easement wasforthesanitarysewer. Inreviewingthesanitarysewerlocation, theeasement canbe
confinedtotheeast20’ (rearlotline) andthenorth5’ (sideyard).
Sincetheeasement isrecordedontheplat, itisconsidered publicrightofwayandcanonlybereleased
throughapublichearingprocess. TheCouncil mustdetermineatthehearingthatitisinthebest
interestoftheCitytorelease theeasement andalltheutilitycompanies must benotifiedforan
opportunity tocomment. Thetablebelowindicatestheresponsefromtheutilitycompaniesverifying
noimpact. CenturyLinkdidrespondtheyhaveinfrastructureintherearlot, buttheproposed easement
willresolvetheirneeds.

EASEMENT CONFINEMENT
Notice is hereby given that a public hearing will be held before the City Council at 6:00 PM,
August 21,2017, at the St.Joseph Government Center, 75 Callaway St E. The purpose of the
hearing is to consider confinement of a sanitary sewer easement located at 108 6th Ave SE.
Administrator The property is legally described as Lot 007 Block 002 Wagner Notch Subdivision and the
request has been submitted by Robert and Margory Rice, 108 6th Ave SE,St.Joseph MN
Judy Weyrens 56374. All persons wishing to speak will be heard. Written testimony should be submitted
