BACKGROUND INFORMATION:
The Minnesota Department of Transportation is granting a Limited Use Permit (LUP) to the City
as a condition to constructing the proposed pedestrian trail along CSAH 2 and within MnDOT
right of way (beneath the I-94 interchange bridges),
Similar to the right of way permit requirements issued by other road authorities where the City
has infrastructure in place (ex. trunk water main crossing I-94, or in Stearns County CSAH 2 right
of way), the sole cost and expense to construct and maintain the trail remains the City’s, and the
trail use is subordinate to MnDOT’s use of their property.
MnDOT reviews/renews the LUP’s on a 10-year basis. Therefore, the City must make written
request to extend the LUP not less than 90 days prior to the expiration date of 12/31/17.
BUDGET/FISCAL IMPACT:
Engineer’s Opinion of Construction Cost: $1,182,963
Programmed Federal TAP Funding: $650,594

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. JOSEPH,
MINNESOTA:
1. Limited Use Permit 7380-0026 for the construction of a RECREATIONAL TRAIL within
the Right of Way of TH 94 is hereby approved.
2. The Mayor and Administrator are authorized to execute said permit on behalf of the City of
St. Joseph
