HomeMy WebLinkAbout[04e] CUP Amendment Request Council Agenda Item 4e MEETING DATE: October 2, 2017 AGENDA ITEM: Conditional Use Permit (CUP) Amendment Request Bed and Breakfast (B & B), 29 MN St. E SUBMITTED BY: Community Development BOARD/COMMISSION/COMMITTEE RECOMMENDATION: The Planning Commission (4-0) recommends approval of the amendment to CUP approving the exterior materials to include the existing wood in combination of new brick and accent siding. PREVIOUS COUNCIL ACTION: Last March, the City Council approved a CUP for a B & B at 29 MN St. E following a recommendation of approval by the Planning Commission. The approval included a site plan that indicated the structure would include new siding. BACKGROUND INFORMATION: Cory Ehlert, owner and applicant has requested to amend the approved conditional use permit related to the exterior materials for the B & B. A site plan, along with an elevation plan showing the design and materials was submitted for review and approval as required in the initial request. The approved plan included new hardie board panel siding, brick, and accent siding. The applicant is proposing to use the existing wood siding rather than replace with hardie board siding. The new brick and accent siding would remain. The property is located in the B-1 Central Business District and wood is an approved exterior building material in the B-1 District. Since the approved CUP includes the site and elevation plans and references the approved site and elevation plans in the resolution, a change requires a review and approval by the Planning Commission and City Council. The house is currently under renovation and the applicant has indicated that the existing wood siding is in good condition. The plan submitted with the original CUP noted that the siding would be Hardy board panel siding. Please note that we have decided add several additional enhancements to the enterior look of the house.These include a new roofwith an upgraded architectural shingle, replacement of all the windows,add accent color and siding in the peaks(gable endsj of the house on aU 4 sides and add 1x6 freeze boards at the transition point of the siding and peaks.Also pa+nt the entire exterior of the house,finish the underside of the front deck for improved appearance from the sidewalk. s _ ~ a i ^ a M f V 4 m - v ... WHEREAS, Cory Ehlert, Cory Commercial LLC owner, has properly applied for a conditional use permit amendment related to the exterior materials for the Bed and Breakfast located at property generally described as 29 Minnesota Street East, St. Joseph, MN and legally described as follows: The East 46.00 feet of Lot 14, Block 10, Original Town of St. Joseph, Stearns County, Minnesota. “Subject Property” WHEREAS, the St. Joseph Planning Commission held a public hearing on the conditional use permit amendment request on September 20, 2017, at which time all persons wishing to be heard regarding the matter were given an opportunity to be heard; and WHEREAS, on September 20, 2017, the St. Joseph Planning Commission reviewed the proposed amendment to the conditional use permit and recommended approval of the request for an amendment to the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. JOSEPH, MINNESOTA, hereby makes the following Findings of Fact: 1. That on March 6, 2017, the St. Joseph City Council granted a conditional use permit on the Subject Property for a Bed and Breakfast. 2. That on March 6, 2017, the St. Joseph City Council approved the site and elevation plans as part of the conditional use permit. 3. That the approved exterior materials included new front decks, hardie board siding, accent siding and brick. 4. That Cory Commercial LLC, hereinafter referred to as “Applicant,” properly applied for a conditional use permit amendment to allow for a change from the approved exterior material on the house. 5. That the Applicant requests to use the existing wood siding in lieu of hardie board siding and the front decks, accent siding and brick would remain. 6. That the Bed and Breakfast will be located within the existing home on the property to be remodeled and will be designed, constructed, operated and maintained so as to be harmonious and appropriate in appearance with character of the area and will not be hazardous or disturbing to existing or future neighboring uses. 7. That the Subject Property is zoned B-1, Central Business District and wood is a permitted material in the B-1 ordinance. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. JOSEPH, MINNESOTA, as follows: 1. Based on the aforementioned Findings of Fact, a conditional use permit amendment to allow for wood siding in lieu of hardie board siding for the Bed and Breakfast on the Subject Property is hereby approved. nd Whereupon said resolution was declared duly passed and adopted by the St. Joseph City Council this 2 day of October, 2017.
