[09a] 2016 Fire Contract Revised
Council Agenda Item 9a MEETING DATE: August 22, 2016 AGENDA ITEM: Fire Contract SUBMITTED BY: Administration BOARD/COMMISSION/COMMITTEE RECOMMENDATION: On August 3, 2016 the Fire Board reviewed the first draft of the proposed fire contract. They recommended some changes and requested that each jurisdiction take the draft to their respective board for comment. PREVIOUS COUNCIL ACTION: In 2006 the City Council approved an amendment to the Fire Contract for a term of 10 years, adding some voting rights for St. Wendel Township. BACKGROUND INFORMATION: The Fire Board has been discussing the current fire contract and fire apportionment. The Contract was amended in 2006 and added voting privileges for St. Wendel Township and the amendment referred to the prior agreement for a number of the terms. The Fire Board agreed that it would be best to have one contract that could stand alone. Therefore, the terms from the amendment and contract have been reduced to a new contract. While the contract has a different appearance, the majority of old language was utilized. The redlined version includes a mark up showing the additions and deletions. The current formula for cost sharing is based on the market value of each entity, excluding tax exempt properties. The formula has worked well over the years; however, with the recent annexations of Waite Park, there has been a shift in the cost sharing due to the land loss. Therefore the cost for St.Joseph City and St. Wendel Township increase will St.Joseph Township decreases. Based on estimated numbers the impact of the upcoming annexation in Waite Park will shift approximately$ 11,000, with St.Joseph City responsible for almost$8,000. It was the shift of percentage of apportionment that led to the discussion as to how to transition the loss of land mass with the entities that will realize an increase. The Board discussed adding a provision tiering the impact. That is,for the first year after annexation that entity would be responsible for 100% of the contribution for the land mass lost, declining 20%each year. The exhibit attached to the draft agreement illustrates the concept. In addition to discussing the reducing contribution, the Fire Board was presented with two other options to include: 1) City St.Joseph contribution 50%and St.Joseph/St. Wendel Township each contributing 25%; 2) as St.Joseph Township has some ownership another option is the City of St.Joseph paying 50%; St.Joseph Township paying 27%and St. Wendel Township paying 23%. This method assumes there is a cost to providing a fire department with a minimum contribution. Since the cost apportionment is based on the budget, discussion about the donation from CSB/Monastery occurred. While the City only received$ 15,000 this year, $5,000 was allocated to the Fire Board. Some members indicated that the donation was historically presented to the Fire Department and questioned why only$ 5,000 was allocated to the Fire Department. I told them that proportionately the majority of the public safety is police and snow removal so it was divided 2/3 to 1/3. The Fire Chief discussed a letter whereby the College/Monastery agree to contribute$ 15,000 per year. This letter was signed in 2001. In 2015 the College/ Monastery provided a donation and in the letter it affirmed that any donation they provide is voluntary and will be evaluated each year. The amount we have received each year has varied as well. They further indicated at the meeting that they are not designating where the funds are applied, that is up to the City. The Fire Board had concerns over the allocation and historical donation. Each contributing member was requested to discuss the proposed draft at their respective meeting and bring feed back to a special meeting in September.
