BACKGROUND INFORMATION: On December 12, 2012 the Joint Planning Board executed the
Development Agreement for the Sunset Ridge Addition. Sunset Ridge provided for 12 large lot single
family lots. As per the OAA MOU, single family large lots developments are required to include ghost
platting. The ghost platting indicates additional lots that can be created when the City provides water and
sewer to rural areas served by well and septic. When property is ghost platted, buildings and
encroachments cannot be located within the future lot. The developer's agreement for Sunset Ridge
included an exhibit illustrating the future lots.
Joe & Lori Baggenstoss purchased Lot 009 Block 001 in Sunset Ridge and applied for a site permit
with Stearns County. The site permit was denied as the proposed structure crosses the ghost plat
line. Since that time Baggenstoss has submitted a proposal to relocate the proposed second lot so
that he could place his home on the site where he planned. Since the Development Agreement is a
recorded document, the Board would have to authorize execution of an amendment, illustrating the
new ghost plat. During this review it was noted that Lot 004 Block 001 will also need to be
amended as the current structure crosses the ghost plat line.
I have requested a new exhibit for the ghost plat, including removing some of the elevation lines so
that ghost plat is easier to see. It was not ready for the meeting, but the highlighted map represents
the final changes.

An application was received in Environrnental Services on�iarch i6,2016 to cflnstruct a n�vv
house with an attached garage and to install a subsurface sewage(SSTS)septic system. As we
discussed on the phane yesterday,the Department is not be able ta issue a per�mit for the
structure in the propased location because it crosses over a"ghost plat"I'vn�. Per Section 7.1.a
ofthe rec�rderl Subdivisic�n Agreement for Sunset Ridge Plat: the develr�pex, its heirs and
assigns, agrees to locate buildings on the plat of Sunset Ridge tlzat do nat overlap,future lots,
blocks and streets as set forth in the attached "ghost�lat". A copy af the"ghost plat"and
Section 7.1.a of the subdivision agreement was sent via email to both you and your cantractor at
Infinity Homes for yQur reference on March 23,2016.
Therefore, at this time the co�nstruction s�te applic�tion,�s submitted,is denied. The
propased strueture rnust be relocated to nr,t cross over a ghost plat line, ar a recorded amendrnent
to the existing Subdivisian Agreement that will allow for the structure to be located as propased,
be submitted to Environmental Services. 'The construction site app�ication will remain valid for
6 months from the date of submittal(March 16,2016, sa any changes made in that time wi71 not
result in addirinnal fees for the canstruction site permit.
Additionally,the Department cannot issue an SSTS perrnit separate frarn a residential structure
construction site pe�mit, so the septic system applic$tian for this parcel is incornplete until a
coustrnctian site permit frrr the home can be issued. Please feel free to give me a call ifyou
