PREVIOUS COUNCIL ACTION: The City Council approved the St.Joseph Professional Plat in
2012,which provided four commercial shovel ready lots.
BACKGROUND INFORMATION: The City has received a request from O'Reilly Auto Enterprises,
LLC to vacate a portion of a drainage easement to accommodate the construction of an O'Reilly Auto
Parts Store.Along the northerly boundary of the St.Joseph Professional Plat(Lot 1,Block 1),a 76 foot
wide drainage easement was dedicated for stormwater drainage needs.They have reconfigured the storm
ponding/infiltration area to accommodate stormwater needs.A drainage easement would remain over the
ponding/infiltration area with the existing easement and with the dedication of a new easement area.
The City Engineer and Public Works Director have reviewed the proposed request for vacation of
easement and have verified that the portion requested to be vacated will not be needed based on the
submitted plans. The utility companies have also been contacted and have verified that they have no
objection to the vacation request. Additionally,there are drainage and utility easements along the
boundaries of the property that will remain.

RESOLUTION 2017-002
RESOLUTION VACATING A PORTION OF A DRAINAGE EASEMENT
WHEREAS,the City Council of the City of St.Joseph held a public hearing following publication,mail
and posted notice for the purpose of hearing those present to consider the vacation of a portion of a public
drainage easement within the City of St.Joseph; and
WHEREAS,it appeared in the best interests of the public and the City of St.Joseph that such a portion
of a public drainage easement be vacated and discontinued.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF ST.JOSEPH,STEARNS
COUNTY,STATE OF MINNESOTA,duly assembled that the following described public drainage
easement hereby vacated to wit:
A vacation of all that part of the Drainage Easement dedicated on the Plat of St.Joseph Professional Plat,
Stearns County,Minnesota,lying easterly of the following described line:
Commencing at the northeast corner of said Lot 1,Block 1; thence South 00 degrees 05 minutes 30
seconds East,assumed bearing,along the east line of said Lot 1,a distance of 38.00 feet to the south line
of the North 38.00 feet of said Lot 1,as measured at right angles to the north line thereof;thence South 89
degrees 25 minutes 56 seconds West,along said south line of the North 38.00 feet,a distance of 155.00
feet to the point of beginning of the line to be described;thence South 44 degrees 25 minutes 56 seconds
West,a distance of 29.96 feet;thence South 00 degrees 34 minutes 04 seconds East, a distance of 16.82
feet to the south line of the North 76.00 feet of said Lot 1,as measured at right angles to the north line
thereof,and said line there terminating.
Whereupon said resolution was declared duly adopted by the St. Joseph City Council this 6th day of
February,2017.

NOTICE OF PUBLIC HEARING
VACATION OF DRAINAGE EASEMENT OF
LOT 1,BLOCK 1,ST.JOSEPH PROFESSIONAL PLAT
The St.Joseph City Council shall conduct a public hearing on Monday, February 6,2017 at
Administrator 6:00 PM,or shortly thereafter,at the St.Joseph City Hall.The purpose of the hearing is to
consider the vacation of a portion of a drainage easement for part of Lot 1, Block 1,St.Joseph
Judy Weyrens Professional Plat.
The request has been submitted by O'Reilly Auto Enterprises LLC.
Mayor All persons wishing to be heard will be heard with oral testimony limited to 5 minutes.Written
Schultz testimony may be submitted to the City Administrator,City of St.Joseph, PO Box 668,St.
