HomeMy WebLinkAbout04b Minutes Joint January 12, 2016 12 Page of Pursuant to due call and notice thereof the St. Joseph Township Board and City of St. Joseph met in special session on Tuesday, January 12, 2016 at 7:15 PM in the St. Joseph City Hall. City Council Members Present: Mayor Rick Schultz. Councilors Bob Loso, Matt Killam, Renee Symanietz St. Joseph Township Board Members Present: Chair Jeff Janssen, Supervisors Jerome Salzer and Brenda Stanger. Township Deputy Clerk Anne Meyer Others Present: Ann Reischl, Michael Koltes, Hal Undersander, Ralph Eiynck, Mike Thompson Rezoning, Hul’s Property: Janssen stated a recommendation for approval of a rezoning request has been received from the Joint Planning Board. The request is to rezone the property located at 30890 County Rd 2 from agricultural to commercial. St. Joseph Township Action: Janssen made a motion accepting the recommendation of the Joint Planning Board, approving the request for rezoning of the property located at 30890 County Road 2 from agricultural to commercial and adopting the findings of fact as approved by the Joint Planning Board. The motion was seconded by Salzer and passed unanimously by those present. 1. The property owner is proposing to use the property in the same manner, trucking repair/service, as the previous property owner. Had the property continued to be occupied the use would have been allowed to continue as a nonconforming use. 2. The subject parcel is located in Planning District 12 in the City of St. Joseph Comprehensive Plan, which guides this property in the future for commercial, to include high aesthetic requirements. 3. Rezoning the property alone does not bring the property into conformance with applicable zoning regulations. The property owner is required to make application for a Conditional Use within 30 days of this action. Approval of Minutes: The motion was seconded by Salzer and passed unanimously by those present. Lelou Agreement: Weyrens reported that she has been working with the Attorney and Matt Lelou th regarding his driveway that enters 320 Street. The Developers Agreement for Sunset Ridge does not th allow for access to 320 Ave and it was missed when the site permit was issued. The current driveway is th not only located on 320 Street, but in the street easement for the future east/west corridor. In an effort to provide the property owner time to relocate the drive, a proposed agreement was drafted. The January 12, 2016 22 Page of agreement does not require the owner to move the driveway today, but if and when the road is built, the driveway will need to be moved at that time. Weyrens had met with the property owner who was not comfortable committing the driveway to Cedar Court. After speaking with the Attorney, three options were provided: 1) require the driveway be moved immediately; 2) delay the relocation of the driveway until the east/west road is developed and make the property owner move the driveway to Cedar Court at that time; or 3) delay the relocation of the driveway until the east/west road is developed and reconsider where the new driveway should be located. General consensus was to go with the third option, allowing the driveway to remain and working with the property owner when the time comes that the driveway will need to be relocated. Salzer questioned what would happen if the owner sold the property. Weyrens stated the document would be recorded and attached with the property. Recording the document will protect the City, Township, and property owner. Schultz made a motion authorizing the approval and execution of the agreement regarding relocation of driveway encroaching on recorded roadway easement on lot 1, block 1, Sunset Ridge. The motion was seconded by Loso and passed unanimously by those present. Rezoning Consideration: Weyrens stated that when preparing the meeting material for the Huls rezoning, it was discovered that the northwest portion of the Orderly Annexation Area had not been rezoned to Urban Expansion as was the intent. In 2011 is was determined that Stearns County did not have the correct Orderly Annexation Area designated, missing the northwest section. A hearing should have been held at that time, but it was never scheduled. Therefore, in discussing the matter with staff at Stearns County Environmental Services, they requested the Board consider conducting the public hearing to rezone the undeveloped property. If it is decided to not move forward, the property will be left zoned as A40. Loso made a motion authorizing the public hearing to consider the rezoning of the area north of CR 75 from A40 to Urban Expansion. The motion was seconded by Salzer and passed unanimously by those present. Loso made a motion to adjourn the meeting. Motion was seconded by Killam and passed Adjourn: unanimously by those present.
