HomeMy WebLinkAbout[04] Minutes, April April 10, 2017 Page 1 of 3 Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in regular session on Monday, April 10, 2017 at 6:00 PM in the St. Joseph City Hall opening with the Pledge of Allegiance. Members Present: Chair Gina Dullinger, Commissioners, Matt Johnson, Daryl Schaefer, Troy Goracke, Community Development Director Therese Haffner Members Absent: Chad Hausmann, Steve Olson Others Present: City Administrator Judy Weyrens Approval of the Aaenda: Johnson made a motion to approve the agenda. The motion was seconded by Schaefer and passed unanimously by those present. Aqproval of the Minutes: Dullinger made a motion to approve the minutes of March 13,2017.The motion was seconded by Johnson and passed unanimously by those present. Conditional Use Permit. Kwik Trin: Community Development Director Haffner stated Kwik Trip, Inc. has requested approval of a conditional use permit to allow for a convenience store with a gas station and single bay carwash to be located at the southwest corner of CR 75 and 20th Avenue SE/CR 134. It also borders Minnesota Street EasUCR 134 on the south side. There will be two fueling areas, one for semi- trucks, and one for regular vehicles. The property is within the Transportation Overlay District and the 62 Highway Business district and a convenience store with a gas station and car wash is a permitted conditional use. The plan proposes three accesses and Stearns County as the road authority has reviewed and issued an access permit for finro accesses on Minnesota Street East/CR 134 and a right in only access on 20th Avenue/CR 134. Kwik Trip will be required to add do not enter signage and should vehicles use this as an exit, a permanent median will need to be constructed within 18 months with a temporary fix such as tube delineators. Haffner clarified if vehicles use as an exit for the first week or two it would not trigger a median. Haffner shared that Kwik Trip has requested that condition number two as follows be removed: Condition 2:That the maximum access width for the accesses along Minnesota Street East shall be 36 feet. Haffner referenced the updated findings of fact and decision document before the commissioners clarifying that condition number finro was removed due to the applicant meeting the requirement. Haffner stated that condition number four related to the access at 20th Avenue SE/CR 134 was consistent with Stearns County and was reworded as follows: Condition 4:That at no expense to the City"Do Not Enter"and/or"Not an Exit"signage shall be installed in the parking lot at the access at CR 134/20th Avenue SE. At the sole expense of the Applicant, if traffic uses the access at CR 134/20th Avenue SE as an exit, a permanent median will be required to be constructed along that north/south stretch of CR 134/20th Avenue SE within 18 months with a temporary fix, such as tube delineators placed at the centerline until the median is constructed. Haffner reported that Kwik Trip requested condition number five as follows be removed saying it was too broad. Condition 5:That if it is determined by Stearns County and the City that the transportation system is not functioning adequately due to the development and operation of Kwik Trip, mitigation measures and improvements will need to be implemented, including but not limited to infrastructure improvements. Such mitigation measures and improvements will need to be reviewed and approved by Stearns County and the City and sha!! be at the sole expense of the Applicant. Haffner stated the condition was broad, but requested the applicant work with the city to agree on April 10, 2017 Page 2 of 3 more specific requirements to address concerns based upon a review from engineering, public works and police. The concerns are that 20th Avenue SE is narrow and given the development is to serve semi-truck traffic, staff is concerned with the lack of room, turning movements, and stacking. Dullinger opened the public hearing. Wade Dumond, Kwik Trip: Dumond stated he has been working with Stearns County since June regarding the accesses adding that the City has no jurisdiction on the roads bordering the property. Dumond added Kwik Trip has a permit with the County approving the three access points. Regarding condition number two limiting accesses along Minnesota Street East to 36 feet wide, Dumond stated their engineering department made a mistake and that the westerly access point along Minnesota Street East would remain at 40 feet wide. Regarding condition number four, Kwik Trip has agreed to terms with Stearns County allowing them flexibility with the access on 20th Avenue SE. Dumond added he will bring the concerns regarding condition number five back to their team. Lisa Meyer, 27— 17�''Ave SE: Meyer stated there are concerns with the store being open 24/7 as well as concerns that Kwik Trip will allow semi-truck parking. Dumond stated there is no intention for the location to be a truck stop.Trucks will not be staying long term as there is no additional parking provided for them to do so. Dumond added the store will need to be open 24/7. If not, then they will not build in that location. Meyer asked if Kwik Trip has a PA system. If so,will it be operated 24/7. Dumond stated they do have a PA system that is used to notify consumers not paying at the pump to come inside and pay. Dumond does not see this location as one to have music playing. However, if there is an issue, residents can notify the store manager who can turn it off. As no one else present wished to speak, Dullinger closed the public hearing. Dullinger stated her concerns were the access points and their proximity to intersections. Goracke questioned the construction timeline. Dumond stated it would be a 2018 project and could start anywhere between March and August. The building would be the same size as the other in town with a similar amount of parking spaces. There will be more pavement to allow for the trucks to fuel. There was further discussion on transportation. Goracke made a motion approving the findings of fact and decision recommending the City Council issue a Conditional Use Permit for a convenience store with a gasoline station and car wash with the condition that city staff and the applicant work to address the transportation concerns. The motion was seconded by Schaefer and passed unanimously by those present. Comprehensive Plan: Haffner reported a pop-up event was held at the Community Showcase which had a great turnout. The advisory committee will meet on April 19t''to review public input received so far and an existing conditions report. Planninp Commission Trainina: Haffner stated the City of Sartell has invited the Planning Commission to training sessions on April 17t''and May 15thfrom 6-8pm.The training will go over legal issues and roles and responsibilities. Council Liaison Report: Goracke stated the Council approved an outdoor permit for the July 4th parish festival. April 10, 2017 Page 3 of 3 Weyrens added the City accepted the bids for the Central Business District alley improvements. The bids came in favor of the City and the Council opted to move forward with the assessment hearing. The CSAH 75 pedestrian study will be presented to the Council on April 17tn Ad'ourn: Johnson made a motion to adjourn the meeting at 6:30 PM.
