BOARD/COMMISSION/COMMITTEE RECOMMENDATION: Staff recommends approval of
Drainage and Utility Easement agreement accepting the easement for Lot 1,Block 1,Buettner Business
Park as proposed.
PREVIOUS COUNCIL ACTION: In 1999,the City Council approved the fmal plat of Buettner
Business Park. In 2008,the City Council approved a lot split for Lot 1,Block 1,which is void since it was
not recorded with Stearns County.
BACKGROUND INFORMATION: Secured Earning&Warranty LLC owns the subject property,
which located on the southwest corner lot of CR 133 and 15th Ave.NE(lot 1,block 1).The property and
area is within an industrial park. The parcel is 8.31+/-acres and the owner has proposed to subdivide into
two lots. Today,the City's Subdivision Ordinance allows for administrative review and approval of such
a lot split.Drainage and utility easements are required along property lines to provide for lot drainage and
placement of utilities.The typical easement would be 6 feet(12 feet total)along the interior boundary
lines. The lot split does not require City Council approval but approval of the easement agreement is
before the City Council for action.

REQUESTED COUNCIL ACTION: Motion 1: Authorize the Mayor and Administrator to execute the
Easement Agreement related to the administrative subdivision of Lot 1,Block 1 of Buettner Business
Park.

PERMANENT DRAINAGE AND UTILITY EASEMENT
This agreement is made this day of ,2018,by and between Secured
Earnings&Warranty,LLC, a Minnesota limited liability company,hereinafter called"Grantor"and the
City of St.Joseph,Minnesota,a municipal corporation,hereinafter called"Grantee".
That for good and valuable consideration,the receipt and sufficiency of which is hereby
acknowledged,the Grantor does hereby grant and convey to the Grantee and its assigns,forever, a
perpetual drainage and utility easement over and under that part of BUETTNER BUSINESS PARK as
described in the attached EXHIBIT A.
IN WITNESS WHEREOF,the parties have hereunto executed this document the day and year

DRAINAGE AND UTILITY EASEMENT AREA
A 12.00 foot easement, over, under and across that part of Lot 1, Block 1, BUETTNER
BUSINESS PARK, according to the recorded plat thereof, Stearns County, Minnesota, lying
6.00 feet on both sides of the following described centerline: Commencing at the southeast
corner of said Lot 1; thence North 00 degrees 34 minutes 30 seconds West, assumed bearing,
along the east line of said Lot 1, a distance of 326.90 feet, to the point of beginning of the
centerline to be described; thence South 89 degrees 25 minutes 30 seconds West, 581.59 feet, to
the westerly line of said Lot 1 and said centerline there terminating.
The sidelines of said easement are to be prolonged and shortened to terminate at a line drawn
10.00 feet westerly of, as measured at a right angle to and parallel with, said east line of Lot 1
and at a line drawn 10.00 feet easterly of, as measured at a right angle to and parallel with, said
westerly line of Lot 1.
