HomeMy WebLinkAbout2015 [04] Apr 02 April 2, 2015 Page 1 of 2 Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular session on Monday, April 2, 2015 at 6:00 PM in the St. Joseph City Hall opening with the Pledge of Allegiance. Members Present: Chair Rick Schultz, Commissioners, Ross Rieke, Steve Olson, Matt Johnson, Daryl Schaefer, Gina Dullinger, City Administrator Judy Weyrens. Others Present: Molly Walz, Tom Kiein, Bob Loso Approval of the Aqenda: Rieke made a motion to approve the agenda. The motion was seconded by Schultz and passed unanimously by those present. Approval of the Minutes: Olson made a motion to approve the minutes of March 5, 2015.The motion was seconded by Dullinger and passed unanimously by those present. Public Hearinq, IUP, Michael & Florence Loso: Chair Schultz opened the public hearing at which time Weyrens stated the purpose of the hearing is to consider an Interim Use Permit to allow a non-owner occupied rental at 26 Birch Street West to Michael and Florence Loso. St. Joseph Code of Ordinances 52.31 subd. 13 (a) allows for an Interim User permit as follows: Residential units in areas that have been rezoned to commercial from residential shall be allowed an interim use permit as a rental for a specific period of time. The maximum density for rental units under the interim use permit shall be limited to the density which is allowed in the R-1, Single Family Residential District. As no one present wished to speak, Schultz closed the public hearing. Weyrens stated the ordinance allows for a three year renewable every year issuance. Each year the property will be looked at to see if iYs still in transition. The permit can be renewed after three years through a new public hearing. Rieke moved to recommend the City Council accept the Findings of Fact, issuing an Interim Use Permit to Michael and Florence Loso allowing a non-owner occupied rental at 26 Birch Street West.The motion was seconded by Schultz and passed unanimously by those present. Council Liaison Report: Schultz stated the demolition of the home across from City Hall for the Bayou Blues project was completed this week. • At the Monday Council meeting, both the facility and aquatics committee will be presenting their reports. Additionally, information will be shared on what needs to be done to the current City Hall to keep it in good working conditions. • Discussions have been had with developers regarding north side lots. The details are still being worked out. • Staff met with Metro Transit and CSB regarding developing a plan for dedicated routes to St. Joseph. The meeting was to discuss the wants and needs of residents and students. The plan would be to have the agreement similar to what it is at St. Cloud State University. Another meeting will be had and will include the Monastery. Rieke asked if the update to the Comprehensive Plan update would be similar to the last update. Weyrens stated that the process will be more in depth as significant growth will be seen. The process will take close to a year. Public Hearing, IUP, Mollv Walz: Chair Schultz opened the public hearing at which time Weyrens stated the purpose of the hearing is to consider an Interim Use Permit to allow an owner occupied rental at 216 — 17th Ave SE to Molly Walz. St. Joseph Code of Ordinances 52.27 subd. 5(a) allows for an Interim Use Permit as follows: Residential Rental provided the unit is owner-occupied and provided the room(s) rented does not contain separate kitchen facilities and is not intended for use as an independent residence. The owners may not exceed two in number. For purpose of determining ownership, the April 2, 2015 Page 2 of 2 owner/owners must provide a copy of a recorder deed or recorded contract for deed. A purchase agreement will not be accepted as evidence of ownership. Molly Wa/z, 216– 17�h Ave SE: Walz approached the Commission as the owner of the property. Walz explained that she would be renting out a room in the home while she is enrolled in school. Walz added that she is hoping to take off some of the financial burden as she will no longer be able to work full time. As no one else present wished to speak, Schultz closed the public comments portion. Olson stated the way the application filled out, it implied that the home would be non—owner occupied. Olson asked if the owner would be living at the residence. Walz stated she will be living up in Duluth Monday thru Friday with her Grandma, but will be keeping the St. Joseph home as her primary residence. Dullinger asked who would be responsible for any maintenance items or issues that may occur with the home. Walz stated it would be her responsibility. Weyrens stated the Ordinance requires someone to live within 40 minutes of the home and asked the applicant if there is someone living within that range of the home. Waiz stated her father lives on County Road 4 just outside of St. Joseph and would be her representative if she is unabie to make it back to the home immediately. Dullinger and Olson stated they are both hesitant on the owner-occupied piece of the permit as the applicant will be away from the home the majority of the time. Olson moved to recommend the City Council accept the Findings of Fact, issuing an Interim Use Permit to Molly Walz allowing an owner occupied rental at 216– 17'" Ave SE.The motion was seconded by Rieke and passed unanimously by those present. Discussion: Schultz asked if there would be any other way to go about getting the Interim Use Permit. Weyrens stated if the applicant put the home up for sale, after 90 days of being up for sale, she could apply for a non-owner occupied interim use permit. Rieke believes the application is a good use of what the Ordinance allows. Ad�journ: As the agenda had been completed, Schultz adjourned the meeting at 6:20 PM. dy Wey��ns Admi istrator
