agreement to
add 3" Avenue NW to the 2002 Interior Street project with the understanding that it could be removed at
a later time.
2" Avenue NW Sidewalk: Bettendorf reported that the Council must make a decision if sidewalk will be
included in the 2002 Interior Street Improvement project. The Council has b,een requested to construct a

sidewalk from Minnesota Street West to Birch Street West. Bettendorf stated the topography of the west
side of 20d Avenue NW make it difficult to design a sidewalk. Bettendorf estimated the cost of the i
sidewalk to be $ 37,000. ! 1
Ehlert stated It is his opinion that the City should encourage residents to walk and provide a safe area .for
such. Therefore, he supports the construction of a sidewalk on 20d Avenue NW and questioned if it could
be constructed on the east side of the road. Ehlert and Hosch agreed to form a sub committee to discuss
the matter with the affected property owners and report back to the Council. With regard to the inclusion
in the 2002 project, the Council agreed to add this Item as a change order if it came to fruition. .
Adiourn: Ehlert made a motion to adjourn at 9:05 PM; seconded by Rassier and passed
