PREVIOUS COUNCIL ACTION: The City Council authorized the solicitation of bids for the 2016
Field Street Improvement and approved the payment for 3 of the 4 ROW parcels.
BACKGROUND INFORMATION: Four of the residents off of Elena that abut the Field Street
Corridor were present at the public hearing for Field Street expressing with concerns about safety as their
back yards abut the corridor and they have small children. They indicated that they did not know that a
road would be located in the back and requested the City provide additional safe guards.
In 2010 one of the four properties applied for and secured a fence for the backyard and received an
easement release allowing the fence to be constructed to the property line. The Building Permit included
a provision that when the Field Street Corridor was constructed the fence may be required to be moved at
their expense. In 2016 a second neighbor applied for a fence permit as was required to keep the fence out
of the easement, which was completed.
The City Ordinance does not allow building in an easement area. In 2006 the Ordinance was amended
that included a provision that in the event an easement does not have infrastructure located within the
easement, a property owner could apply for an administrative variance. We have tried to very consistent
in enforcing that Ordinance as everyone indicates that they will move the impediment if we need, it is
typically an emergency that requires us to access an area. In those times we might not have the ability to
wait to move something. Therefore we have not allowed encroachments. In reviewing the fence that was
installed in 2010, the encroachment was permitted in error.
Two of the property owners have requested that either the City construct the fence in the public right of
way or allow them to build a fence in the easement area. City staff is not recommending purchasing and
installing fence in the public right of way as this would be precedence setting and a maintenance issue.
The City cannot pay for improvements on private property so we would not have the ability to pay for the
fence on private property. The Council is being asked to allow the fence in the easement area. If it is
granted some type of Memorandum of Understanding should be executed to identify the terms.

Here is the letter:
As residents of 402 Elena Lane,we live on the corner of the future intersection of Elena Lane and Field Street. For those
of you not familiar with our home,we have a pie-shaped yard,with the tip of the pie being in the backyard.
As we previously disclosed at the meeting about Field Street in January 2016,we were not aware when we purchased
our home in 2013 that the field road would one day become an actual road. Despite the impending road,we love our
neighborhood, our town and our home. However,we are concerned about the safety of our 19-month-old son and his
future sibling. At the meeting to discuss Field Street, the feasibility report that was presented showed the parkway
model providing 21 feet of space between our property line and the beginning of the road (see PDF
attachment). However,for the first four homes this isn't accurate. There is only 14 feet from the property line to the
road.That's 7 feet less than what was presented to us in January.
Considering the current dirt field road is at least 40 feet away,you can understand how concerned we are about the
safety of our kids. At the city council meeting to discuss the road in January, we were told that the city would take
measures to work with the home owners to address our safety concerns.
We would request that the city would put in an 8-foot maintenance free fence for the first four homes within the 3.8
feet between the homeowners' property line and the sidewalk. A fence of this nature would have limited lifetime
costs.
If the city council does not support a fence being put on the city's property then we request that the city council would
help facilitate the granting of permits for homeowners to put up a fence of their own within the city's allowed easement
on our properties. Fencing within the easements is allowed in City Ordinance 302 when permits are granted. With our
irregular shaped lot it makes putting up a fence outside of the 15 feet of easement extremely difficult. With our
concerns for safety and close proximity of the road, we feel a fence is a necessity and would ensure the safety of our
kids. We would like to put up maintenance-free fencing panels approximately 5 feet or less from the property line. This

style of fencing could be easily removed in the rare instance of the city needing to enact their easement rights. Please
