BACKGROUND INFORMATION: Derek Schaefer has submitted a request to construct a small
addition to an existing home on CR 2. The home was built prior to Stearns County adopting the setback
Ordinance. The home is not exactly straight and the side of the home they are looking to add to
encroaches the front yard setback by three feet. The addition will not create a further encroachment. The
adoption of the Ordinance created the non-conformity. If the property was governed by the St. Joseph
Code of Ordinances, the addition would have been allowed through the non-conforming ordinance
without a variance. The Ordinance allows for residential alternations of up to 20% which is less than the
proposed addition.

NOTICE IS HEREBY GIVEN that the Joint Planning Board of St. Joseph Township and the City of St.
Joseph will be conducting a public hearing on Tuesday, July 25, 2017 at 7:00 PM in the St. Joseph
Government Center, 75 Callaway St E. The purpose of the hearing is to consider a variance to construct a
12ft by 23ft addition onto an existing residential structure. The requested addition is located 117 feet from
the centerline of County Road 2, classified a Minor Collector Road. Section 9.9.9A(3) of the Stearns
County Zoning Ordinance #439 requires a building setback of at least 120 feet from a Minor Collector
Road.
The property under consideration is Lot 2, Block 1 of Rothfork Addition, Section 3, T124N,R29W, St.
Joseph Township. The property address is 31126 County Road 2, St. Joseph MN and the request has
been submitted by Derek Schaefer.

Request: To construct a 12ft by 23ft addition onto an existing residential structure to be
located 117 feet from the centerline of County Road 2, classified a Minor Collector Road.
Said Ordinance requires a building setback of at least 120 feet from a Minor Collector
Road
Background:
The applicants own a 20,OOOsqft lot with a residential structure and attached garage that
was constructed prior to zoning regulations for road setbacks were enacted. None of the
original structure meets the setback requirements. An addition to the backside of the
garage (SE corner) was permitted in 2005 as meeting the road centerline setback.
The applicants are requesting to construct a 12ft x 23ft addition located approximately 9.5ft
north of the previously permitted garage addition on the backside of the house. The NW
corner of the house is 4ft closer to the road than the SW corner so the proposed addition
will be located 117ft from the centerline at its closest point. The existing deck will be
removed and added to the east end of the proposed addition and will meet all setback
requirements.
• The property is zoned Urban Expansion and is located in the City of St. Cloud Drinking
Water Supply Management Area.
• The addition will not result in an increase of potential bedrooms so will not have an
impact on the septic system. As proposed it will meet all septic system setback
requirements.
• Impervious lot coverage upon implementation of the proposed project will be
approximately 19%.
• It is not possible to locate an addition on to the backside of the house without a
variance.
Staff Analysis:
A variance may be granted only when it is in harmony with the general purposes and intent
of the official control and consistent with the comprehensive plan and where the strict
enforcement of county zoning controls will result in practical difficulty.
1. The proposed use is allowed in the zoning districts in which the subject
property is located? The Board shall consider those uses that are considered
permitted, provisional, accessory or conditional in the district (state the type of use
and district for the record).
2. The variance will be in harmony with the general purposes and intent of the
official control(s) (any related Ordinances)? Consider the purposes and intent of
the official controls as follows (Appendix A):
3. The variance will be consistent with the Comprehensive Plan? The Board shall
consider the Goals and Objectives of the Comprehensive Plan to determine if the

request is consistent (Appendix B). (Please state specifically which goals or
objectives are met or not met for the record.)
The variance may be granted if there are Practical Difficulties in complying with the
official control(s) as determined by items 4 through 7 below:
4. The property owner proposes to use the property in a reasonable manner?
The Board shall consider what reasonable use of the property is lost (practical
difficulties) by the strict enforcement of the official control. (Please state why it is
reasonable for the record.)
5. The plight of the landowner is due to circumstances unique to the property,
not created by the landowner? The Board shall consider what circumstances are
unique to the property. (Lot size, lot configuration, wetland, steep slope, Shore
Impact Zone, bluff, floodplain, floodway, etc., one or more should be stated on the
record; what differentiates this parcel from others, not a feature that affects all
parcels similarly.)
6. The variance, if granted, will not alter the essential character of the locality?
The Board shall consider and state for the record why the request does or does not
maintain the character of the area. (Is this request similar to what others have, what
are the near shore conditions of neighbors, similar sized or number of structures
adjacent or in the area.)
7. The need for the variance involves more than economic considerations? The
Board should consider if economics played a role in the request.
The Board of Adjustment may impose conditions in the granting of variances. A condition
must be directly related to and must bear a rough proportionality to the impact created by
the variance. (Mitigating impervious surface with stormwater management, deep rooted
vegetative buffers, raingardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact
situation. Variances are meant to be an infrequent remedy where an Ordinance imposes a
unique and substantial burden.
The Board considers each of the elements in the findings of fact. If any one element
is voted "NO" in the majority, then the criteria for granting a variance has not been
met per Minnesota Statutes, Section 394.27, and the variance, as requested, cannot
be granted.
Alternatives/Recommended Conditions:
1. Grant or deny the variance request based on the Findings of Fact.

STATE OF MINNESOTA ST. JOSEPH JOINT PLANNING BOARD
COUNTY OF STEARNS VARIANCE PROCEEDINGS
In the matter of: Derek Schaefer
The Joint Planning Board considered a request for Variance by Derek Schaefer, property owner, to allow
for the construction of a 12ft by 23ft addition onto an existing residential structure to be located 117 feet
from the centerline of County Road 2, classified as a Minor Collector Road. Stearns County Ordinance #
439 requires a building setback of at least 120 feet from a Minor Collector Road. The property for which
variance is sought is legally described as Lot 002 Block 001 Rothfork Addition, Section 3, Township
124N Range 29W St. Joseph Township. The request for variance has been submitted by Derek Schaefer,
31126 County Road 2, St. Joseph MN 56374.
The matter was duly published and notice was provided to property owners within 1250 feet (.25 mile) of
the above referenced property and the Joint Planning Board conducted a public hearing on July 25, 2017.
The St. Joseph Joint Planning Board hereby adopts the following Findings of Fact supporting the
approval of the proposed variance:
1. The Subject Property is currently zoned Urban Expansion District and within the Orderly
Annexation Area of the City of St. Joseph.
2. The purpose of the Urban Expansion District is to enable the orderly and efficient staging of
urban services, including wastewater, water, electric, gas, roads and communications. This
district is further intended to limit barriers to efficient growth of cities.
3. The Town of St. Joseph and City of St. Joseph have entered into a Memorandum of
Understanding (MOU) dated March 24, 2015.
4. The applicant owns a 20,000 square foot lot with a residential structure and attached garage
that was constructed prior to zoning regulations and the entire original structure does not
meet the required setback.
5. In 2005 the property owner constructed an addition to the SE corner of the garage, meeting
the required setbacks.
6. The applicant is requesting to construct a 12ft by 23ft deck located approximately 9.5ft north
of the previously permitted garage addition on the backside of the house. The NW corner of
the house is 4ft closer to the road than the SW corner of the house; therefore the proposed
addition will be 117ft from the centerline at its closest point.
7. The existing deck will be removed and added to the east end of the proposed addition and
will meet all setback requirements.
8. Stearns County Environmental Services, acting as the Zoning Administrator has provided the
following:
a. The property is zoned Urban Expansion and is located in the City of St. Cloud
Drinking Water Supply Management Area.
b. The addition will not result in an increase of potential bedrooms; therefore the septic
system will not be impacted. The proposed construction is in compliance with the
septic system setback requirements.
c. Impervious lot upon implementation of the proposed project will be approximately
19%, meeting Ordinance requirements.
d. It is not possible to locate an addition on to the backside of the house without a
variance.
9. In reviewing the St. Joseph Code of Ordinances 520.08 Subd. 6 non-conforming uses, the
following is applicable:
Subd. 6: Residential Alterations. Alterations may be made to a residential building
containing non-conforming residential units when they will improve the livability and
safety of such units provided, however, that they do not increase the number of dwelling
units in the building. Additions may be made to non-conforming residential buildings,
limited to an increase in the living area of no more than 20% of the existing main floor
square footage.
The proposed addition is less than 20% of the main accessory building.
10. Granting of a variance is controlled by MN Statute 394.27 Subd. 7 and requires the applicant
to meet ALL the following criteria:
a. The proposed use is allowed in the Zoning district in which the subject property is
located.
b. The proposed use is in harmony with the general purposes and intent of the official
controls.
c. The variance must be consistent with the comprehensive plan.
d. The variance may be granted IF there are practical difficulties in complying with the
official control.
i. The property owner proposes to use the property in a reasonable manner.
ii. The plight of the landowner is due to the circumstances unique to the
property and not created by the landowner.
iii. The variance, if granted, will not alter the essential character of the
locality.
iv. The need for variance involves more than economic
DECISION AND CONCLUSION
Based on the Finding of Fact, the St. Joseph Joint Planning Board hereby approves the Variance
requested by Derek Schaefer to allow the construction of a 12ft by 23ft addition onto the existing
structure located at 31126 County Road 2. Approval is based on the following:
In reviewing the variance in relation to MN Statute 394.27 Subd 7 the Board finds:
a. The proposed addition is consistent to what is allowed in a residential zoning district or in
this matter the Urban Expansion area.
b. The proposed use in in harmony with the general purpose and intent of the official controls.
c. The variance request is consistent with the Comprehensive Plan as the subject property is
located in a residential area meeting the future plans.
d. Practical difficulties exist in applying the strict standards of the Ordinance which include:
i. The property owner is proposing to continue using the property as a residential property
which is a reasonable use.
ii. The Zoning Ordinance was adopted after the main structure was constructed to which the
property owner could not control.
iii. The variance will not alter the characteristic of the neighborhood as the location of the
structure will not be altered and it is located in the same sightline as the other homes.
Further, the addition will be located in the rear of the structure.
iv. The variance request is not related to economic factors as the only way in which the
property could fall into compliance is to physically move the entire house back three feet
which is not practical.
The variance is approved with the following contingencies:
1. The property owners secure all necessary permits before commencing construction.
