HomeMy WebLinkAbout2018 [09] Sep 10 September 10, 2018 Page 1 of 2 Pursuant to due call and notice thereof, the Planning Commission for the City of St. Joseph met in a regular session on Monday, September 10, 2018 at 6:00 PM in the St. Joseph City Hall opening with the Pledge of Allegiance. Planninq Commission Members Present: Commissioners Troy Goracke, Chad Hausmann, Mike Ross, Daryl Schaefer, Community Development Director Therese Haffner Members Absent: Gina Dullinger, Matt Johnson, Steve Olson Others Present: City Administrator Judy Weyrens, Tyler Keller, AI Keller Approval of the A eq nda: Goracke made a motion to approve the agenda. The motion was seconded by Ross and passed unanimously by those present. Approval of the Minutes: Under the Council Liaison Report Haffner corrected to 2019 budget. Ross made a motion to approve the minutes of August 27, 2018 as amended.The motion was seconded by Schaefer and passed unanimously by those present. Residential Driveway Discussion: Haffner stated that Tyler Keller and AI Keller with Elite Development were here to share background regarding two access that were installed for a new home under construction. Haffner noted that City Ordinance limits single family lots to one access to maintain access management, on-street parking space, and limit interference with easements. Haffner shared how the area cities regulate referencing findings in the staff report and stated the purpose was for discussion only so no formal action would be taken. Tyler Keller stated that he had submitted a building permit to construct a single family home in Graceview 5 on a corner lot and the plans included garage doors on two sides. After the home was constructed he was informed the City only allowed one curb cut per property. At this time the home is constructed and he cannot change the house design. AI Keller stated that he understands limiting curb cuts in residential neighborhoods; however he would like the City to consider allowing a second curb cut when the residential lot abuts two streets (corner lots). Haffner stated the options would be a variance or zoning ordinance text amendment request. Weyrens clarified that it would be considered an after the fact variance. Hausmann questioned the background on the ordinance requirement. Weyrens responded that it was related to the Northland neighborhood and lack of on-street parking. Hausmann stated he would be open to considering an ordinance amendment with a permit requirement. Goracke questioned the building setback. AI Keller said buildings would still have to meet the building setback and the existing garage does. There was discussion on establishing conditions, including not allowing on arterial and collector roadways and ensuring proper spacing from the intersection. Hausmann reiterated that he was willing to consider after the public hearing and hearing staff's recommendation. Hausmann suggested discussing with the city engineer. Telecommunication Tower Ordinance: Haffner noted that in 2017 MN State Law related to small cell equipment in the public right of ways was amended and that St. Joseph's code like other municipalities was drafted before small cell facilities existed. The small cell and distributed antenna systems (DAS) are attached to existing light poles, or other structures. Haffner commented that there was a need to update both the tower and right of way ordinances to properly manage and ensure consistency with federal and state law. Haffner referenced the draft tower ordinance and shared that a public hearing would be scheduled at a future meeting to consider the amendments. Hausmann shared his concerns with new poles and said it was good to address in the tower ordinance and questioned whether the draft ordinance addresses aesthetics. Haffner said it does. Hausmann September 10,2018 Page 2 of 2 questioned permit requirements. Haffner said they were stiil determining permits but it would require a right of way permit if applicable and/or conditional use permit.
