BOARD/COMMISSION/COMMITTEE RECOMMENDATION: In 2005 the Planning
Commission approved a Preliminary Plat and PUD for property entitled"Arcon". The property is located
adjacent to CR 121 and Jade Road. At the time of preliminary platting, a portion of Jade Road was
abandoned and re-aligned, but the ROW remained intact.
PREVIOUS COUNCIL ACTION: The City Council accepted the recommendation of the Planning
Commission approving the preliminary plat and PUD entitled Arcon.
BACKGROUND INFORMATION: The City has received a revised preliminary plat and PUD plan
for the former Arcon Property. During the Planning process it was discovered that the abandoned portion
of Jade Road had not been vacated and is still a public right of way. MN Statute requires a public hearing
to vacate dedicated public rights of way and the Council must determine that the vacation of the public
ROW is in the best interest of the public. In this case the ROW has been vacated and is not serving a
public purpose.

The St. Joseph City Council shall conduct a public hearing on Monday, June 20, 2016 at 6:30
PM, or shortly thereafter, at the St. Joseph City Hall, 25 College Ave N. The purpose of the
hearing is to consider the vacation of a portion of right of way for Jade Road per DOC. No.
