AGENDA ITEM: Public Hearing, Interim Use Permit—Mining Operation
PREVIOUS ACTION: On July 12, 2016 the Joint Planning Board considered an application for
an administrative subdivision. The applicant was seeking approval to sever a parcel to complete a land
swap for the proposed expansion of the gravel pit. The proposed subdivision was approved with the
contingency that the subdivision did not grant development rights.
BACKGROUND INFORMATION: St. Joseph Sand& Gravel, LLC, applicant and Melrose
Associates, Inc.,property owner are requesting approval on an interim use permit to allow for mining of
sand and rock for use for construction. The existing mining operation is approximately 19 acres and the
applicant is proposing to expand mining to the east another 19 acres for a total of approximately 38 acres.
The operation would utilize the existing private drive onto County Road 2.
The applicant is proposing to operate from April through November, Monday- Saturday from 6 am to 10
pm and does not foresee the pit becoming inactive. Interim Uses are allowed for a limited period of time
and established within the Interim Use Permit. The property is zoned Urban Expansion(UE) and the
future land use plan guides the property for low and medium density residential and community oriented
mixed use (residential with neighborhood business). According the City's future transportation plan, an
east/west minor arterial roadway is planned to extend through the property upon future development.
The Joint Planning Board granted a four year interim use permit for a temporary asphalt plant as
requested by St. Joseph Sand& Gravel on the adjacent property to the south. That interim use permit is
allowed to operate until December 31, 2018 from 6 am to 8 pm Monday—Friday, 8 am to 2 pm on
Saturdays and no operation on Sundays or Holidays.
The existing plant is grandfather as it predates the Ordinance. However, since the plant is being expanded
the entire site will fall under the IUP as indicated on the staff report from Stearns County Environmental
Services.
Mining is a permitted interim use within an UE zoning district. The interim use permit shall establish
conditions of operation, including but not limited to hours of operations, days of operations and expiration
of the interim use permit. Conditions of approval are established to protect the health, safety and welfare
of the Town of St. Joseph and City of St. Joseph.
The City Office has received some concerns about the noise at early hours. Providing hours of operation
should help alleviate that concern. At the public hearing for the administrative subdivision a concern was
raised about the material that is dragged into the streets from trucks hauling material. Since that meeting
the driveway has been improved with asphalt.
In reviewing the documents the reclamation plan is contradictory and should be defined further. In one
place it states that the final grades will be determined after the mining operation, but yet a survey
illustrating elevations has been submitted. The reclamation plan appears to lack detail and since the IUP
covers the entire operation, consideration should be given if a reclamation plan for the entire site should
be submitted.
Since the proposed expansion is located within the City's Drinking Water Supply Management Area
(DWSMA) the City Engineer has reviewed the plans (comments are included). The applicant should
provide proof of the required MPCA permits or a letter of exemption if they do not need such.

NOTICE IS HEREBY GIVEN that the Joint Planning Board of St. Joseph Township and the City of St.
Joseph will be conducting a public hearing on Tuesday, September 13, 2016 at 7:05 PM in the St. Joseph
City Hall, 25 College Ave N. The purpose of the hearing is to consider an interim use permit submitted
by Melrose Associates, Inc, Melrose MN and St. Joseph Sand& Gravel, LLC, St. Joseph MN.
The request for an interim use permit is in accordance with Sections 4.18, 7.17, and 9.15.7 E of the
Stearns County Land Use and Zoning Ordinance 9439 and according to the Memorandum of
Understanding between the City of St. Joseph, Township of St. Joseph and Stearns County. The request is
to operate a gravel mining operation on an additional 19.04 acres, for a total of approximately 38 acres.
The property under consideration is part of the NWI/4 SWI/4 Section 3 and part of the NEI/4 SEI/4
Section 4, lying westerly of County Road 2, St. Joseph Township (124/29).

application is complete, the application will be scheduled for a Public Hearing with the County Planning
Commission who will recommend action to the County Board of Commissioners. It typically takes 2 months
from the time a complete application is submitted until the County Board issues final approval or denial of the
IUP.

PROPOSED GRAVEL PIT INTERtM USE PERMIT
1. This Interim Use Permit is granted only for the purpose(s) and use(s) indicated on
the parcel approved with the application, as qualified by these development .
conditions. The applicant shall undertake the project according to the plans and
specifications submitted to the county with the application.
2. The applicant shall permit reasonable access for the County to periodically inspect
the site at reasonable times and in a reasonable manner to insure that the permit
holder is in compliance with the conditions of approval and ail other applicable
statues, rules and ordinances. Minnesota Mine Safety and Health Administration
(MSHA) best practices require ali visitors be accompanied by MSHA trained

appointment to insure everyone's safety during inspection.
3. Weeds and any other unsightly or noxious vegetation sha4l be cut or trimmed as
may be necessary to preserve a reasonably neat appearance, to prevent seeding
on adjoining property.
4. All equipment used for mining operation(s) shall be kept operationat and shall be
maintained and operated in such a manner as to minimize as far as is practicabie
noises and vibrations. The mining operation shall conform to all noise standards
contained in Minnesota Rules, Chapter 7030.
S. Abandoned machinery and rubbish shall be removed from the mining
operation(s) site and shall not be allowed to accumulate.
6. There shall be no dewatering activities. ln the event that it is discovered that
dewatering is needed the applicant shall be required to amend the interim use
permit.
7. A11 mining access roads shall be gated or cabled and closed when not in operation.

described in the permit.
11. Mining operations shall not be conducted closer than fifty feet to the right-of-
way line of any existing or platted street, road or highway, or any other right-of-
way.
12. AI1 buildings, struttures, and plants used for mining operation(sj shall be
maintained in such a manner as is practicable and according to acceptable and
industrial practice, so as to assure tha# such buildings, structures, and plants will
not become dangerously dilapidated.
13. All practical means sha!! be used to reduce the amount of fugitive dust
generated by mining operation(s�. In any event, the amount of dust or other '
particulate matter generated by the mining operation(s) shall not exceed air
pollution control standards established by the Minnesota Pollution Control
Agency, including those set forth in Minnesota Rules, Chapters 70�5� 7009, 7011,
7017 and 7023. �

MN and St.Joseph Sand &Gravel, LLC,St.Joseph MN according to Sections 4.18, 7.17 and
9.15.7 E of Stearns County Land Use and Zoning Ordinance#439 and according to the
Memorandum of Understanding between the City of St.Joseph,Township of St.Joseph and
Stearns County. The request is to operate a gravel mining operation on an additional 19.04
acres,for a total of approximately 38 acres,for a period of 12 years.
BACKGROUND
An administrative subdivision was approved for this property in luly 2016. The subdivision has not
been recorded. A condition is proposed that the interim use permit is not valid until the
subdivision is recorded.
The adjacent mining operation to the west is a "pre-ordinance mining operation"therefore it is
grandfathered in and not subject to hours of operation,financial guarantee,etc. This application
will encompass both the existing mining operation and the new proposed mining operation. So
the entire site will be subject to the conditions of the IUP.
SITE INFORMATION
Location of Property: The property under consideration is part of the NWl/4 SW1/4 Section 3
and part of the NE1/4 SE1/4 Section 4, lying westerly of County Road 2, St.Joseph Township
(124/29).
Zoning: Urban Expansion District
Areas of Concern: The property is located within the City of St. Cloud and City of St.Joseph's
Drinking Water Supply Management Area. Notice has been sent to both cities.
Wetlands:There are no wetlands on the property.
PERFORMANCE STANDARDS(Section 7.17.4 Ordinance 439)
A. General Provisions:Noise, dust and vibrations shall be minimized.

B. Water Resources: Minimize interference with surface water drainage outside boundaries.
There are no wetlands on the property. The gravel pit will drain down into the pit.
C. Safety Fencing:may be required at the discretion of the Planning Commission.
D. Mining Access Roads:Shall be such that traffic has sufficient line of sight, sufficiently wide to
accommodate two-way hauling. "Trucks Hauling"signs are required during times of hauling.
Intersections shall be repaired by mine operator if necessary;turn lanes required if deemed
necessary. The mining operation will be accessed from County Road 2. Truck hauling signs
must be posted.
E. Screening Barrier:may be required by the Planning Commission to screen the mining site
from adjacent properties or public roads.
F. Setback: Processing: 100' property line, 500' residential dwelling. Mining: 30' property line,
200' residential dwelling(unless approved in writing between affected property owner and
mining operator),50' road ROW,200' river. All setbacks are met.See the attached site p►an.
G. Hours of Operation: Shall be set in the interim use permit. The applicants are requesting to
operate 6am-10pm Monday-Saturday.
H. Access roads:Shall be paved or otherwise maintained to control dust;shall be clearly signed;
shall minimize deposit of materials from trucks onto pubfic roads. The applicant will spray
water and calcium ch/oride for dust contro/and will sweep County Road 2 as needed.
I. Vertical faces:Shall be kept to a minimum except during actual mining.
J. Weeds and other unsightly or noxious vegetation:Shall be controlled and comply with MN
Statutes,section 18.191;or successor statute. Will be met per applicant.
K. Complaints: Stearns County has not complaints related to the mining operation. The City and
Township can discuss if either of them have any complaints.
L. Signage:An informational sign is required at the entrance to the gravel pit. It must be clearly
visible from the public road and must indicate the name and phone number of property
owner,site operator and hauling contractor. A sign is posted at the County Road 2 entrance.
ADJACENT LAND USES: The surrounding land is zoned Urban Expansion. There is 40 acres of R-10
zoning to the northeast.
North—Agricultural land and wetland
East—Agricultural land. The city of St.Joseph is 800 ft to the southeast
South—Turkey barns, mining operation and rural residential lots
West—South Fork Watab River is over 1000 ft to the west. Also wetland and a rural residential
lot.
Reclamation:See enclosed sheet 3 of 3 for proposed contours.
SURVEYOR'S NOTE: (End Use Plan)
1. Proposed final grades will be determined after mining operation has been completed.A
proposed 3 to 1 slope grade will be constructed around the perimeter of the finished mining
operation.The remaining site will result in finished grades that will be determined, but will take
in consideration what is stated in the Stearns County Land Use and Zoning ordinance,section
7.17.5. "The peaks and depressions of the mined area shaU be graded and back-filled to a
surface which will result in a gently rolling topography in substantial conformity to the land area
immediately surrounding. Finished slopes shall be stabilized to minimize erosion due to rainfall.
The finished grade shall be such that it will not adversely affect the surrounding land or future
development of the site.The finished plan shall restore the mining site to a condition whereby
it can be utilized for the type of land use proposed to occupy the site after Mining Operations
cease.

2. After the mining operation has been completed the site will be used for farming operations and
is intended to be replanted in crops.
3. There is no reclamation staging plan proposed with this site.
4. End Use Plan elevations shown on the drawing have been determined by St.Joseph Sand and �
Gravel LLC.

SUMMARY
If the Joint Planning Board approves this conditional use permit according to Sections 4.18, 7.17 and
9.15.7 E of Stearns County Land Use and Zoning Ordinance#439, the following conditions should be
considered:
1. Hours of operation shall be set. The applicants are requesting to operate 6am-10pm Monday-
Saturday. No operation is typically allowed on Sundays or holidays.
2. Date the interim use permit would expire. The applicants are requesting 12 years(December
31,2028).
3. The applicant shall submit and maintain a financial guarantee of$95,000($2500 per acre on
38 acres), payable to the Joint Planning Board,to ensure that the reclamation will be
completed in accordance with the proposed plan and with Section 7.17.5 of Ordinance#439,
or successor ordinance.
4. All performance standards of Section 7.17.4 of Ordinance#439, or successor ordinance shall be
met.
5. The IUP is not valid and no mining can occur until the administrative subdivision is recorded.

1. As noted in the August 23, 2016, memo from Stearns County Environmental, the existing and proposed
gravel mining operations fall within the City's Drinking Water Supply Management Area (DWSMA). The
existing mining and proposed operations are located within areas described as Very High and High
vulnerability(See attached Figure 9-3). DWSMA vulnerability is an assessment of the likelihood that the
groundwater aquifer may be subject to impact from land and water uses within the wellhead protection
area. The site is outside of the Emergency Response Area that is defined as the part of the wellhead
protection area defined by a one-year time of travel within the aquifer that is used by the public water
supply well.
2. The submittal did not include any geotechnical investigation of the site that identifies potential ground
water elevations. However, the certificate of survey indicates open water areas of the existing operation
are between elevations of 1060 and 1063, and the Stearns County aerial imagery of the St. Joseph Sand
and Gravel site to the southwest suggests open water similarly near the 1063 contour elevation. The
South Fork Watab River generally flows between elevations of 1055 and 1054 in the vicinity of the site.
The MPCA Construction Stormwater(CSW)General Permit requires a minimum vertical separation of 3
feet from the seasonally saturated soils (water table)or bedrock. Assuming the proposed 1070 finished
grade elevation for the mining operation and an estimated water table elevation of 1063, it appears
reasonable vertical separation is being proposed. The City may consider requesting either existing well
logs or recent geotechnical logs of the site for field verification purposes.
3. Considering the conditions identified in comments 1 and 2 above, the MPCA provides the following
guidance relative to infiltration practices on the site:
If the site requires a Construction Stormwater General Permit, stormwater infiltration is prohibited in
the following areas regardless of whether the site is located in a DWSMA.
• Areas that receive discharges from vehicle fueling and maintenance.
• Areas with less than three (3)feet of separation distance from the bottom of the infiltration system to
the elevation of the seasonally saturated soils or the top of bedrock.
• Areas that receive discharges from industrial facilities that are not authorized to infiltrate industrial
stormwater under an NPDES/SDS Industrial Stormwater Permit issued by the MPCA.
• Areas where high levels of contaminants in soil or groundwater will be mobilized by the infiltrating
stormwater.

• Areas of predominately Hydrologic Soil Group D (clay)soils unless allowed by a local unit of
government with a current MS4 permit.
• Areas within 1,000 feet up-gradient, or 100 feet down-gradient of active karst features unless allowed
by a local unit of government with a current MS4 permit.
• Areas where soil infiltration rates are more than 8.3 inches per hour unless soils are amended to slow
the infiltration rate below 8.3 inches per hour or as allowed by a local unit of government with a
current MS4 permit.
Recommendations for infiltrating storm water in DWSMAs
The following are recommendations for infiltration practices in a DWSMA regardless of whether the
above step-by-step process indicates infiltration is appropriate or a Construction Stormwater permit is
required.
• Ensure that separation distances are met and that existing or proposed structures or infrastructure
(e.g. rate control BMPs, utilities, buildings, roadway, easements)do not prevent infiltration.
• If there is a potential for the high water table or bedrock to be within 6 feet of the bottom of proposed
infiltration practices, follow guidelines in the Minnesota Stormwater Manual for conducting site
investigations and managing infiltration in these areas.
• If there is the potential for presence of contaminated soils, contaminated groundwater, and/or hotspot
runoff, follow guidelines in the Minnesota Stormwater Manual for conducting site investigations and
managing infiltration in these areas.
• If there is a potential for presence of soils with steady-state infiltration rates less than 0.2 inches per
hour, follow guidelines in the Minnesota Stormwater Manual for conducting site investigations and
managing infiltration in these areas.
• If infiltration could result in adverse surface water hydrologic impacts, such as impacting a perched
wetland, minimize infiltration to a point where adverse surface water hydrologic impacts are avoided.
• If the infiltration practice is constructed in industrial, commercial, or transportation land uses, ensure
that emergency procedures for containment of spills are established and acceptable.
• Infiltration is not recommended in areas that receive discharges from vehicle fueling and
maintenance.
• Infiltration is not recommended in areas that receive discharges from industrial facilities that are not
authorized to infiltrate industrial stormwater under an NPDES/SDS Industrial Stormwater Permit
issued by the MPCA.
• Infiltration is not recommended in areas within 1,000 feet up-gradient, or 100 feet down-gradient of
active karst features. If infiltration is being considered, follow stormwater management guidelines for
karst areas.
• Infiltration is not recommended in areas where soil infiltration rates are more than 8.3 inches per hour
unless soils are amended to slow the infiltration rate below 8.3 inches per hour or as allowed by a
local unit of government with a current MS4 permit.
4. We were unable to determine if the site is presently regulated by an existing MPCA Industrial Stormwater
Permit for the operation. The applicant shall submit a copy of the permit and spill containment plan for the
site (or formal evidence of exemption of permit coverage from the MPCA).
5. The applicant should clarify if there will processing of recycled construction materials (ex. concrete,
asphalt, etc.)or concrete washout operations on site. Additional Best Management Practices (BMP) may
need to be defined if such operations are occurring or will occur.
6. The Reclamation section of the IUP Request states that the "proposed final grades will be determined
after mining operation has been completed," but also references Sheet 3 of 3 of the certificate of survey

STATE OF MINNESOTA ST.JOSEPH JOINT PLANNING BOARD
COUNTY OF STEARNS INTERIM USE PROCEEDINGS
In the matter of. St. Joseph Sand and Gravel, LLC and Melrose Associates, Inc.
The Joint Planning Board considered a request for an Interim Use Permit submitted by St. Joseph Sand
and Gravel LLC and Melrose Associates, Inc. to allow for the operation of mining sand and gravel on the
property legally described in Exhibit A, "Subject Property". The matter was duly published and notice
was provided to property owners within 1250 feet(.25 mile) of the above referenced property and the
Joint Planning Board conducted a public hearing on September 13, 2016.
The St. Joseph Joint Planning Board acknowledged the following Findings of Fact in consideration of
the request for Interim Use Permit for the operation of mining of sand and gravel:
1. The subject property is currently zoned Urban Expansion.
2. Mining is a permitted interim use in an Urban Expansion Zoning District.
3. The adjacent land uses to the subject property are the temporary asphalt operation,
agricultural and rural residential lots. The City of St. Joseph and single family residential lots
are located southeast of the subject property.
4. The future land use plan within the Comprehensive Plan guides the property for low and
medium density residential and community oriented mixed use (residential and neighborhood
commercial).
5. The future land use plan guides the surrounding property for low to medium density
residential and community oriented mixed use (residential and neighborhood commercial).
6. The interim use is consistent with the Stearns County Comprehensive Plan. The Urban
Expansion category is described as areas anticipated to be annexed and provided with
municipal services during the time frame of this plan. This also includes areas under Orderly
Annexation Agreements. Limited commercial/industrial uses may be considered.

i. Objective 1: Locate the high quality aggregate resources in the County to guide
protection and utilization activities.
ii. Objective 2: Manage the aggregate resources to provide for the extraction of high

7. The interim use is consistent with the City of St. Joseph Comprehensive Plan, Transportation
Plan, and Utility Plans
a. The subject property is located in Planning District three which identifies this area a low
to medium density residential. The mining operation is issued through a temporary
interim use permit which allows the property to develop in the future.
b. Utility Planning—The temporary interim use permit will not impact future utilities.
c. Transportation Plan—The temporary interim use permit will not impact future roadways.
The future transportation plan indicates an east/west roadway through the subject
property.
DECISION AND CONCLUSION
Based on the Finding of Fact, the St. Joseph Joint Planning Board approves the Interim Use
Permit(IUP) as requested by St. Joseph Sand and Gravel, LLC and Melrose Associates, Inc. with the
following conditions:
1. Months of Operation: April 1 —November 30
2. Hours Operation: Monday—Friday: 7 AM to 8 PM
Saturdays: 8 AM to 2 PM
Sundays and Holidays: Operation not allowed
3. Expiration of IUP: The IUP will expire on September 19, 2021.
4. Secure Load: Trucks hauling shall secure their load. Dirt, gravel, sand, excess
material shall be cleaned from the public roadway.
5. Financial Guarantee: The applicant shall submit a financial guarantee in the amount of
S 95,000, to guarantee reclamation of cleanup.
6. Signage: a. Truck Hauling signs are required during times of hauling.
b. Signs shall be placed at the entrance showing the name and
telephone number of the property owner, site operator and
hauling contractor.
7. The administrative subdivision that was approved by the St. Joseph Joint Planning Board
on July 12, 2016 for the Subject Property shall be recorded prior to beginning mining
operation.
8. Required Permits: The applicant is responsible for obtaining all required Federal,
State, and Local permits and provide copies to the Joint Board Secretary(City offices).
9. The applicant shall submit a copy of the MPCA Industrial Stormwater Permit and spill
containment plan for the site (or formal evidence of exemption of permit coverage from
the MPGA).
10. The applicant shall submit plans for processing of recycled construction materials (ex.
concrete, asphalt, etc.) or concrete washout operations on site. Best Management
Practices (BMP) shall be followed and a BMP plan shall be submitted to the Joint
Planning Board Secretary(City offices).
11. The Reclamation plan shall include the entire site and final grades. A revised detailed
plan shall be submitted to the Joint Planning Board Secretary prior to beginning mining
operation.
12. The Setback are as follows: Processing: 100 feet from property line, 500 feet from
residential dwelling. Mining: 30 feet from property line, 200 feet from residential
dwelling and 200 feet from river.
13. Access roads shall be paved or otherwise maintained to control dust;shall be clearly
signed; shall minimize deposit of materials from trucks onto public roads.
14. Weeds and other unsightly or noxious vegetation shall be controlled and comply
with MN Statutes, section 18.191; or successor statute.
15. Dust shall be controlled.
