PREVIOUS COUNCIL ACTION: The City Council has previously approved the constructed Field
Street with a portion of the costs to be assessed.
BACKGROUND INFORMATION: The construction of Field Street has been completed and the
final assessment roll has been prepared. The assessment roll includes current assessments as well as
deferred assessments and trunk charges. Those property owners that are not in the City or where the
service cannot be connected at this time are indicated as deferred or trunk charges. The City is working
with property owners with deferred street assessment to come to an agreement on the terms and
conditions. It is anticipated that those agreements will be ready for the assessment hearing.
Since the process for assessing property requires two weeks published notice, and the Council has to first
to declare the cost to be assessed, the hearing will not meet the requirements for conduct the hearing on
October 16. Therefore, we are looking at the potential of moving the October 16 meeting to October 23,
one week later.

Declaring Costs to be Assessed and Ordering Preparation
of Proposed Assessment
2016 Field Street Improvements
WHEREAS, a contract has been let for the improvement of Field Street between College
Avenue S, beginning on College Avenue S at a point approximately 1,550 feet north of

Hill Street W, and the southerly extension of 7 Avenue SE to a point approximately 600
th
feet south of the Graceview Estates 4 subdivision; and the improvement of 7 Avenue SE
th
beginning at the intersection of 7 Avenue SE and Elena Ln in the Graceview Estates 4
subdivision and a point approximately 600 feet south of the Graceview Estates 4
subdivision by constructing sanitary sewer, water main, storm drain, storm water
treatment, bituminous street, trail, sidewalk, and lighting improvement.
The estimated cost for such improvement is $1,490,000, and the expenses incurred or to be
incurred in the making of such improvement amount to $631,971.12 so that the total cost
of the improvement will be $2,121,970.12.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH,
MINNESOTA:
1. The portion of the cost of such improvement to be paid by the city is hereby
declared to be $954,743.06 and the portion of the cost to be assessed against
benefited property owners, including deferred and postponed assessments, is
declared to be $1,167,227.06.
2. Assessments shall be payable in equal annual installments extending over a period
of 10 years, the first of the installments to be payable on or before the first Monday
in January 2018, and shall bear interest at the rate of 4.75 percent per annum from
the date of the adoption of the assessment resolution.
3. The City Administrator, with the assistance of the City Engineer, shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece or parcel of land within the district affected, without
regard to cash valuation, as provided by law, and she shall file a copy of such
proposed assessment in her office for public inspection.
4. The City Administrator shall upon the completion of such proposed assessment,
notify the council thereof.

WHEREAS, by a resolution passed by the council on October 2, 2017, the City
Administrator was directed to prepare a proposed assessment of the cost of the
improvement of Field Street between College Avenue S, beginning on College Avenue S
at a point approximately 1,550 feet north of Hill Street W, and the southerly extension of

AND WHEREAS, the City Administrator has notified the council that such proposed
assessment has been completed and filed in his/her office for public inspection,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH,
MINNESOTA:

1. A hearing shall be held on the 23 day of October, 2017 in the St. Joseph
Government Center located at 75 Callaway St E, St. Joseph, MN at 6:30 PM to
pass upon such proposed assessment and at such time and place all persons owning
property affected by such improvement will be given an opportunity to be heard
with reference to such assessment.
2. The City Administrator is hereby directed to cause a notice of the hearing on the
proposed assessment to be published once in the official newspaper at least two
weeks prior to the hearing, and she shall state in the notice the total cost of the
improvement. She also cause mailed notice to be given to the owner of each parcel
described in the assessment roll not less than two weeks prior to the hearings.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the county auditor, pay the whole of the assessment on such property,
with interest accrued to the date of payment, to the date of payment, except that no
interest shall be charged if the entire assessment is paid within 30 days from the
adoption of the assessment. An owner may at any time thereafter, pay to the City
Administrator the entire amount of the assessment remaining unpaid, with interest
accrued to December 31 of the year in which such payment is made. Such payment
must be made before November 15 or interest will be charged through December
31 of the succeeding year.
