Pursuant to due call and notice thereof, the City of St. Joseph and St. Joseph Township met in Joint
session on Wednesday, July 12, 2017 at 7:00 PM at the St. Joseph Government Center,
City of St. Joseph Members Present; Mayor Rick Schultz. Councilors Dale Wick, Bob Loso, Matt Killam,
Troy Goracke. City Administrator Judy Weyrens.
St. Joseph Township Members Present: Chair Jerome Salzer. Supervisors Ralph Eiynck, Mark
Thompson. Town Clerk Ann Reischl.
Others Present: City Attorney Sue Kadlec, Township Attorney Boe Piras, Anne Jarrell, Michael Koltes,
Steve Gohman.
Minutes – Salzer made a motion to approve the minutes of the May 25 meeting; seconded by
Schultz and passed unanimously.
Mayor Schultz stated that he understood the purpose of the meeting was to consider the final draft of the
Ordinances that would govern in the OAA. He was surprised to see that the process has changed to
where the City and Township are considering adopting the Stearns County Ordinance. Therefore, as the
County makes amendments they are automatically enforceable in the OAA. This is opposite of the
direction at the last joint meeting. Township Attorney Boe Piras stated that while trying to identify all the
County Ordinances that would apply it became apparent that the most efficient approach would be to
adopt the Ordinance by reference, not creating a static ordinance for the Joint Planning Board (JPB).
Wick questioned what happens if the County adopts or amends an Ordinance that is contrary to what the
City and Township support. City Attorney Sue Kadlec stated that the Joint Planning Board could opt to
amend the MOU excluding a provision. Weyrens stated that the City and Township receive notices of all
Ordinance amendments/revisions and if one would have an impact to the JPB the information could be
presented and the City/Township would have an opportunity to approach the Stearns County Board or
take action to exclude the OAA. Wick cautioned that there would still be an opportunity that timing could
allow an adverse Ordinance to be in effect for a short period of time.
Piras indicated that a sub committee consisting of City and Township representatives met to discuss the
most efficient manner in which to apply land use regulations and it was the consensus that utilizing the
County Ordinance was most effective. In addition the sub-committee developed a fee schedule that
would be implemented with the adoption of the new MOU.
Schultz questioned the next step in the process. Township Chair Jerome Salzer stated that the Township
will present the revised draft at their next meeting, July 31, 2017. He does not expect any changes to the
document as residents have already had input in the process. Piras stated that the City and Township
will need to conduct a public hearing to adopt the new MOU. Once the Township approves the final
MOU, the hearing can be posted for consideration.
The City and Township agreed to conduct a public hearing on August 16, 2017 at 7:00 PM at the St.
Joseph Government Center to consider final adoption of the MOU at which time the City will serve as the
Zoning Administrator for the OAA. Weyrens stated that due to publication requirements she would need
to know by August 1 if the Township agrees to move forward. Salzer stated that the Board will make a
final decision on July 31.
