PREVIOUS COUNCIL ACTION: Over the past couple of years the City Council has been discussing the
need to improve the Central Business District(CBD)alleys as they have been deteriorating and have
some drainage issues. At the same time the Council discussed whether or not a central parking area
could be created in Block 9 of the downtown area and if green space and amenities could be added.
Staff had met with property owners and the consensus of the owners that participated was to improve
the alley, include storm sewer improvements and maybe add some amenities
The City Council accepted the feasibility report and called for the public hearing on January 23,2017.
BACKGROUND INFORMATION: On Nov 14, 2016 the Council authorized the City Engineer to prepare
the feasibility report for the proposed 2017 CBD Alley Improvement. On January 23, 2017 the City
Council accepted the feasibility report and authorized the public improvement hearing for the proposed
improvements.
The public hearing process is regulated through the 429 process which includes a series of resolutions
that must be adopted by the Council. The City Council has already completed the first resolution by
accepting the feasibility report calling for a public hearing.
Part of the public hearing is to provide a reasonable estimate as to the cost of the project and impact to
residents. Included in the information for the packet is a preliminary assessment roll. The purpose of
this hearing is not to focus on the assessment; rather the merits of the project. At this time the project
is not designed and the numbers are merely an estimate. Residents will have an opportunity at a later
time to discuss the assessments when final numbers are available.

ORDERING IMPROVEMENT AND PREPARATION OF PLANS
2017 CBD Alley Improvement
WHEREAS, a resolution of the city council adopted on the 23rd day of January, 2017, fixed a date for a
council hearing on the proposed improvement to the east/west and north/south alley's between Minnesota
Street and Birch Street and College Avenue N and ls`Ave NW by bituminous surfacing, storm water and
sewer improvements, and to assess the benefited property for a portion of the cost of the improvement.
AND WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and
the hearing was held thereon on the 6"' day of February, 2017, at which all persons desiring to be heard
were given an opportunity to be heard thereon,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report.
2. Such improvement is hereby ordered as proposed in the council resolution adopted the 6"' day of
February, 2017.
3. SEH is here by designated as the engineer for this improvement. The engineer shall prepare plans
and specifications for the making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the improvement
from the proceeds of the tax exempt bond.

This official notice of public hearing is being sent to inform you that the City Council of the
City of St.Joseph will be conducting a public hearing at 6:15 PM on Monday,February 6 at the
St.Joseph Government Center, 75 Callaway St E,to consider the proposed public improvement
as listed on the attached hearing notice. If these proposed improvements are approved by the
City Council,property in your ownership abutting these improvements will be assessed for the
benefit.

1. At the time of the public hearing anyone wishing to speak in favor of,or in opposition
to the proposed improvements,or having questions relating thereto,will be heard by the
Mayor Council. (Note: You are not required to attend this meeting). Written testimony may be
directed to the City Administrator,City of St.Joseph,PO Box 668, St.Joseph

The preliminary assessment roll presented at the public hearing is only an
Councilors estimate. If the Council moves forward with the project,the Engineer will provide
a revised assessment roll based on actual costs and review of the benefit of the

a) Approve the proposed improvement requesting the Engineer to prepare the
plans and specifications.
b) Table the action to a future meeting,the date of which will be announced at this
same time.
c) Request modification of the project with revised plans submitted to the City
Council
d) Reject the proposed improvement.
3. Should the City Council elect to approve the improvement,it is anticipated that bids
will be received spring 2017 for construction after July 4,2017.
4. After preparation of the assessment roll,each owner receives a notice of the proposed
assessment to his/her property and the City Council conducts a public hearing on the
proposed assessment. The assessment hearing is conducted after the bids are received
but before the City Council awards the project. The final decision on the making of the
improvement occurs when or if the City Council votes to award the project.
5. Assessments are based on actual project costs(construction, engineering,administration
and capitalized interest).The assessed amounts may vary from estimated costs,
depending upon the actual project cost and result of benefit analysis.
6. Following approval of the assessment roll,as proposed or as amended,you will be sent
a bill of your actual assessment.The City Council's policy for payment of the
assessment allows payments in the following manner:

a) Payment in full or a partial payment of the assessment to the City of St.Joseph,within 30
days of the date of the assessment bill. Payments must be submitted to the City Offices.
b) After 30 days from the date of the assessment bill,but before September 15,2017,
payment of the entire amount of the assessment plus interest estimated at a rate TBD,
computed from the date of the Council resolution adopting the assessment roll to the date
of payment. Payments must be submitted to the City Offices. (Note: The interest rate will
be determined at the time of bonding for the improvement.)
c) On or about October 1,2017 the Finance Director will certify the unpaid assessment
balance to the County Auditor for collection. Payments will then be made in annual
installments over either a 10 or 15 year period.The term will be determined at the
assessment hearing. These payments shall be payable in the same manner as real property
taxes,with the first installment payment due on May 15,2018.The first installment shall
be added interest at the estimated rate TBD of the entire assessment amount computed
from the date of the Council resolution adopting the assessment roll to December 31,
2017.Thereafter,the assessment shall be divided into equal annual payments. Once the
assessment has been certified to the County Auditor for collection,the assessments may
be paid in full to the City Offices with interest accrued to December 31 of the year in
which payment is made.
d) A homestead property whose owner is 65 years of age or older maybe eligible for a
deferment of special assessment. For additional information contact the City Offices at

Notice is hereby given that the City Council of St.Joseph will meet in the Government Center
Council Chambers, 75 Callaway St E, at 6:15 PM on February 6, 2017 to consider the making of

2017 Alley Improvements
Prepared for City of St Joseph
1.0 Scope
This report addresses the proposed alley reconstruction and potential utility improvements for
the Block 9 and 12 alleys in the Saint Joseph Addition in the City of St. Joseph, MN. It also
contains findings of facts, options for improvements, and opinions of probable costs for the
alley rehabilitation. This report has been developed based on preliminary field observations
and discussions with City staff.
The project location is shown in Exhibit No. 1. This report considers paving all alleys in
Blocks 9 and 12 with up to four optional infrastructure additions for either block.
• Option 1 would include the addition of storm sewer to collect drainage within the
alleys. This option would include new storm sewer in targeted locations for both
blocks along with replacing the existing storm sewer in Block 12.
• Option 2 includes the addition of concrete curb and gutter and the storm sewer
referenced in Option 1 to both blocks.
• Option 3, for Block 9 only, includes a walkable alleyway for approximately 55 feet of
the south alley leg of the block.
• Option 4 is the addition of cured in-place pipe (CIPP) at targeted spot locations within
lining the existing sanitary sewer on both Blocks 9 and 12.
2.0 Feasibility
Having investigated the facts relating to construction of the proposed improvements, it is in
my opinion, from an engineering standpoint, that this project is feasible and cost-effective.
The project is necessary in order to replace deteriorating pavement, minimize maintenance
activities associated with the gravel alleys, and improve drainage concerns.
3.0 Background and Existing Conditions
3.1 Alley Surfaces
Block 9
Currently, the Block 9 alleyshave 16 foot-wide paved surfaces but are in poor condition. City
records indicate the east and west alley legs were last constructed in 1998. There is severe
alligator cracking throughout a majority of the block and numerous potholes in primarily the
south and west alley legs. The east alley leg currently has curb and gutter on the north side
only, while the majority of the alley abuts existing bituminous paved parking lots. There are

also a number of previously patched locations in the bituminous pavement throughout the
block.
Considering the downtown commercial businesses and proximity to College Avenue and
Minnesota Street, pedestrians, bicyclists, motorists, and commercial traffic are present
throughout the block.
Block 12
The existing alleys are gravel surfaces with 20-foot wide rights-of-way (ROW) and have been
considered for reconstruction in the past. The gravel surface has many potholes throughout,
along with low lying areas on either side. The south 30 feet of the south alley leg is currently
paved, which over time has developed frequent cracks throughout. The north, south, and
west alley legs have adjacent paved parking lots, while the south and east alley legs have
adjacent concrete parking lots. These parking areas also generate pedestrian activity to and
from the downtown area.
3.2 Drainage
Block 9
The north and south alley legs drain to the north with the exception of the south half of the
south alley leg which drains toward West Minnesota Street. The east alley leg drains to an
existing storm sewer catch basin near Bo Diddley’s, and the west alley leg drains west toward
1st Avenue NW. The location of the existing catch basin can be seen on Exhibit No. 2 and
was installed in 1998 during the 1998 Street Improvements project. The existing storm sewer
and catch basin on the east alley leg is the only one within the Block 9 alleys, and it is too
shallow to extend service further west. The poor condition of the bituminous pavement on the
south alley leg contributes to poor surface flow, and there is also an area where water
collects along the west building of the south alley leg.
Block 12
The east and west alley legs currently drain east toward College Avenue. The north and
south alley legs drain toward the north, with the exception of the southernmost 30 feet of the
south alley leg, which drains toward Ash Street West to the south. There are no storm sewer
catch basins within the east, west, or south alley legs of this block; however, there are two
storm sewer catch basins in the north alley leg which can be seen on Exhibit No. 3. These
catch basins were installed in 2002 with the 2002 Street Improvement and Utility
Improvement project. Poor drainage has been observed on the east alley leg on the north
across from the office building and along either side of the south alley leg.
3.3 Sanitary Sewer
Block 9
An 8 inch vitrified clay pipe (VCP) sanitary sewer gravity pipe exists on the east and west
alley legs shown on Exhibit No. 2 and drains to the west to 1st Avenue NW. There are an
estimated fourteen sanitary sewer hook ups from the adjacent properties to this pipe.

Block 12
The east and west alley legs of Block 12 are also served by an 8 inch VCP sanitary sewer
gravity pipe flowing toward the east as shown in Exhibit No. 3. There are access manholes
on both ends located on 1st Avenue NW and College Avenue North. This block is estimated
to have five sanitary sewer hook ups to the adjacent properties.
Both sanitary sewer pipes have been televised. The Block 9 sewer was televised in 2000 and
2011, and the lock 12 sewer was televised in December 2016. The sewer televising showed
the VCP pipe to be in operable condition with isolated deficiencies including sections of pipe
with longitudinal and vertical cracks, minor offset pipe, joints, and minor service top
protrusions. The pipe flow line is mostly uniform.
4.0 Proposed Improvements
Block 9
It is proposed to replace the bituminous pavement of Block 9. Reconstruction would involve
removing existing bituminous pavement together with existing base material. As shown on
Exhibit No. 9, the alley way would then be paved with an inverted crown similar to the
improvements constructed behind Millstream Shops and Lofts in 2006. The alleys are
proposed to be paved at a width of 16 feet. The new bituminous surface location can be seen
in Exhibit No. 4.
Block 12
The improvements proposed for Block 12 are to replace existing gravel surfaces of all alley
legs, including the existing bituminous paved section on the south alley leg with bituminous
pavement throughout. As shown on Exhibit No. 9, the use of an inverted crown would be
used in an effort to improve drainage and to utilize the existing storm sewer catch basins.
These alleys are proposed to be paved at 16-feet wide within the 20 foot ROW as shown on
Exhibit No. 5.
4.1 Option 1: Add Storm Drains
Option 1 would include the addition of new storm sewer locations and replacing the existing
storm sewer in place.
Block 9
To improve the collection of surface drainage, a new storm sewer is proposed down the
middle of the north alley leg. The proposed storm sewer is depicted on Exhibit No. 4. The
existing storm sewer catch basin on the east alley leg would stay in service. The storm sewer
manhole within Ash Street West would need to be reconstructed in order to connect the new
proposed storm sewers within the alley.
Block 12
Two additional storm sewer catch basins are proposed to improved drainage of the Block 12
alleys. These catch basins would be installed on the north side of the existing sanitary sewer
that runs west to east. The proposed locations can be seen on Exhibit No. 5 and will connect
to existing storm sewer catch basins on the north alley leg. The existing south catch basin
would need to be replaced in order to connect the new catch basins to the system. The other
existing storm sewer would be adjusted to the new bituminous pavement.

It is estimated the majority of the proposed storm drain work will occur within the public alley
rights-of-way; however, there may be a need to acquire temporary construction easements to
construct the optional storm sewer additions.
4.2 Option 2: Add Curb and Gutter & Storm Drains
Option 2 includes the proposed storm sewer as defined in Option 1 for both blocks, but would
also include the addition of concrete curb and gutter where applicable. The addition of curb
and gutter may allow other typical pavement cross section alternatives, depending on the
storm sewer catch basins location. The typical pavement section within the curb and gutter
can be seen on Exhibit No. 9. The design would be crowned roadway sloped toward the curb
and gutter. Where needed, a more drive-over type of curb and gutter would be used for
locations such as where the alley ties into a parking area. A determination on whether or not
the typical section can include a uniform pavement crown or a variable cross-slope will be
made during detailed design.
4.3 Option 3: Walkable Alley
This option applies to Block 9 only and would be in addition to either of the first two options.
The existing south alley leg alley, between the Rock House Productions building and the
Closet 2 Closet building, would be converted to a walkable alley with no motorized vehicles
allowed. As shown in Exhibit No. 8, this walkable area would be limited to length of the
buildings between the sidewalks on Minnesota Street to the back of the Rock House
Productions building, approximately 55 feet.
This walkway area is proposed to include lit bollards preventing motorized vehicle entrance, a
decorative arch as envisioned by the Minnesota Design Team sketches, lighting benches,
plantings, and bicycle storage loops.
4.4 Option 4: Sanitary Sewer Cured In-Place Lining
Option 4 exists independent of the other surface options and provides for the spot-lining of
the sanitary sewer for both blocks. Block 9 has an 8 inch VCP gravity sanitary sewer pipe that
drains east to west as depicted in Exhibit No. 6.
Block 12 also has an 8 inch VCP gravity sanitary sewer pipe that drains west to east shown
in Exhibit No. 7.
5.0 Probable Costs
The summary of probable costs for the improvement are summarized in Table 1 and Table 2
for Block 9 and Block 12 respectively, and includes opinions of probable cost for construction,
contingency, engineering, fiscal, legal, and administrative expenses for each option. The
complete detailed opinions of probable cost for each option can be found in Appendix A.

6.0 Assessments
For surface improvements, the City’s Special Assessment Policy prescribes the assessment
methodology to be on the basis of “frontage” or “footage” unless the assessable costs would
be more equitably distributed on a different basis. Since most of the lots abutting the project
are regular shaped, the frontage basis is anticipated to be applicable for the surface
improvements.
For frontage assessments, rectangular interior lots are assessed the frontage equal to the
dimension of the side of the lot abutting the improvement. Rectangular corner lots are
assessed 100 percent of the short side footage of the lot abutting the improvement and 50
percent of the long side footage of the lot abutting the improvement. In the instance where
rectangular corner lot sides are equal, one side will be assessed 100 percent and the other
side will be assessed 50 percent.

in the same manner as surface improvements.
For sanitary sewer improvements, it has been the City’s practice to assess 60 percent of the
total improvement cost to benefitting properties, and to subsidize the remaining 40 percent
with City funds.
