HomeMy WebLinkAbout[02] Minutes December 13, 2016 Page 1 of 2 Pursuant to due call and notice thereof, the Joint Planning Board for the Township and City of St. Joseph met in regular session on Tuesday, December 13, 2016 at 7:00 PM in the St. Joseph City Hall. Members Present: Acting Chair Renee Symanietz. Members Jerome Safzer, Steve Olson, Bob Loso, Gina Dullinger, Brenda Stanger, Ralph Eiynck, Mark Thompson. Secretary of the Board Judy Weyrens. Others Present: Ann Reischl, Hal Understander, Allen Bright, Steve Bright, Bobby Bright. Approve Minutes: Loso made a motion to approve the minutes; seconded by Salzer and passed unanimously. Public Hearinq Conditional Use Permit Steve Briqht� Chair Symanietz cafled the hearing to order to which Weyrens stated the purpose of the hearing is to consider a conditional use permit to allow the property owner to operate an auto and light truck sales lot in the Industrial Zoning district in accordance with Sections 4.8, 6.44 and 9.11 of the Stearns County Land Use and Zoning Ordinance#439 and according to the Memorandum of Understanding between the City of St. Joseph, Township of St. Joseph and Stearns County. The property for which the Condition Use is being requested is located at 8055 Country Road 75, St. Joseph MN 56374. The request for CUP has been submitted by Charles Koenig on behalf of Steve Bright. Steve Bright spoke on his own behalf. He stated that he currently owns a car lot in Waite Park entitled Granite City Motor Car and is in need of additional space as he has outgrown his existing site. The site describe above will meet his needs and allow his business to grow. The business will remain the same, vehicle sales only. While there are buildings located on the site he is not proposing to modify the buildings. As no one present wished to speak, Symanietz closed the public hearing. Weyrens presented the Board with draft findings of fact recommending approval of the CUP. She stated that Stearns County has reviewed the application and stipulated that all vehicles must be parked on improved surfaces. Other stipulations include limiting the signage to the existing frame and not permitting the use of banners or streamers. Loso made a motion authorizing execution of the findings of fact, issuing a Conditional Use Permit to allow the operation of an auto and light truck sales at the aforementioned property with the following contingencies: 1. For sale vehicles shall only be displayed on the paved areas as illustrated on Exhibit �A„ 2. Any new lighting installed must meet Stearns County Standards to include deflecting light away from any adjoining property or public streets. 3. Any outdoor tr•ash enclosures must be enclosed on three sides per Section 7.31 of Stearns County Ordinance 439. 4. Signage for the property shall be limited to size of the existing signs. New signs are not included or approved. S. The use of banners and streamers shall be prohibited. The motion was seconded by Salzer and passed unanimously. Develoqment Aqreement Amendment River Ridge Estates� Weyrens presented the Board with a proposed amendment to the Development Agreement for River Ridge Estates. Earlier this year the Joint Planning Board approved execution of a Development Agreement for the River Ridges Estates development. The Agreement required that the first lift of pavement be completed no later than September 2016. As of this time the road has not been completed. The developer, Cory Ehlert, has requested an extension to June 30, 2016 and he would also request that he be allowed to construct the final wear course late 2017. Weyrens stated that she contacted the City Engineer and he is agreeable to December 13, 2016 Page 2 of 2 the request. Dullinger made a motion to amend the Development Agreement between the Joint Planning Board and CLC Partners extending the time for completion of the first lift of pavement for the Rivers Ridge Estates to June 30, 2017. In addition, contingent upon approval of the Engineer,the final wear course can be completed in 2017. The motion was seconded by Salzer and passed unanimously.
