PREVIOUS COUNCIL ACTION: In 2005 the City accepted the environmental document, AUAR,
for the Arcon development. In 2007 the AUAR was updated to reflect the land use changes on a portion
of the plat. The area where Kennedy School is located was originally planned for single family.
BACKGROUND INFORMATION: The City staff has been working with the developer for the
Country Manor Project to identify all the processes needed for the development. Due to the size of the
project an environmental document of some kind is needed. The property purchased by Country Manor is
part of the property that was included in the AUAR that was initially completed in 2005 and then updated
in 2007. The developer is proposing to update the AUAR for the project. The proposed project is less
dense than the original Arcon Development and saves the woods. Since the City is considered the RGU
(Regulating Government Unit), the City must authorize the environmental document and start the process.
The developer is responsible for paying the cost for the update and managing the submittals and
publications. The City recently did this same process, only it was an EAW, for the distribution center.
Westwood prepared that one as well.
The City cannot approve any plats or land use matters until the update process is complete. However, the
process can be concurrently. Therefore, the developer will start the planning process, including
conducting the required public hearings but approvals cannot happen until after the Council accepts the
final document.

presented and to manage the submittals and publications with the cost being borne by the developer.

Dear Judy:
Per our meeting on Wednesday, April 6 2016 at your office, we have revised the scope of our Limited AUAR
Update to include the actual intersections to be studied. All other items are per our original letter dated March
22, 2016.
AUAR Question Number Description of Update
2: Project Proposer Update project proposer information.
6: Project Description Briefly describe current project proposal (unit counts, etc.)
7: Project Magnitude Briefly describe current project magnitude.
11: Fish, Wildlife, Ecological Update NHIS Database search for project area using Westwood’s in-house
database information (No formal DNR contact unless changes are identified).
12: Water Use Briefly review proposed water usage for new project in relation to previous
AUAR assumptions and available capacities.
17: Water Quality, Surface
Water Runoff
Update section using current stormwater plans and information.
18: Water Quality,
Wastewaters
Provide a brief update on anticipated wastewater generation for revised uses
and compare to previous AUAR assumptions, available capacities, etc.
21: Traffic Provide updated traffic analysis section, with revised Traffic Impact Study.
This will include the following intersections:

Briefly review and summarize current project against changes to

By May 9, 2016 Prepare copies and distribute AUAR Update to the EQB and official mailing
list
May 9, 2016 EQB Monitor publication date – 10-day comment period commences
May 19, 2016 AUAR Update comment period ends
May 23, 2016 If no Agencies issue an Objection to the AUAR Update, the City Council
formally Adopts the AUAR Update. If any Objections to the AUAR Update
are received, the City and the Objecting Agency enter negotiations to resolve
the objection. If Objections cannot be resolved, EQB will review and
determine if the AUAR Update is Adequate.
By May 30, 2016 Submit Final Adoption of AUAR Update to EQB
June 6, 2016 Final Adoption of AUAR Updated published in EQB Monitor
Notes
1.Above schedule is aggressive and may change based upon city of St Joseph staff availability
and meeting schedules/dates. Schedule assumes the project design is set and will not change
during the AUAR preparation process, and that supporting studies are available from the client at
the time the AUAR draft is initiated. Schedule also assumes that the Council does not need to
approve preparation and distribution of the AUAR document per City Staff.
2. The City Council meets the 1st and 3rd Monday of every month, 7:00 p.m. If a Council meeting
date falls on a holiday, the meeting will take place on Tuesday.
3. Based on the above timeline, notice of the Adoption of the AUAR Update in the EQB Monitor
could be possible by June 6, 2016 with a April 5, 2016 project kickoff.
