JOSEPH ECONOMIC DEVELOPMENT AUTHORITY Meeting Minutes - Wednesday, August 20, 2003 Present: EDA Board Members Mike Deutz, Tom Skahen, Bruce Gohman and Larry Hosch. Absent: EDA Member Ross Rieke Also present: Joe Prom, Joanne Foust of Municipal Development Group and City Attorney Tom Javonovich (4:32 p.m.). President Deutz called the regular meeting of the St. Joseph EDA to order at 4: 10 p.m. Agenda. Moved by Gohman seconded by Skahen to approve the agenda, with Minutes from the July 30, 2003 Special EDA meeting moved after the discussion relating to the pay request for the Maintenance Facility. Motion carried 4-0. Minutes. Moved by Hosch seconded by Skahen to approve the minutes from the regular EDA meeting held July 16, 2003. Motion carried 4-0. Moved by Gohman seconded by Skahen to approve the minutes of the August 6, 2003 special EDA meeting as presented. Motion carried 3-1-0, with Hosch abstaining. EDA Accounts Payable. . Foust provided an overview of accounts payable including the MDG contract for July in the amount of $1,848.55. Additional invoices for $750.00 to MDG Inc. for annual TIF Reports and $8,445.97 for the first one-half of 2003 TIF payment to Borgert Products/SKN Properties were also discussed. EDA members discussed detail provided for MDG Inc. invoices. Foust noted that supplemental information is submitted with the original invoice to City Administrator Weyrens and is on file. EDA members concurred it would not be necessary to include that additional information in EDA packets. Mayor Hosch noted the City is considering assigning minutes to clerical staff in the future. Moved by Gohman seconded by Skahen to approve the EDA August Accounts Payable in the amount of $11,044.52 as presented. Motion carried 4-0. Three invoices relating to the Maintenance Facility were also presented to the EDA for consideration including: $787.00 to Outsource Management Services for Construction Administration; $2,205.00 to Shingobee Builders, Inc. for Payment NO.2 and $183,114.00 to Shingobee Builders, Inc. for Payment No. 5. Foust noted the $183,144 in Payment NO.5 signifies 99% project completion. The pay request illustrates a 10% retainage for final project completion or approximately $47,000. Items noted by the EDA at the special July 30,2003 meeting were reviewed. Deutz questioned UBC requirements for ceilings to be fire rated in maintenance facilities, if a portion of the building is being used for a shop. It was noted that the "eye wash" is not a Uniform Building Code requirement, but may be an OSHA requirement. An "eye wash" was not specified on the building plans. A couple of other items which are in the process of being corrected include the grading behind the building and the curb level. City Attorney Tom Javonovich reported that during a City Department Head meeting earlier in the day, it was suggested that the EDA appoint two representatives to conduct a walk through of the Maintenance - Facility with Joe Bettendorf, City Engineer, Nancy Scott - City Bldg Inspector and Jim Marthaler - Public Works. The purpose of the walk through would be to itemize a list of items remaining to be completed, - EDA Minutes - August 20, 2003 Page 1 ;< . . determine the percent of the project which is actually complete, the estimated cost to complete remaining items and determine the appropriate payment to Outsource Management Services for Construction Administration and Shingobee Builders, Inc. for construction. Javonovich noted that the EDAlCity may withhold full payment if the architect finds the work has not been done or has been done incorrectly. Moved by Hosch, seconded by Gohman to approve payment to Outsource Management Services for Construction Administration and Shingobee Builders, Inc. for construction in the amount determined appropriate by City Engineer Joe Bettendorf, Building Inspector Nancy Scott, City Public Works Member Jim Marthaler, City Administrator Judy Weyrens and EDA Members Mike Deutz and Bruce Gohman, following a review of the building and site on Thursday, August 21, 2003. Motion carried 4-0. Moved by Hosch seconded by Skahen to approve the minutes of the special July 30, 2003 EDA meeting with a notation that Gohman was not present at the meeting. Motion carried 4-0. Financial Report Foust provided a brief overview of the financial report, noting the EDA has received the first half of 2003 of the transfer of funds from the city for 2003. Moved by Gohman, seconded by Skahen to approve the EDA August Financial Report. Motion carried 4- o. High Speed Data Line. Gohman reported that he had contacted U.S. Cable regarding high speed data service. He noted that they are providing service to the new Knight Builders facility in Indian Hills Park. He noted Astound has service 300 feet from Gohman Construction, but has indicated they are unable to provide service. Foust noted that MDG, Inc. has contacted a number of providers to discuss the feasibility of extending . service to the business areas on the northeast side of the community. A report was included in the EDA packet. It was the consensus of the EDA to continue to work with service providers to review options. City Attorney Tom Javonovich suggested the EDA contact Mert Auger, City Clerk/Treasurer with the City of Buffalo, who recently extended city cable service and is selling service to businesses. EDA Members directed MDG, Inc. to investigate this option and check on the use of MN Community Capital Funds to assist in financing a municipal or EDA cable service and include this item on the September EDA agenda. Industrial Park Development. Foust reported that the EDA, as a part of the Comprehensive Plan, has identified a need to begin exploring options for a future industrial park. She noted past and current industrial land absorption rates and noted areas identified by the comprehensive plan for future industrial land use. Foust also reported on a new grant program available through the MN Department of Employment and Economic Development (DEED, formerly DTED) which will fund up to 50% of infrastructure costs for new industrial parks located outside of the seven county metropolitan area. The $7.5 million dollar fund program information was distributed. Mr. Joe Prom introduced himself to the EDA. He noted he was present at the meeting as he is one of the representatives of land, which is in the area identified for a future industrial park, which has been in an estate since the 1950s. He noted they may be interested in selling land in the next couple of years. He added that he feels a portion of the land, due to topography, may be more conducive for residential development, with a portion appropriate for industrial development. Foust explained the need for a Comprehensive Plan amendment in order to re-designate the land use. Hosch suggested the EDA begin the procedure of investigating a future industrial park now, He noted it is likely to be a lengthy process. . EDA Minutes - August 20, 2003 Page 2 3 . It was the consensus of the EDA to direct MDG, Inc. to begin exploring the options for the development of a future industrial park including how the land would tie in with the future east-west corridor identified on the APO's map, funding options, land options, etc. Deutz indicated that he and Foust had discussed a couple of inquiries MDG, Inc. had received regarding the industrial park that he and three other partners are developing in the township, northeast of St. Joseph city limits. Foust noted that a couple of individuals inquired if Deutz would have a conflict-of- interest either working on a new industrial park or by having access to business leads as a member of the EDA. Deutz indicated that he had no intention of using contacts for his personal benefit, as he receives the Prospect List/Activity Report with business codes rather than business names and numbers, like other EDA members and the public. City Attorney Javonovich noted that there are two types of conflict-of-interest, "official" and "general". He noted there is not an official conflict-of-interest as the EDA/City does not have a contract with Deutz or his business which would provide direct or indirect financial benefit to him. He noted that with perception of conflict-of-interest, he would need to conduct further research on case study to determine if there is a general conflict-of-interest. EDA members expressed their support for Deutz as an EDA member and the expertise he brings to the board. They also discussed any liability to Deutz and/or the EDA and method of handling the perception of conflict-of-interest by parties. City Attorney Javonovich noted that at the Mayor's request he could prepare an official option and outline options. The EDA took no formal action on this. Foust asked the Board for direction on handling business inquires which request a one or two acre parcel of industrial land, if there is no land within the corporate limits which meets the businesses' needs. EDA members concurred that land within the city limits should be explored first. If no sites are available, the business should be referred to the Partnership. . Prospect List/Activity Report. A report outlining communication with various contacts was included in the EDA's packet. Foust noted additional information on the contacts is available to EDA members upon request. Director's Report. Foust reported the City Council would be reviewing a new fee schedule for water and sewer access charges (WAC and SAC) at their September 4,2003 meeting. The proposed fee schedule is similar to the schedule used by metropolitan communities and supported by the Met Council. It is intended to be more equitable with charges being higher for higher water and sewer users and lower for residents and businesses with lower usages. Board Member Reports. There were no Board Member Reports. Adjournment Moved by Skahen seconded by Deutz to adjourn. All present voted in favor of adjournment, the EDA meeting adjourned at 6:15 p.m. . Larry J. Hosch Change Order Request: COUNCILORS The EDAlCouncil have received Change Order Request #14 in regard to the facility. A copy Alan Rassier of the change order is attached for your information. Change order 14 details: Ross Rieke 1. A CREDIT ($2,625.00) to the City for thirty (30) loads of fill removed from the Gary Utsch site; and, Dale Wick 2. Delivering an additional four (4) loads of Class 2 fill to the site at a COST of $620.00 3. For a CREDIT balance to the City of $2,005.00. Building Ownership: . A final walk-though of the Maintenance Facility by EDA and City Council representatives has been completed. A list of items identified during the walkthroughs have, according to Dean Wick been completed per the requirements in the agreement with the contractor. Additional information is attached. It is noted City Administrator Weyrens has requested the City Engineer review the outside grading to ensure final grading is acceptable. Additional information will be presented at the EDA meeting. The City requests formal action by the EDA relative to building possession and enjoyment of the property by the Lessee (City) per Section 3.5 of the lease agreement entered into by the EDA and the City earlier this year. . EDA Action: A MOTION is in order to approve Change Order #14 to receive a credit of $2,005.00. Continue to work with Astound to determine another less costly approach to Alan Rassier servicing the business areas which are currently not served; and Ross Rieke Gary Utsch 2. Contact the City of Buffalo regarding a municipal fiber optic utility- Buffalo Wireless Dale Wick Internet Group (BWIG) which was established a couple of years ago. Astound: MDG spoke to an Astound' representatives on September 3, 2003 requesting any updates. They noted they are testing another system and hope to have information regarding another · option to the EDA soon. MDG followed up by leaving a message for the Astound representative on September 10, 2003. A verbal update is expected to be available for the meeting on the 17th. Qwest: MDG spoke with an engineer at the St. Cloud Qwest office regarding phone service to Buettner Business Park. MDG was directed to speak with another St. Cloud based Qwest engineer. MDG spoke with Qwest Engineer Doug Isaacson regarding high speed access through Qwest's network. Mr. Isaacson has indicated he left several messages with other department heads regarding high speed service for all industrial areas including those adjacent to 19th Avenue, the Buettner Business Park and those adjacent to Elm Street, including Borgert Products. Mr. Isaacson expects additional information within the next day and will provide it to MDG for a verbal report at the September 17th EDA meeting. Mr. Isaacson offered to address the EDA, interested business owners and/or both at anytime. Municipal fiber optic utility: Information relating to Buffalo Wireless Internet Group (BWIG) was also obtained from their web site: www.bwig.net. The City of Buffalo serves approximately 585 customers including commercial, industrial, medical and government users. Their system has 336 fibers, 38,604 feet of conduit. The City uses 'WaveRider" a wireless modem which can operate at raw data rates of up to 2.75 megabytes per second and access speeds up to 1 megabyte per second. The system may be networked with other computers in a home or business. BWIG offers various classes of services which range from $15.99 per month for basic 128K residential internet service, $29.99 for "silver" class 256K of residential and $39.99 for Gold 384K business service. The cost for customers is included on their city utility bill. The city has local support technicians to assist customers. The city also requires an Internet Services · Access Agreement, which includes a $550 for the modem and access to the internet, to be paid in equal monthly installments of $10 per month. /5 . The City of Buffalo indicated the service has been offered for approximately 2 years. The City Administrator, Merton Auger, noted that at the time they investigated providing their own service they did not have high speed internet service available in the city. Neither Quest or Charter would serve the community. The City already had an electrical utility, which they felt was beneficial but not essential. The process is much more detailed, but in summary the City: 1. Organized as a service provider with the MN Public Utilities Commission (PUC) 2. Investigated various options including line-of-sight, non-line-of-sight and wireless (also is non-line-of-sight) and considered which would be the least expensive long term for repair, etc. 3. The City determined a wireless option was the best solution for their needs and sent out a Request for Services with bids taken. 4. The City completed a Radio Frequency Study to make sure all areas could be served. 5. The City sent out a Request for Services for modems and the implementation. There project was close to $1 million with seven towers. There are now small packages available for $8,500. During the brief discussion, Mr. Auger thought the EDAlCity may be able to serve a small area at an initial project cost of around $20,000. The City of Buffalo has a business plan for the fiber optic utility with a goal of 600 customers by the end of 2003. As noted they are now at 585. Their break-even point was 400 customers. The City has one service tech and noted it would be required to have at least one part time person for I.P. set up. Mr. Auger noted the customer and Council are very pleased with the utility and its reliability. He invited EDA members to tour and discuss the utility if more information is desired. . Attached is supplemental data on the Buffalo wireless service for EDA members' information. Additional Information: MDG contacted a representative from Minnesota Technology regarding alternative methods of obtaining high speed access to the internet and/or granUfunding assistance relative to installation of plant. Mn. Technology noted four options available depending on providers within community (i.e. T-1 lines, broadband, wireless and dsl) and that occasionally communities do opt to establish third party connections to services. The Mn. Technology representative (offices in Waite Park and lives in Foley) indicates community utility is very expensive and often not very effective. Mn. Technology representative suggested contacting the Mn. Department of Administration, Office of Technology and the Initiative Foundation regarding possible programs providing grants to assist with plant installation costs. MDG contacted the Initiative Foundation and the Minnesota Office of Technology regarding resources for providing high speed access and grant/funding options for installing plant. The Initiative Foundation indicated several regional entities have been established to address similar issues including, but not limited to: wesmn.net, tntswmn.com and pcnetplan.com. A brief review of these websites indicates abundant research on how to best provide access to technology in rural portions of the state. The Initiative Foundation also suggested the MDG contact the Blandin Foundation regarding possible grant opportunities available to assist with the installation of high speed data plant. MDG contacted a Blandin Foundation representative who has indicated grant assistance may be available. Further information is available upon request. MDG also contacted the Minnesota Department of Administration's Office of Technology via email to request additional information. . Hosch development of a future industrial park. On August 27, 2003 Foust and Strack met with three representatives of the estate for the Feld property. Items discussed included the COUNCILORS comprehensive plan and guided land uses for the approximate 320 acres they currently own, Alan Rassier market values and tax classes for residential and industrial properties, industrial and residential Ross Rieke land prices, their thoughts on development and the Department of Employment and Economic Gary Utsch Development's Business Development Infrastructure Program. MDG staff walked the property Dale Wick with the owners. Land Suitability: The St. Joseph Comprehensive Plan guides a significant portion of the northeastern quadrant of the City's joint annexation area toward future industrial expansion. Upon walking the property it appears the land immediately east of the current industrial park is . suitable for industrial development. The land farther to the north; however, contains a number of large trees, wetlands and has a rolling topography which may be more conducive to residential development. Development of the Land: Joe Prom is the contact for the estate. Those involved in the meeting on August 2ih indicated they would like all land developed or sold at one time versus a piecemeal projecUsale. They have not determined if they would like to be involved with the platting and development of the land or sell the land to a developer to coordinate the process. A meeting with all parties to the trust will be convened on September 2ih. Additional information is expected following the meeting. Funding: The Department of Employment and Economic Development released additional information on their "Business Development Infrastructure Program" the first week of September. Enclosed is additional information. MDG has left a message for DEED representatives regarding the processing and prioritization of funding requests. MDG has been keeping in touch with the project contact over the past two years, the latest communication occurred on August 20th when a letter was mailed. . Project 01-F: This company has been in contact with the EDA regarding potential sites for a commercial business since August, 2001. MDG has forwarded the contact information on a number of sites, including the latest follow-up on September 3, 2003. Project 01-J: This developer owns a commercial subdivision in St. Joseph and has constructed a commercial building. MDG has been working with the developer and has forwarded potential business leads. Contact with the developer was made on August, 15th, 20th and 2ih. MDG spoke to a company considering land in this subdivision on September 3, 2003. Project 01-N: This company has been searching for commercial lots for the construction of an office building since the fall of 2001. Contact with this developer occurred on August 20th, 25th, 26th and September 3' 2003. The company phoned MDG on September 8th indicating their intent to enter a purchase agreement for a lot in the Indian Hill plat. The contact had reviewed the site with the City Engineer and reported the purchase agreement would be signed on either the 8th or the 9th. On the 10th MDG forwarded information regarding applicable zoning standards along with an application for planning consideration and a list of materials to be submitted in conjunction with the request for development plan approval. Project 02-E: This company is looking for approximately 1 acre of land for an industrial use for an expansion possibly in 2004. MDG last followed up with the company representative on September 3, 2003. Project 02-L: - This company filed plans to construct a 32,000 square foot multi-tenant building in St. Joseph business park. A portion of the facility is available for lease. MDG followed up with the company on - August 13th and sent a flyer on the building to a potential tenant on September 3, 2003, The company has recently retained a commercial realtor to assist as well. They have noted their plans for an expansion are one to two years away. MDG most recently followed up with the company on September 3, 2003. Project 03-A: These developers are interested in a large highway commercial development in an area not yet annexed into the City. MDG has been working with them over the past several months. Follow-up and correspondence most recently occurred on August 1ih, 20th and 25th and September 3,2003. Project 03-1: This contact phoned the City last spring regarding 5,000 s.f. of retail lease space. MDG most recently followed-up with this contact on September 10th with the mailing of a letter and flyer regarding an available commercial property. Project 03-L: This contact initially contacted the city in May, 2003 regarding lots in Buettner Business Park. MDG most recently August 8th when the contact indicated he was probably one to one and a half years away from proceeding with a project and that he did not wish to have information released to the park realtor. Project 03-M: This company contacted the city in May, 2003 regarding commercial space. In July they noted they thought they had secured a building in St. Cloud. MDG left a message for them on August 27,2003 to follow-up. Project 03-0: This company purchased a business with a large amount of acreage in 2003. They are currently investigating subdividing a portion of the lot to create additional commercial lots. MDG spoke to the company, city engineer and a business interested in possibly purchasing a lot on August 26, 2003. Project 03-P: This company contacted the city on July 9th regarding 8.0+ acre sites in industrial zoned areas. MDG - forwarded information on Buettner Business Park and financial programs, at their request. MDG - followed up on August 6th. Project 03-R: Inquiry forwarded to MDG on August 20th, contact with developer indicates a desire for a small industrial parcel with outdoor storage availability. MDG gave him the industrial park realtor's name and phone number and followed up on August 2ih and September 3,2003. Other: The MDG consultants Foust and Strack met with three members of the Feld Property estate and had preliminary discussions regarding the future development of the 320 acres. MDG followed up with Astound Broadband and Qwest regarding installation of high speed data lines within the industrial park, sent follow-up letters to businesses and contacted the City of Buffalo re: a municipal fiber optic utility. Additional information regarding access to high speed internet was obtained from Minnesota Technology, the Initiative Foundation, the Minnesota Office of Telecommunication, the Blandin Foundation and several regional organizations . .
